Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 615 Akta Syarikat 2016 [Akta 777], Menteri, atas syor Suruhanjaya, membuat perintah yang berikut:

Pengecualian
(1)
Menteri mengecualikan mana-mana penyelesai bagi suatu syarikat asing—
(a)
yang memohon kepada Mahkamah untuk mendapatkan suatu pengiktirafan bagi prosiding asing di bawah seksyen 15 Akta Insolvensi
Rentas Sempadan 2026 [Akta 877]; atau
(b)
yang belum dilantik oleh Mahkamah sebagai penyelesai bagi Malaysia, daripada pemakaian perenggan 578(3)(b) dan subprenggan 578(4)(c)(ii) Akta.
(2)
Dalam perenggan ini, “prosiding asing” mempunyai erti yang diberikan kepadanya di bawah Akta Insolvensi Rentas Sempadan 2026.

COMPANIES (EXEMPTION) ORDER 2026
Opening note
Preamble
- IN exercise of the powers conferred by section 615 of the Companies Act 2016 [Act 777], the Minister, upon the recommendation of the Commission, makes the following order: Citation and commencement 1.
(1)
The Minister exempts any liquidator of a foreign company—
(a)
who applies to the Court for a recognition of foreign proceedings under section 15 of the Cross-Border Insolvency Act 2026 [Act 877]; or
(b)
who has not been appointed by the Court as a liquidator for Malaysia, from the application of paragraph 578(3)(b) and subparagraph 578(4)(c)(ii) of the Act.
(2)
In this paragraph, “foreign proceedings” has the meaning assigned to it in the Cross-Border Insolvency Act 2026.
