- PADA menjalankan kuasa yang diberikan oleh seksyen 59 Akta Racun Makhluk Perosak 1974 [Akta 149], Menteri membuat perintah yang berikut: Nama

Pengecualian
(1)
Tertakluk kepada subperenggan (2) dan (3), Menteri mengecualikan
Hextar Chemicals Sdn. Bhd. (Nombor Pendaftaran Syarikat : 133061-V) berhubung dengan racun makhluk perosak Plane 20 EC daripada kehendak—
(b)
bagi suatu lesen untuk mengilang racun makhluk perosak itu di bawah seksyen 15 Akta;
(c)
bagi suatu lesen untuk menjual atau menyimpan bagi jualan racun makhluk perosak itu di bawah seksyen 17 Akta; dan
(d)
untuk mendaftarkan pemilikan atau penggunaan racun makhluk perosak itu di bawah perenggan 53A (1)(a) Akta.

diberikan mulai 1 Mac 2018 hingga 1 Mac 2019 melainkan dibatalkan terlebih dahulu oleh Lembaga.

Pengecualian yang disebut dalam subperenggan (1) hendaklah tertakluk kepada syarat seperti yang berikut:
(a)
racun makhluk perosak yang disebut dalam subsubperenggan (1)(a) hendaklah dilabelkan sebagaimana yang ditetapkan oleh Lembaga;
(b)
racun makhluk perosak itu hanya dibenarkan dijual kepada
Delphina
Technik
Sdn.
Bhd.
(Nombor
Pendaftaran
Syarikat : 933670-A) semata-mata bagi tawaran perkhidmatan kerja-kerja penyahseranggaan pesawat udara bagi AirAsia Berhad
(Nombor Pendaftaran Syarikat: 284669-W) di Lapangan Terbang
Antarabangsa Kuala Lumpur;
(c)
kerja-kerja penyahseranggaan itu sebagaimana yang disebut dalam subsubperenggan (3)(b) hendaklah dijalankan oleh seorang pemakai racun makhluk perosak berlesen atau seorang pembantu pemakai racun makhluk perosak berlesen di bawah penyeliaan sendiri seorang pemakai racun makhluk perosak berlesen sebagaimana yang ditakrifkan dalam subkaedah 2 Kaedah-Kaedah
Racun Makhluk Perosak (Pengendali Kawalan Makhluk Perosak)
2004 [P. U. (A) 70/2004] yang diambil khidmat oleh Delphina
Technik Sdn. Bhd.;
(e)
amaun racun makhluk perosak yang dikilang dan dijual itu hendaklah dilaporkan kepada Lembaga tiap-tiap bulan.

Jika mana-mana syarat pengecualian di bawah subperenggan 2(3)
tidak dipatuhi, Lembaga boleh membatalkan pengecualian ini.

PESTICIDES ACT 1974
PESTICIDES (EXEMPTION) ORDER 2018

Preamble
- IN exercise of the powers conferred by section 59 of the Pesticides Act 1974 [Act 149], the Minister makes the following order: Citation 1. This order may be cited as the Pesticides (Exemption) Order 2018. Exemption 2.
(2)
and (3), the
Minister exempts
Hextar Chemicals Sdn. Bhd. (Company Registration Number : 133061-V) in relation to the pesticide Plane 20 EC from the requirement—
(c)
for a licence to sell or store for sale the pesticide under section 17
of the Act; and
(d)
to register possession or use of the pesticide under paragraph 53A (1)(a) of the Act.
(1)
is granted from 1 March 2018 until 1 March 2019 unless revoked earlier by the Board.
(3)
The exemption referred to in subparagraph (1) shall be subject to the following conditions:
(a)
the pesticide referred to in subsubparagraph (1)(a) shall be labelled as prescribed by the Board;

(b)
the pesticide is only allowed to be sold to Delphina Technik Sdn. Bhd.
(Company Registration Number : 933670-A) solely for offer of service of disinsection work of the aircraft for AirAsia Berhad
(Company Registration Number : 284669-W) at the Kuala Lumpur
International Airport;
(c)
the disinsection work as referred to in subsubparagraph (3)(b) shall be carried out by a licensed pesticide applicator or a licensed assistant pesticide applicator under the personal supervision of a licensed pesticide applicator as defined in subrule 2 of the
Pesticides (Pest Control Operator) Rules 2004 [P. U. (A) 70/2004]
employed by Delphina Technik Sdn. Bhd.;
(e)
the amount of pesticide manufactured and sold shall be reported to the Board every month.
(4)
Where any of the conditions of exemption under subparagraph 2(3)
is not complied with, the Board may revoke this exemption.
