- PADA menjalankan kuasa yang diberikan oleh seksyen 263 Akta Perkhidmatan Kewangan 2013 [Akta 758], Menteri, atas syor Bank, membuat perintah yang berikut: Nama dan permulaan kuat kuasa
Seksyen 2
(1)
Anggota Kumpulan Kelab Perlindungan dan Indemniti Antarabangsa
(IGP&I) dikecualikan daripada pemakaian subseksyen 8(1) Akta semata-mata bagi maksud menjalankan perniagaan insurans berkenaan dengan insurans perlindungan dan indemniti bagi kapal yang memiliki berat 5,000 tanan kasar atau kurang, termasuk kapal
Malaysia, bagi tempoh tiga tahun.
(2)
Penanggung insurans yang dinyatakan dalam Jadual dikecualikan daripada pemakaian subseksyen 8(1) Akta semata-mata bagi maksud menjalankan perniagaan insurans berkenaan dengan insurans perlindungan dan indemniti bagi kapal Malaysia yang memiliki berat 300 tanan kasar atau kurang bagi tempoh satu tahun.

Bagi maksud subperenggan (1) dan (2)—
(a)
“insurans perlindungan dan indemniti” ertinya insurans perlindungan dan indemniti yang ditawarkan oleh anggota
Kumpulan Kelab Perlindungan dan Indemniti Antarabangsa
(IGP&I) atau penanggung insurans yang dinyatakan dalam Jadual, mengikut mana-mana yang berkenaan, secara usaha sama dengan
Perlindungan dan Indemniti Malaysia Sdn. Bhd.; dan

(b)
“kapal Malaysia” mempunyai erti yang diberikan kepadanya dalam subseksyen 11(1) Ordinan Perkapalan Saudagar 1952
[Ord. 70/1952].

FINANCIAL SERVICES ACT 2013
FINANCIAL SERVICES (EXEMPTION) ORDER 2019
IN exercise of the powers conferred by section 263
of the
Financial Services Act 2013 [Act 758], the Minister, upon the recommendation of the
Bank, makes the following order:
Citation and commencement 1.
(1)
This order may be cited as the Financial Services (Exemption)
Order 2019.
(2)
This Order is deemed to have come into operation on 25 March 2019.
Exemption from subsection 8(1)

(1)
The members of the International Group of Protection and Indemnity Clubs
(IGP&I) are exempted from the application of subsection 8(1) of the Act for the purpose of carrying on insurance business solely in respect of protection and indemnity insurance for ships of 5,000 gross tonnage or less, including Malaysian ships, for a period of three years.
(2)
The insurers specified in the Schedule are exempted from the application of subsection 8(1) of the Act for the purpose of carrying on insurance business solely in respect of protection and indemnity insurance for Malaysian ships of 300 gross tonnage or less for a period of one year.
(3)
For the purposes of subparagraphs (1) and (2)—
(a)
“protection and indemnity insurance” means the protection and indemnity insurance offered by the members of the International
Group of Protection and Indemnity Clubs (IGP&I) or the insurers specified in the Schedule, as the case may be, in collaboration with the Perlindungan dan Indemniti Malaysia Sdn. Bhd.; and

(b)
“Malaysian ship” has the meaning assigned to it in subsection 11(1)
of the Merchant Shipping Ordinance 1952 [Ord. 70/1952].
