Kedua dikecualikan daripada pemakaian subseksyen 6(3), 7(2), 10(1), 10(2), 11(1) dan 11(2) Akta mulai 15 April 2014 hingga 31 Disember 2015.

Pengecualian yang disebut dalam subperenggan (2) tertakluk kepada terma dan syarat yang berikut:

(a)

respons pembayaran di bawah seksyen 6 Akta hendaklah disampaikan kepada pihak yang tidak dibayar dalam masa tiga puluh hari dari penerimaan tuntutan pembayaran;

(b)

hak untuk merujukkan pertikaian kepada adjudikasi oleh pihak yang tidak dibayar atau pihak yang tidak membayar di bawah subseksyen 7(2) Akta hanya boleh dijalankan selepas tamat

tempoh untuk menyampaikan respons pembayaran di bawah subsubperenggan (a);

(c)

responden yang disebut dalam seksyen 10 Akta, dalam masa tiga puluh hari dari penerimaan tuntutan adjudikasi, hendaklah—

(i)

menyampaikan respons adjudikasi bertulis yang hendaklah menjawab tuntutan adjudikasi itu berserta dengan apa-apa dokumen sokongan kepada pihak yang menuntut; dan

(ii)

memberikan adjudikator salinan respons adjudikasi itu berserta dengan apa-apa dokumen sokongan; dan

(d)

pihak yang menuntut yang disebut dalam seksyen 11 Akta, dalam masa tiga puluh hari dari penerimaan respons adjudikasi—

(i)

boleh menyampaikan suatu jawapan bertulis kepada respons adjudikasi itu berserta dengan dokumen sokongan kepada responden; dan

(ii)

hendaklah memberi adjudikator salinan jawapan adjudikasi berserta dengan apa-apa dokumen sokongan.

JADUAL PERTAMA

Suatu kontrak bagi apa-apa kerja pembinaan—

(a)

yang dijalankan dengan segera dan tanpa berlengah disebabkan oleh bencana alam, banjir, tanah runtuh, pemendapan tanah, kebakaran dan hal keadaan kecemasan dan luar jangka yang lain;

(b)

yang berkaitan dengan keselamatan negara atau kemudahan berkaitan keselamatan termasuk pembinaan kemudahan tentera dan polis, pangkalan dan kem tentera, penjara dan kem tahanan, loji kuasa dan loji pembersihan air.

JADUAL KEDUA

Suatu kontrak bagi apa-apa kerja pembinaan yang ditakrifkan di bawah Akta dengan jumlah kontrak dua puluh juta ringgit (RM20,000,000) dan ke bawah.

CONSTRUCTION INDUSTRY PAYMENT AND ADJUDICATION ACT 2012

CONSTRUCTION INDUSTRY PAYMENT AND ADJUDICATION (EXEMPTION)

ORDER 2014

IN exercise of the powers conferred by paragraph 40(b) of the Construction Industry

Payment and Adjudication Act 2012 [Act 746], the Minister, upon considering the recommendation of the Kuala Lumpur Regional Centre for Arbitration, makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the Construction Industry Payment and

Adjudication (Exemption) Order 2014.

(2)

This Order comes into operation on 15 April 2014.

Exemption 2.

(1)

A Government construction contract as specified in the First Schedule is exempted from all provisions of the Act.

(2)

Subject to subparagraph (3), a Government construction contract as specified in the Second Schedule is exempted from the application of subsections 6(3),

7(2), 10(1), 10(2), 11(1) and 11(2) of the Act from 15 April 2014 to 31 December 2015.

(3)

The exemption referred to in subparagraph (2) is subject to the following terms and conditions:

(a)

a payment response under section 6 of the Act shall be served on the unpaid party within thirty days of the receipt of the payment claim;

(b)

the right to refer a dispute to adjudication by the unpaid party or non-paying party under subsection 7(2) of the Act shall only be

exercised after the expiry of the period to serve a payment response under subsubparagraph (a);

(c)

the respondent referred to in section 10 of the Act, within thirty days from the receipt of the adjudication claim, shall—

(i)

serve a written adjudication response which shall answer the adjudication claim together with any supporting document on the claimant; and

(ii)

provide the adjudicator with a copy of the adjudication response together with any supporting document; and

(d)

the claimant referred to in section 11 of the Act, within thirty days from the receipt of the adjudication response—

(i)

may serve a written reply to the adjudication response together with any supporting document on the respondent;

and

(ii)

shall provide the adjudicator with a copy of the adjudication reply together with any supporting document.

FIRST SCHEDULE

A contract for any construction works—

(a)

that is carried out urgently and without delay due to natural disaster, flood, landslide, ground subsidence, fire and other emergency and unforeseen circumstances;

(b)

that relates to national security or security related facilities which includes the construction of military and police facilities, military bases and camps, prison and detention camps, power plant and water treatment plant.

SECOND SCHEDULE

A contract for any construction works as defined under the Act with the contract sum of twenty million ringgit (RM20,000,000) and below.
