CIVIL AVIATION ACT 1969

CIVIL AVIATION (AMENDMENT) (NO. 2) REGULATIONS 2019

IN exercise of the powers conferred by section 3

of the

Civil Aviation Act 1969 [Act 3], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Civil Aviation (Amendment)

(No. 2) Regulations 2019.

(2)

These Regulations come into operation on 4 July 2019.

Amendment of regulation 2 2.

The Civil Aviation Regulations 2016 [P.U. (A) 97/2016], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 2

by inserting after the definition of “ornithopter” the following definition:

‘ “lease” means wet lease, dry lease or damp lease;'.

Amendment of regulation 116 3.

Regulation 116 of the principal Regulations is amended—

(a)

in subregulation (1), by substituting for the word “obtain” the words

“apply for”; and

(b)

by deleting subregulation (3).

New regulation 116A

4.

The principal Regulations are amended by inserting after regulation 116

the following regulation:

“Leasing of aircraft between holders of air operator certificate 116A. (1)

The holder of an air operator certificate issued under regulation 110 who intends to lease an aircraft of another holder of an air operator certificate issued under regulation 110 shall apply for an approval of the Authority.

(2)

An application under subregulation (1) shall be made to the

Authority in accordance with regulation 189.”.

Amendment of regulation 117 5.

Regulation 117 of the principal Regulations is amended in the national language text by substituting for the word “pemajakan” the word “pajakan”.

Amendment of Third Schedule 6.

The Third Schedule to the principal Regulations is amended in Part C, by inserting after item 116 and the particulars relating to it the following item and particulars:

“116A

Leasing of aircraft between holders of air operator certificate”.
