PERWAKILAN KUASA DI BAWAH SEKSYEN 5
Preamble
PADA menjalankan kuasa yang diberikan oleh seksyen 5 Akta Perwakilan Kuasa 1956
[Akta 358], Menteri Kewangan mewakilkan kepada tiap-tiap pegawai pengawal yang dilantik di bawah seksyen 15A Akta Tatacara Kewangan 1957 [Akta 61]
kuasa yang diberikan kepada
Menteri
Kewangan oleh perenggan 17(b)
Akta Tatacara Kewangan 1957 berkenaan dengan amaun hasil dan hutang yang tidak boleh didapatkan kembali, tertakluk kepada syarat dan sekatan yang berikut:
kuasa yang diwakilkan hanya boleh dijalankan berkenaan dengan amaun hasil atau hutang yang tidak boleh didapatkan kembali yang tidak lebih daripada lima puluh ribu ringgit dalam mana-mana satu akaun;
kuasa yang diwakilkan tidak boleh diwakilkan semula kepada mana-mana pegawai lain;
tiada apa-apa amaun hasil atau hutang boleh ditinggalkan selagi ada sebarang kemungkinan, tidak kira bagaimana tipis sekalipun, boleh mendapat apa-apa bayaran;
tatacara penilaian yang ditetapkan dalam Arahan Perbendaharaan
No. 328(a) hendaklah diikuti dengan betul;
tidak ada soal pencurian, fraud atau kecuaian pegawai awam berhubung dengan amaun hasil atau hutang yang tidak boleh didapatkan kembali yang akan ditinggalkan;
suatu laporan mengenai amaun hasil atau hutang yang ditinggalkan hendaklah dihantar kepada Perbendaharaan dengan salinan kepada
Ketua Audit Negara atau wakil tempatannya; dan

pegawai pengawal hendaklah mematuhi apa-apa arahan yang dikeluarkan oleh Perbendaharaan dari semasa ke semasa.
Permulaan kuat kuasa 2.
Perwakilan ini hendaklah mula berkuat kuasa pada 30 April 2026.
Pembatalan 3.
Perwakilan yang dibuat di bawah P.U. (B) 436/2007 yang disiarkan pada 30 November 2007 dibatalkan.

DELEGATION OF POWERS ACT 1956
DELEGATION OF POWERS UNDER SECTION 5
Preamble
IN exercise of the powers conferred by section 5
of the
Delegation of Powers Act 1956 [Act 358], the Minister of Finance delegates to every controlling officer appointed under section 15A of the
Financial
Procedure
Act 1957
[Act 61]
the power conferred on the
Minister of Finance by paragraph 17(b) of the Financial Procedure Act 1957
in respect of irrecoverable amounts of revenue and debts, subject to the following conditions and restrictions:
the delegated powers shall only be exercised in respect of irrecoverable amounts of revenue or debts which do not exceed fifty thousand ringgit in any one account;
the delegated powers shall not be re-delegated to any other officer;
no amounts of revenue or debts shall be abandoned as long as there is any possibility, however remote, of obtaining some payment;
the evaluation procedure laid down in Treasury Instruction No. 328(a)
shall be strictly followed;
there is no question of theft, fraud or negligence of a public officer in relation to the irrecoverable amounts of revenue or debts to be abandoned;
a report on the abandoned amounts of revenue or debts shall be sent to the
Treasury with a copy to the Auditor General or his local representative; and
the controlling officer shall comply with such instructions as may be issued by the Treasury from time to time.

Commencement 2.
This delegation shall come into force on 30 April 2026.

The delegation of powers made under P.U. (B) 436/2007 published on the 30 November 2007 is revoked.
