(a)
dalam perenggan 5, dengan memasukkan selepas perkataan “13,”
perkataan “13A,”; dan
(b)
dengan memasukkan selepas perenggan 6 perenggan yang berikut:
“7.
BAYARAN SEBAGAI GANTI CUTI:
Seseorang Pesuruhjaya Kehakiman yang telah tamat tempoh pelantikannya tetapi tidak dapat mengambil cuti rehat tahunannya disebabkan oleh desakan perkhidmatan, layak diberikan bayaran wang tunai sebagai ganti cuti rehat bersamaan dengan satu pertiga puluh daripada gaji bulanan yang akhir diterimanya bagi setiap hari tertakluk kepada syarat seperti yang berikut:
(a)
maksimum cuti rehat yang dibenarkan bagi maksud pemberian wang tunai adalah sebanyak lapan hari atau satu per empat daripada kadar cuti rehat setahun, mengikut mana yang lebih rendah, dan jika bilangan hari tersebut melibatkan angka perpuluhan, pengiraan hendaklah dibundarkan kepada angka bulat yang terhampir;
(b)
maksimum cuti rehat yang dibenarkan bagi maksud pemberian wang tunai bagi sepanjang tempoh pelantikan
Pesuruhjaya Kehakiman adalah sebanyak tiga puluh lima hari;
(c)
hanya Pesuruhjaya Kehakiman yang telah tamat tempoh pelantikannya dan tidak dilantik sebagai Hakim layak diberikan bayaran tunai sebagai gantian cuti rehat yang tidak dapat diambil;

(d)
tempoh pelantikan yang berkuat kuasa tidak boleh kurang daripada satu tahun; dan
(e)
dia tidak mempunyai apa-apa alasan penghakiman atau kes sambung bicara yang belum selesai.”.

JUDGES’ REMUNERATION ACT 1971
JUDGES’ REMUNERATION (AMENDMENT OF SECOND SCHEDULE AND
FIFTH SCHEDULE) REGULATIONS 2014
IN exercise of the powers conferred by section 19 of the Judges’ Remuneration Act 1971
[Act 45], the Yang di-Pertuan Agong, after consultation with the Chief Justice, makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Judges’ Remuneration
(Amendment of Second Schedule and Fifth Schedule) Regulations 2014.
(2)
These Regulations are deemed to have come into operation on 1 July 2013.
Amendment of Second Schedule 2.
The Judges’ Remuneration Act 1971, which is referred to as the “principal Act” in these Regulations, is amended in the Second Schedule by inserting after paragraph 13
the following paragraph:
“13A. HEALTH INSURANCE COVERAGE FACILITY WHILE BEING ABROAD ON
PERSONAL BUSINESS:
A Judge is eligible to receive health insurance coverage facility while being abroad on personal business in accordance with the rates and conditions as prescribed in the Service Circulars, as accorded to an officer in the public service as revised from time to time.”.
Amendment of Fifth Schedule 3.
The Fifth Schedule to the principal Act is amended―
(a)
in paragraph 5, by inserting after the words “13,” the words “13A,”; and

(b)
by inserting after paragraph 6 the following paragraph:
“7.
PAYMENT IN LIEU OF LEAVE:
A Judicial Commissioner who has reached the end of his appointment but is unable to take his annual vacation leave owing to exigencies of service, is eligible to be given a cash payment in lieu of the leave equivalent to one-thirtieth of his last-drawn monthly salary for each day subject to the following conditions:
(a)
the maximum allowable vacation leave for the purpose of a cash payment is eight days or one-quarter of the rate of the annual vacation leave per year, whichever is lower, and if the number of days involves decimal digits, the calculation shall be rounded to the nearest number;
(b)
the maximum allowable vacation leave for the purpose of a cash payment for the duration of the appointment of the
Judicial Commissioner is thirty-five days;
(c)
only a Judicial Commissioner who has reached the end of his appointment and is not appointed as a Judge is eligible to be given a cash payment in lieu of the leave not taken;
(d)
the period of appointment in force shall not be less than one year; and
(e)
he does not have any pending grounds of judgment or part-heard cases.”.
