Preamble

An Act to provide for presumption of survivorship in regard to claims to property. [Peninsular Malaysia—23 May 1950; Sabah and Sarawak—25 February 1965] Short title

Section 1

This Act may be cited as the Presumption of Survivorship Act 1950.

Section 2

Presumption of survivorship in regard to claim to property

In all cases where two or more persons die in circumstances rendering it uncertain which of them survived the other or others, such deaths shall (subject to any order of the court) for all purposes affecting the title to property be presumed to have occured in order of seniority and accordingly the younger shall be deemed to have survived the elder.
