Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 11 dan perenggan 60(d) Akta Tenaga Boleh Baharu 2011 [Akta 725], Menteri membuat peraturan-peraturan yang berikut: Nama
Seksyen 2
Cara rayuan
(1)
Seseorang yang terkilan dengan keputusan Pihak Berkuasa yang menolak permohonan bagi kelulusan galakan di bawah seksyen 7 Akta, yang mengenakan apa-apa syarat tambahan atau yang mengubah atau membatalkan mana-mana syarat yang dikenakan atas kelulusan galakan di bawah seksyen 9 Akta atau yang membatalkan kelulusan galakan di bawah seksyen 10 Akta boleh, dalam masa tiga puluh hari dari pemberitahuan keputusan itu kepadanya, merayu kepada Menteri dengan menyampaikan suatu notis rayuan kepada Menteri.
(2)
Suatu notis rayuan di bawah subperaturan (1) hendaklah—
(a)
dibuat secara bertulis dalam bahasa kebangsaan dan boleh disertakan dengan terjemahan dalam bahasa Inggeris;
(d)
mengandungi alamat di mana apa-apa notis atau dokumen yang berhubungan dengan rayuan itu boleh disampaikan kepada perayu; dan

Perayu itu juga hendaklah menyampaikan suatu salinan notis rayuan itu kepada Pihak Berkuasa.
Alasan keputusan
Seksyen 3
Apabila menerima suatu salinan notis rayuan yang disampaikan di bawah subperaturan 2(3), Pihak Berkuasa hendaklah mengemukakan suatu pernyataan alasan keputusannya kepada Menteri dalam masa empat belas hari dari tarikh penerimaan salinan notis rayuan itu.
Seksyen 4
Keputusan Menteri atas rayuan
(1)
Menteri hendaklah, selepas menimbangkan alasan rayuan yang dinyatakan oleh perayu di bawah perenggan 2(2)(c) dan pernyataan alasan keputusan yang dikemukakan oleh Pihak Berkuasa di bawah peraturan 3, memutuskan rayuan itu.
(2)
Keputusan Menteri atas rayuan itu hendaklah disampaikan kepada perayu oleh Pihak Berkuasa melalui suatu notis bertulis dalam masa tujuh hari dari tarikh Pihak Berkuasa diberitahu tentang keputusan itu.

RENEWABLE ENERGY (MANNER OF APPEAL) REGULATIONS 2019
Opening note
Preamble
- IN exercise of the powers conferred by section 11 and paragraph 60(d) of the Renewable Energy Act 2011 [Act 725], the Minister makes the following regulations: Citation 1. These regulations may be cited as the Renewable Energy (Manner of Appeal) Regulations 2019. Manner of appeal 2.
(1)
A person who is aggrieved by the decision of the Authority in refusing an application for a feed-in approval under section 7 of the Act, in imposing any additional conditions or in varying or revoking any conditions imposed on a feed-in approval under section 9 of the Act or in revoking a feed-in approval under section 10 of the
Act may, within thirty days of the decision being notified to him, appeal to the Minister by serving a notice of appeal on the Minister.
(2)
The notice of appeal under subregulation (1) shall—
(a)
be made in writing in the national language and may be accompanied by a translation in the English language;
(d)
contain an address where any notice or document relating to the appeal may be served upon the appellant; and
(3)
The appellant shall also serve a copy of the notice of appeal on the Authority.

Grounds of decision 3.
Upon receipt of a copy of the notice of appeal served under subregulation 2(3), the
Authority shall submit a statement of the grounds of its decision to the Minister within fourteen days from the date of receipt of the copy of notice of appeal.
Decision of Minister on appeal 4.
(1)
The Minister shall, after considering the grounds of appeal stated by the appellant under paragraph 2(2)(c) and the statement of the grounds of decision submitted by the Authority under regulation 3, decide on the appeal.
(2)
The decision of the Minister on the appeal shall be communicated to the appellant by the Authority through a written notice within seven days from the date the
Authority is notified of such decision.
