Dalam Perintah ini, “minyak sawit mentah” ertinya minyak sawit dalam bentuk mentah yang berasal atau yang diekstrak daripada perikarpa buah kelapa sawit, dan termasuklah minyak sawit dalam bentuk mentah yang berasal atau yang diekstrak daripada isirong buah kelapa sawit.

Seseorang yang mengeluarkan minyak sawit mentah hendaklah membayar kepada Lembaga ses sebanyak empat belas ringgit bagi tiap-tiap tan metrik atau sebahagian daripada suatu tan metrik minyak sawit mentah yang dikeluarkan olehnya.

Ses yang kena dibayar di bawah perenggan 3 hendaklah dibayar kepada Lembaga tidak lewat daripada hari terakhir setiap bulan dalam satu tahun kalendar atas minyak sawit mentah yang dikeluarkan olehnya dalam bulan yang sebelumnya.

Seseorang yang mengeluarkan minyak sawit mentah hendaklah mengemukakan kepada Lembaga suatu penyata yang benar dan tepat tentang jumlah minyak sawit mentah yang dikeluarkan olehnya dalam bulan yang sebelumnya dalam

apa-apa borang yang ditentukan oleh Lembaga dan hendaklah memastikan bahawa penyata itu diterima oleh Lembaga tidak lewat daripada hari ketujuh setiap bulan.

Seseorang yang gagal untuk mematuhi subperenggan (1), melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi satu ribu ringgit atau dipenjarakan selama tempoh tidak melebihi enam bulan atau kedua-duanya.

Ses yang kena dibayar di bawah Perintah-Perintah yang dibatalkan berkenaan dengan minyak sawit mentah yang dikeluarkan dalam suku tahun dalam satu tahun kalendar dan setiap bulan dalam satu tahun kalendar sebelum permulaan kuat kuasa Perintah ini hendaklah dibayar kepada Lembaga tidak lewat daripada 31 Januari 2020.

Penyata yang dikehendaki dikemukakan di bawah Perintah-Perintah yang dibatalkan berkenaan dengan minyak sawit mentah yang dikeluarkan dalam bulan sebelum permulaan kuat kuasa Perintah ini hendaklah dikemukakan kepada Lembaga tidak lewat daripada 7 Januari 2020.

MALAYSIAN PALM OIL BOARD (CESS) ORDER 2019

  1. IN exercise of the powers conferred by subsection 35(1) of the Malaysian Palm Oil Board Act 1998 [Act 582], the Minister, after consultation with the Minister of Finance, makes the following order: Citation and commencement 1.

This order may be cited as the Malaysian Palm Oil Board (Cess)

Order 2019.

This Order comes into operation on 1 January 2020.

Interpretation 2.

In this Order, “crude palm oil” means palm oil in crude form originating or extracted from the pericarp of the oil palm fruit, and includes palm oil in crude form originating or extracted from the kernel of the oil palm fruit.

Imposition of cess 3.

A person who produces crude palm oil shall pay to the Board a cess of fourteen ringgit for every metric ton or part of a metric ton of crude palm oil produced by him.

Payment of cess 4.

The cess payable under paragraph 3 shall be paid to the Board not later than the last day of each month of a calendar year on crude palm oil produced by him during the preceding month.

Submission of return 5.

A person who produces crude palm oil shall submit to the Board a true and accurate return of the amount of crude palm oil produced by him in the preceding month in such form as may be determined by the Board and shall ensure that such return is received by the Board not later than the seventh day of each month.

A person who fails to comply with subparagraph (1), shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.

Cess not to be custom duty 6.

The cess payabe under paragraph 3 shall not, for the purposes of its collection and for the enforcement of its collection, be deemed to be a customs duty under the

Customs Act 1967 [Act 235].

Designation of finance officer 7.

For the purpose of subsection 35(7) of the Act, “finance officer” means the

Director General or any officer of the Board to whom the function of the Board is delegated.

Revocation 8.

The Malaysian Palm Oil Board (Cess) Order 2000 [P.U. (A) 154/2000] and the

Malaysian Palm Oil Board (Cess) Order 2001 [P.U. (A) 115/2001] (hereinafter referred to as the “revoked Orders”) are revoked.

Transitional 9.

Suggest a correction

(1)

The cess payable under the revoked Orders in respect of the crude palm oil produced in the quarter of the calendar year and each month of a calendar year preceding the commencement of this Order shall be paid to the Board not later than 31 January 2020.

The returns required to be submitted under the revoked Orders in respect of the crude palm oil produced in the month preceding the commencement of this Order shall be submitted to the Board not later than 7 January 2020.
