Opening note
Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 3 Akta Penerbangan Awam 1969 [Akta 3], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa
Seksyen 2
Pindaan peraturan 198
Peraturan-Peraturan Penerbangan Awam 1996 [P.U. (A) 139/1996] dipinda dengan menggantikan peraturan 198 dengan peraturan yang berikut:
“Langkah-langkah keselamatan
Seksyen 198
(1)
Ketua Pengarah hendaklah bertanggungjawab bagi melindungi penerbangan awam daripada perbuatan gangguan yang menyalahi undang-undang.
(2)
Bagi maksud subperaturan (1), Ketua Pengarah hendaklah mematuhi peruntukan Aneks 17 dan Manual Keselamatan bagi Melindungi
Penerbangan Awam daripada Perbuatan Gangguan yang Menyalahi Undang-Undang yang dikeluarkan oleh ICAO yang dipinda dari semasa ke semasa.
(3)
Tanpa menjejaskan keluasan subperaturan (1) dan (2), Ketua
Pengarah hendaklah menubuhkan suatu Program Keselamatan Penerbangan
Awam Kebangsaan dan apa-apa program keselamatan lain yang terpakai bagi

pengendali kapaludara, pengendali padang terbang, syarikat berlesen, ejen kargo udara, atau mana-mana orang lain yang pada pendapat Ketua Pengarah perlu bagi maksud keselamatan penerbangan.
(4)
Ketua Pengarah boleh, dari semasa ke semasa, di bawah peraturan ini, mengeluarkan notis kepada mana-mana orang yang baginya peraturan ini terpakai yang menghendaki orang itu untuk mengambil apa-apa langkah seperti yang dinyatakan dalam notis itu.”.

CIVIL AVIATION (AMENDMENT) (NO. 3) REGULATIONS 2011

Preamble
- IN exercise of the powers conferred by section 3 of the Civil Aviation Act 1969 [Act 3], the Minister makes the following regulations: Citation and commencement

(1)
These regulations may be cited as the Civil Aviation (Amendment)
(No. 3) Regulations 2011.
Seksyen 2
Amendment of regulation 198
The Civil Aviation Regulations 1996 [P.U. (A) 139/1996] are amended by substituting for regulation 198 the following regulation:
“Safety measures
Seksyen 198
(1)
The Director General shall be responsible for safeguarding civil aviation against acts of unlawful interference.
(2)
For the purpose of subregulation (1), the Director General shall comply with the provisions of Annex 17 and the Security Manual for
Safeguarding Civil Aviation against Acts of Unlawful Interference issued by ICAO as amended from time to time.
(3)
Without prejudice to the generality of subregulations (1) and (2), the Director General shall establish a National Civil Aviation Security Programme and any other security programmes which apply to an aircraft operator, an aerodrome operator, licensed company, air cargo agent, or any other person in

the opinion of the Director General necessary for the purpose of aviation security.
(4)
The Director General may, from time to time, under this regulation, issue notices to any person to whom this regulation applies requiring him to take such measures as specified in the notices.”.
