Preamble

  1. MENURUT kuasa? yang di-beri kapada-nya, oleh \sekshen,8 Akta kta 30. Universiti dan Kolej. Universiti, 1971, Yang di-Pertuan Agong telah menetapkan satu haribulan Januari, "1972. sa-bagai tarikh bila per-untokan? Perlembagaan Universiti Malaya yang di-tubohkan di-bawah Akta Universiti. Malaya, 1961, sa-bagaimana di-nyatakan di-dalam Jadual bersama ini hendak-lah di-sifatkan sa-bagai berkuatkuasa.

Perlembagaan Universiti Malaya sa-bagaimana di-nyatakan dalam Jadval hendak-Jadual kapada Akta Universiti Malaya, 1961 hendak-lah terhenti (yoctcdasa.

berkuatkuasa. 44/61.

JADUAL

1. Perlembagaan ini boleh-lah di-namakan Perlembagaan Universiti Nama.

Malaya.

2: (1) Dalam Perlembagaan: ini, melainkan: jika paudonaay ayat-nya Tafsirao.

“Universiti” erti-nya Universiti Malaya;

“Yayasan” erti-nya jabatan, sekolah atau lain? badan yang di-tuboh-kan di-bawah sekshen 18;

Sebutan dalam Perlembagaan ini mengenai sa-suatu sekshen ia-lah sebutan mengenai sa-suatu sékshen dalam Perlembagaan ini.

BAHAGIAN J

UNIVERSITI

3. Ada-lah dengan ini di-tubohkan mengikut peruntokan Perlembagaan ini, suatu Universiti yang di-nania dan di-gelar “Universiti Malaya” dan mengikut nama dan gelaran itu Chanselar, Pro-Chanselar, Naib Chanselar dan ahli? pada masa itu bagi Juma‘ah, Majlis dan Senat ada-lah dengan ini di-tubohkan sa-bagai suatu pertubohan perbadanan yang kekal turun temurun, dan dengan kuasa penoh di-bawah nama itu—

(a)

untok mendakwa dan di-dakwa dalam semua mahkamah;

(b)

untok mempunyai dan menggunakan suatu meteri dan dari sa-masa ka-samasa memechah, menukar, mengubah dan mem-baharui meteri itu sa-bagaimana yang di-fikitkan-nya patut;

(c)

bagi maksud Perlembagaan ini, dan tertaklok kapada Statut,

Akta dan Peratoran? untok membeli apa? harta, sama ada harta aleh atau harta tak aleh, dan mengambil, menerima dan memegang apa? harta tersebut yang akan terletakhak pada-nya oleh sebab pembelian itu, atau menurut apa? pertukaran, pem-berian, derma, pajakan, pemberian berwasiat atau lain?;

(d)

untok menjual, menggadaijanji, memajakkan, menukar atau melepaskan mana? harta itu; dan

(e)

untok menjalan dan melaksanakan' mengikut peruntokan

Perlembagaan ini dan peruntokan Statut, Akta dan Peratoran2, semua kuasa dan kewajipan yang di-beri atau di-tanggongkan ka-atas Universiti oleh peruntokan itu.

4. (1) Tertaklok kapada peruntokan Perlembagaan ini, Universiti Fetter fi:

hendak-lah mempunyai kuasa? yang berikut—

(a)

menyediakan kursus pengajaran, mengadakan pepereksaan, membuat peruntokan untok penyelidekan, dan mengambil apa?

langkah lain yang di-dapati perlu atau mustahak untok memaju dan menyibarkan pengetahuan;

(b)

memberi ijazah dan diploma termasok ijazah dan diploma luar kapada orang? yang telah mengikuti kursus pengajian yang di-luluskan oleh Universiti dan telah memenohi apa? kehendak lain sa-bagaimana yang di-tetapkan oleh Akta;

(c)

mengiktiraf ijazah dan diploma yayasan pengajian tinggi yang lain bagi maksud memasoki kursus pengajian dan pepereksaan

Universiti dan juga mengurnia ijazah yang lebeh tinggi kapada pemegang? ijazah atau diploma itu atau kapada siswazah?

memberi ijazah kapada guru Universiti yang telah memenohi apa? kehendak sa-bagaimana yang di-tetapkan oleh Akta;

memberi ijazah kehormat kapada orang? yang telah memberi sumbangan terhadap kemajuan atau penyibaran pengetahuan atau yang telah berbuat jasa chemerlang kapada awam;

(f)

memberi sijil kapada orang yang telah menchapai kechekapan dalam mana? chawangan atau chawangan? pengetahuan;

(g)

mengadakan kerusi?, jawatan? pensharah, dan lain? jawatan dan jabatan, dan membuat perlantekan bagi yang tersebut;

(A)

menubohkan suatu perchetakan Universiti dan menerbitkan buku? dan lain? bahan;

(i)

mendiri, melengkap dan menyenggara perpustakaan, makmal, muzium, dewan? kuliah, bangunan? tempat tinggal dan segala bangunan lain yang di-kehendaki bagi maksud? Universiti, sama ada di-Persekutuan atau di-tempat lain;

(jf) mengada dan mengurnia fellowship, biasiswa, bantuan, derma-siswa, pingat, hadiah dan lain? gelaran, kepujian, kurniaan dan lain? jenis bantuan terhadap kemajuan dan penyibaran penge-tahuan;

(k)

melaborkan apa? wang yang terletakhak pada-nya sa-bagai dermakekal dalam harta tanah atau chagaran? (sama ada di-benarkan sa-bagai pelaboran pemegang amanah atau tidak), sama ada wang itu terletakhak bagi maksud am atau maksud khas, atau apa? wang lain yang tidak di-kehendaki segera bagi perbelanjaan sa-masa, dengan mempunyai kuasa mengubah mana? pelaboran itu serta mendepositkan dari sa-masa ka-samasa apa? wang yang pada masa itu tidak di-laborkan dalam mana? bank yang sama ada dalam akaun deposit tetap atau akaun sa-masa;

() membuat kontrek, melantek kakitangan dan menubohkan amanah? sa-bagaimana yang di-kehendaki bagi maksud

Universiti;

(m)

melantek, menaikkan pangkat dan mengadakan tatatertib bagi pegawai, guru dan kakitangan Universiti;

(n)

membuat peratoran? mengenai sharat? perkhidmatan bagi kakitangan Universiti, termasok sekim perkhidmatan, tangga gaji, chuti dan tatatertib;

menubohkan sekim penchen atau sekim persaraan atau sékim kumpulanwang simpanan bagi faedah pekerja?-nya, din mem-buat perkiraan? dengan pertubohan atau orang lain bagi menubohkan sekim? itu;

(p)

membuat peratoran? dan peruntokan? mengenai tempat tinggal bagi pegawai, guru, kakitangan dan pelajar Universiti dan mengenai kebajikan dan tatatertib guru, kakitangan dan pelajar;

(q)

menuntut dan menerima apa? bayaran sa-bagaimana yang di-tetapkan oleh Akta dari sa-masa ka-samasa; dan

(r)

untok melakukan segala perbuatan dan perkara Jain, sama ada bersangkutan atau tidak dengan kuasa? yang tersebut di-atas itu, sa-bagaimana yang di-perlukan untok memajukan peng-ajaran, penyelidekan, kewangan, pentadbiran, kebajikan dan tatatertib di-Universiti.

Jika Yang di-Pertuan Agong berpuas hati, dengan tujuan hendak mengekal dan memajukan perhubongan luar negeri Persekutuan, ada-lah perlu supaya suatu ijazah kehormatan di-kurniakan kapada sa-saorang pembesar luar negeri, maka atas arahan Yang di-Pertuan

Agong, Universiti hendak-lah mengurniakan ijazah itu sa-bagaimana di-nyatakan dalam arahan itu.

5. Tertaklok kapada peruntokan Perkara 153 Perlembagaan Perseku-tuan, keanggotaan Universiti, sama ada sa-bagai pegawai, guru atau pelajar, ada-lah terbuka kapada semua orang tidak kira jantina, kaum, ugama, bangsa atau kelas, dan tiada apa? ujian mengenai keperchayaan atau penganutan ugama boleh di-lakukan atau di-adakan untok meng-hakkan sa-saorang menjadi anggota atau untok mengurniakan kapada sa-saorang apa? ijazah atau diploma Universiti, dan juga tiada apa?

jua fellowship, biasiswa, bantuan, dermasiswa, pingat, hadiah atau lain?

kepujian atau kurniaan boleh di-hadkan kapada orang? dari sa-suatu kaum, ugama, bangsa atau kelas yang tertentu jika belanja bagi-nya di-bayar daripada wang am Universiti.

6. (1) Meteri Universiti ada-lah meteri yang di-luluskan oleh Chanselar atas shor Majlis dan dengan chara di-luluskan demikian itu juga meteri itu boleh dari sa-masa ka-samasa di-pechahkan, di-tukar, di-ubah dan di-buat baharu.

Meteri Universiti hendak-lah di-simpan dalam jagaan Naib

Chanselar.

(3)

Meteri Universiti tidak boleh di-chapkan pada apa? jua suratchara kechuali di-hadapan—

(a)

Naib Chanselar; dan

(b)

sa-orang lagi ahli Majlis, yang akan menandatangani suratchara itu sa-bagai tanda menunjokkan meteri itu di-chapkan di-hadapan mereka dan tandatangan itu ada-lah menjadi keterangan yang chukup bahawa meteri itu telah di-chapkan dengan sempurna dan sa-patut-nya dan bahawa meteri itu ada-lah meteri Universiti yang sah.

Meteri Universiti hendak-lah di-beri pengiktirafan rasmi dan kehakiman.

(5)

Apa? suratan atau suratchara yang (jika di-sempurnakan oleh sa-saorang yang bukan suatu pertubohan perbadanan) tidak di-kehendaki di-meteri boleh di-sempurnakan dengan chara demikian itu oleh

Universiti dengan sharat bahawa suratan atau suratchara itu hendak-lah

dissempurnakan bagi pehak Universiti olch sa-orang pegawai alau mana?

orang yang di-berikuasa sa-chara am atau khas olch Majlis bagi pehak-nya dan lagi dengan sharat bahawa nama pegawai atau orang yang di-berikuasa demikian itu tclah di-wartakan dengan sempurna-nya.

FEGAWAI2 UNIVERSITI

7. (1) Maka hendak-lah ada sa-orang Chanselar yang menjadi Ketua

Universiti dan apabila hadhir hendak-lah mempengerusikan—

(a)

meshuarat Juma‘ah;

(b)

meshuarat Majlis; dan

(c)

mana? konvokeshen;

dan hendak-lah mempunyai apa? kuasa lain dan menjalankan apa?

kewajipan lain yang di-beri atau di-tanggongkan ka-atas-nya oleh

Perlembagaan ini atau mana? Statut, Akta atau Peratoran.

(2)

Chanselar hendak-lah memegang jawatan sa-lama tempoh tujoh tahun dari tarikh perlantekan-nya, atau sa-hingga ia meletakkan jawatan-nya terlebeh dahulu dari tempoh itu dengan mengutus surat yang di-tandatangani oleh-nya kapada Majlis, atau sa-hingga ia di-pechat oleh Juma‘ah atas sa-suatu sebab yang berpatutan.

Chanselar hendak-lah di-lantek oleh Juma‘ah atas penchalunan

Majlis menurut apa? achara yang di-tetapkan oleh Statut.

(4)

Sa-saorang ada-lah layak di-lantek sa-mula bagi jawatan

Chanselar.

8. (1) Chanselar boleh melantek beberapa orang yang di-fikirkan-nya patut sa-bagai Pro-Chanselar.

(2)

Jika oleh kerana sa-suatu sebab Chanselar tidak berupaya men-jalankan mana? daripada tugas-nya di-bawah Perlembagaan ini atau mana? Statut, Akta atau Peratoran, ia boleh membenarkan mana? Pro-Chanselar menjalankan tugas itu bagi pehak-nya.

Tiap? Pro-Chanselar hendak-lah memegang jawatan sa-lama tempoh yang di-perkenankan oleh Chanselar.

9. (1) Maka hendak-lah ada sa-orang Naib Chanselar yang di-lantek oleh Majlis.

(2)

Pada membuat sa-suatu perlantekan di-bawah sekshen-kechil

(1)

Majlis hendak-lah bertindak mengikut nasihat suatu Jawatankuasa yang terdiri daripada—

(a)

sa-orang Pengerusi yang di-lantek oleh Chanselar;

(b)

dua orang yang di-pileh oleh Majlis dari antara ahli?-nya sendiri;

(c)

dua orang yang di-pileh oleh Senat dari antara ahli?-nya sendiri; dan

(d)

pengapit? yang tidak berhak mengundi sa-ramai tidak lebeh daripada dua orang (yang tidak perlu hadhir dalam meshuarat? jawatankuasa) yang di-lantek oleh Majlis sa-lepas berunding dengan Senat.

Naib Chanselar hendak-lah menjadi pegawai utama kerja dan akademik bagi Universiti.

Ada+lah menjadi kewajipan Naib Chanselar menentukan supaya peruntokan Pctlembagaan ini dan peruntokan Statut, Akta dan Per-atoran? di-patohi, dan ia ada-lah mempunyai segala kuasa yang perlu bagi maksud ini dan, khusus-nya, untok mempastikan supaya tiap?

Pehak-berkuasa atau jawatankuasa sentiasa bertindak menurut kuasa?

atau tugas-nya yang di-tetapkan,

Tertaklok kapada peruntokan Perlembagaan ini, Naib Chanselar hendak-lah menjalankan pengawasan am ka-atas semua peratoran mengenai pengajaran, penyelidekan, kewangan, pentadbiran, kebajikan dan tatatertib di-Universiti, dan boleh menjalankan apa? kuasa lain sa-bagaimana yang di-beri kapada-nya oleh Perlembagaan ini dan mana? Statut, Akta atau Peratoran.

Kuasa Naib Chanselar untok menjalankan pengawasan am ka-atas kebajikan dan tatatertib di-Universiti ada-lah termasok kuasa—

(a)

menggantong sa-saorang kakitangan (sama ada akademik atau bukan akademik) daripada menjalankan tugas atau jawatan-nya sa-lama tempoh tidak lebeh daripada dua bulan atau bagi tempoh yang lebeh lama sa-bagaimana yang di-luluskan oleh

Majlis;

(b)

menggantong sa-saorang pelajar daripada menggunakan kemu-dahan? di-Universiti sa-lama tempoh tidak lebeh daripada satu penggal akademik atau bagi tempoh yang lebeh lama sa-bagaimana yang di-luluskan oleh Majlis; dan

(c)

mendenda sa-chara terus sa-saorang pelajar sa-banyak tidak lebeh daripada $25. Wang yang di-pungut daripada denda itu hendak-lah di-gunakan bagi kebajikan pelajar mengikut budi-bichara Naib Chanselar.

Tempoh jawatan dan lain? sharat perkhidmatan bagi Naib

Chanselar hendak-lah di-tetapkan oleh Majlis, dan hendak-lah di-nyatakan dalam kontrek yang di-chap dengan meteri Universiti.

(8)

Sa-orang atau beberapa orang Timbalan Naib Chanseldr boleh di-adakan dan ia hendak-lah di-lantek oleh Majlis sa-lepas berunding dengan Senat untok sa-lama tempoh yang di-tetapkan oleh Majlis sa-locas ‘Benunding dengan Senat, atau sa-lama tempoh yang di-tetapkan oleh Akta.

Jika Naib Chanselar tidak berupaya menjaJankan mana? dari-pada tugas jawatan-nya sa-lama tempoh yang lama oleh sebab sakit, berchuti atau apa? sebab lain, Timbalan Naib.Chanselar hendak-lah menjalankan tugas? itu; dan jika sa-kira-nya Timbalan Naib Chanselar tidak ada atau tidak berupaya maka Majlis hendak-lah membuat apa?

perkiraan sementara yang di-fikirkan-nya patut untok menjalankan tugas? itu.

10. (1) Maka hendak-lah ada sa-orang Pendaftar, sa-orang Bursar dan sa-orang Pegawai Perpustakaan yang berkhidmat sa-bagai pegawai?

sa-penoh masa Universiti dan yang mempunyai kuasa dan kewajipan?

sa-bagaimana di-tetapkan oleh Statut.

Pendaftar, Bursar dan Pegawai Perpustakaan hendak-lah di-lantek oleh Majlis mengikut nasihat Lembaga Pemileh.

(3)

Tertaklok kapada peruntokan Perlembagaan ini, tempoh jawatan dan lain? sharat perlantekan bagi Pendaftar, Bursar dan Pegawai Per-pustakaan hendak-lah di-tetapkan oleh Majlis.

11. Universiti boleh melantek lain? pegawai atau pengkhidmat sa-bagaimana di-tetapkan oleh Statut.

PEHAK-BERKUASA UNIVERSITI

12. (1) Pehak-berkuasa Universiti ia-lah Juma‘ah, Majlis, Senat, Fakulti,

Yayasan, Lembaga Pengajian, Lembaga Pemileh, Lembaga Kebajikan

Pelajar dan lain? badan sa-bagaimana di-tetapkan oleh Statut sa-bagai

Pehak-berkuasa Universiti.

Tertaklok kapada peruntokan Perlembagaan ini, keanggotaan, kuasa dan achara bagi Pehak-berkuasa itu hendak-lah di-tetapkan oleh

Statut.

13. Juma‘ah hendak-lah terdiri daripada—

(a)

Chanselar;

(b)

Pro-Chanselar;

(c)

Naib Chanselar;

(d)

Naib Chanselar semua Universiti yang di-tubohkan dalam

Persekutuan dan Naib Chanselar lain? Universiti mengikut budibichara Universiti;

(e)

ahli2 Majlis pada masa itu;

(f)

ahli2? Senat pada masa itu;

(g)

lapan orang yang di-lantek oleh Yang di-Pertuan Agong;

(h)

sa-orang yang di-lantek oleh tiap? sa-orang Raja atau Gabenor

Negeri;

sa-orang atau beberapa orang yang di-lantek oleh ketua negara mana? negeri mengikut budibichara Universiti;

(j)

wakil? Persatuan Siswazah sa-bagaimana di-tetapkan oleh Statut;

(k)

wakil? Badan Perundangan Persekutuan dan Negeri dan pehak-berkuasa tempatan sa-bagaimana di-tetapkan oleh Statut;

(J)

wakil? pertubohan yang mengambil bahagian dalam pengajaran atau penyelidekan, pertubohan terpelajar, hospital dan yayasan pelajaran sa-bagaimana di-tetapkan oleh Statut;

(m)

tidak lebeh daripada tiga puloh orang yang di-lantek oleh

Chanselar mengikut shor Naib Chanselar, ia-itu orang? yang mewakili pertubohan? profeshenal, perdagangan, perusahaan, kebudayaan dan lain? pertubohan di-Persekutuan; dan

(n)

Yang di-Pertua dan Setiausaha pada masa itu bagi Persatuan

Mahasiswa Universiti Malaya.

14. Tertaklok kapada peruntokan Perlembagaan ini, Juma‘ah ada-lah mempunyai kuasa—

(a)

menerima laporan tahunan mengenai Universiti dari Naib

Chanselar;

(b)

menerima apa? laporan khas yang di-hantar kapada-nya oleh

Majlis;

(c)

menerima akaun? tahunan Universiti yang telah di-odit;

(d)

meluluskan apa? ketetapan yang di-fikirkan patut oleh Juma‘ah mengenai apa? laporan atau akaun yang di-hantar kapada

Juma‘ah;

(e)

menerima salinan bagi segala Statut;

(f)

meluluskan apa? ketetapan yang di-fikirkan patut oleh Juma‘ah mengenai apa? Statut yang di-terima oleh Juma‘ah;

(g)

menjalankan apa? tugas lain yang di-beri kapada Juma‘ah oleh

Statut.

sa-orang yang di-lantek oleh Raja atau Gabenor ‘Negeri di-mana

Universiti itu terletak; ‘

dua orang yang di-lantek oleh Chanselar;

dua orang yang di-pileh oleh Juma‘ah dari antara ahli?-nya sendiri;

(g)

sa-orang (bukan Dekan Fakulti) yang di-pileh oleh. Senat dari antara ahli?-nya sendiri mengikut chara sa-bagaimana yang di-tetapkan oleh Statut;

(h)

sa-orang Dekan yang di-pilech mengikut giliran sa-bagaimana di-tetapkan oleh Statut; dan

(i)

dua orang yang biasa-nya tinggal di-Persekutuan, yang di-pileh oleh Persatuan Siswazah dari antara ahli?-nya sendiri.

17. (1) Senat hendak-lah terdiri daripada:

(a)

Naib Chanselar yang akan menjadi Pengerusi;

(b)

Timbalan Naib Chanselar;

(c)

Profesor? dan Dekan? Universiti; dan

(d)

lain? orang sa-bagaimana di-tetapkan oleh Statut.

Senat ada-lah menjadi badan akademik bagi Universiti dan, tertaklok kapada peruntokan Perlembagaan ini, Statut, Akta dan

Peratoran?, ada-lah berhak mengawal dan memberi arahan sa-chara am mengenai pengajaran, penyelidekan dan pepereksaan, dan pengurniaan ijazah, diploma dan sijil?.

Dalam melaksanakan kewajipan, tugas dan tanggongjawab-nya.

Senat boleh mewakilkan mana? daripada kewajipan, tugas dan tanggongjawab-nya kapada ahli?-nya atau sa-suatu jawatankuasa yang terdiri daripada ahli?-nya.

18. (1) Universiti hendak-lah di-bahagi kapada beberapa Fakulti,

Yayasan dan Sekolah mengikut nama-nya masing? sa-bagaimana di-tetapkan oleh Statut.

Sa-suatu Fakulti, Yayasan atau Sekolah hendak-lah bertanggong-jawab kapada Senat atas penyusunan pengajaran dalam mata-pelajaran mengenai pengajian dalam bidangkuasa Fakulti, Yayasan atau Sekolah itu, mengikut mana yang berkenaan, dan boleh menjalankan apa? tugas lain sa-bagaimana di-beri kapada-nya oleh Statut, Akta atau Peratoran.

Sa-suatu Fakulti hendak-lah memileh dari antara abli?-nya sa-orang Dekan dan sa-kurang?-nya sa-orang Timbalan Dekan. Dekan itu hendak-lah menjadi pengerusi Fakulti itu dan hendak-lah menjalan-kan apa? tugas lain sa-bagaimana yang di-beri kapada-nya oleh Statut,

Akta atau Peratoran; dan jika Dekan tidak berupaya menjalankan kewajipan? jawatan-nya oleh sebab berchuti atau apa? sebab lain, maka ada-lah sah bagi Timbalan Dekan menjalankan kewajipan? Dekan itu sa-lama tempoh Dekan itu tidak berupaya menjalankan kewajipan?

untok menimbangkan chadangan? yang di-rujok kapada-nya oleh Senat bagi penubohan sa-suatu Fakulti, Yayasan atau

Sekolah baharu; dan dalam mana? satu perkara itu Lembaga Pengajian itu hendak-lah mem-buat laporan mengenai perkara? itu kapada Fakulti atau Fakulti? atau kapada Yayasan atau Yayasan? atau kapada Sekolah atau Sekolah?

atau kapada Senat, mengikut mana yang berkenaan.

20. (1) Suatu Lembaga Pemileh, tertaklok kapada mana? Statut, hendak-lah terdiri daripada—

(a)

Naib Chanselar yang akan menjadi Pengerusi;

(b)

dua orang ahli Majlis yang di-lantek oleh Majlis;

(c)

Dekan atau ketua Fakulti; Yayasan atau Sekolah, atau Dekan?

atau ketua? Fakulti, Yayasan atau Sekolah (jika ada) yang akan di-untokkan Kerusi;

(d)

dua orang ahli Senat yang di-lantek oleh Senat; dan

(e)

mengenai sa-suatu kekosongan bagi mana? Kerusi Klinikal, dua orang ahli yang di-lantek oleh Lembaga Pengurus Hospital

Pengajian yang berkenaan, atau jika tidak ada Lembaga

Pengurus itu, dua ahli yang di-lantek oleh Majlis sa-telah berunding dengan Menteri yang bertanggongjawab atas kesi-hatan.

Kechuali sa-bagaimana di-peruntokkan dalam sekshen-kechil (3)

Lembaga? Pemileh hendak-lah di-panggil bermeshuarat oleh Naib

Chanselar dan meshuarat itu hendak-lah di-pengerusikan oleh Naib

Apabila di-buat keputusan untok mengisi sa-suatu jawatan kechuali jawatan bagi sa-suatu Kerusi, Lembaga Pemileh yang di-panggil bermeshuarat bagi maksud itu hendak-lah di-pengerusikan oleh

Timbalan Naib Chanselar, atau, jika ia tidak ada, oleh sa-orang abli yang di-pileh oleh ahli? yang hadhir dalam meshuarat itu.

Jika Timbalan Naib Chanselar tidak menjadi sa-orang ahli Lem-baga Pemileh, maka bagi maksud meshuarat yang di-pengerusikan-nya di-bawah sekshen-kechil (3) dan bagi maksud keputusan yang di-buat dalam meshuarat itu, ia hendak-lah di-sifatkan sa-bagai sa-orang ahli

Lembaga Pemileh.

Penyertaan pakar luar dalam membuat perlantekan? boleh di-tetapkan oleh Statut.

21. (1) Maka hendak-lah di-tubohkan suatu Lembaga Kebajikan

Pelajar yang terdiri daripada Naib Chanselar dan orang? lain sa-bagai-mana di-lantek oleh Senat.

(2)

Lembaga Kebajikan Pelajar ada-lah mempinyai kuasa? sa-bagai-mana di-tetapkan oleh Statut.

22. (1) Tertaklok kapada kelulusan Majlis, maka ada-lah sah bagi sa-ramai tidak kurang daripada tiga puloh orang siswazah Universiti menubohkan suatu persatuan yang di-namakan Persatuan Siswazah.

Persatuan Siswazah hendak-lah.di-kelola dan di-tadbir mengikut perlembagaan-nya dan kaedah?-nya yang di-buat oleh-nya tetapi tiada sa-suatu perlembagaan tersebut atau kaedah? yang di-buat itu atau apa? pindaan-nya boleh berkuatkuasa melainkan dan sa-hingga ia telah di-luluskan terlebeh dahulu oleh Majlis.

Tiada apa? jua dalam sekshen ini boleh di-tafsirkan sa-bagai menjadikan Persatuan Siswazah itu suatu Pehak-berkuasa bagi Univer-siti atau sa-bagai memberi apa? kuasa kapada-nya untok memileh, sa-bagai wakil?-nya kapada Majlis, orang? yang pada masa itu bekerja dengan Universiti sa-bagai kakitangan akademik dan bukan akademik.

23. (1) Kechuali sa-bagaimana di-tetapkan oleh Perlembagaan ini atau oleh mana? Statut, tempoh jawatan bagi sa-saorang yang di-pileh atau di-lantek sa-bagai ahli bagi sa-suatu Pehak-berkuasa, kechuali ahli ex-Officio, ia-lah tiga tahun:

Dengan sharat bahawa—

(a)

jika orang itu di-pileh atau di-lantek oleh kerana ia memegang sa-suatu jawatan atau oleh kerana ia ada-lah sa-orang ahli bagi sa-suatu Pehak-berkuasa atau badan yang lain, ia hendak-lah berhenti daripada menjadi ahli Pehak-berkuasa itu jika sa-belum habis tempoh jawatan-nya itu ia berhenti daripada memegang jawatan itu atau daripada menjadi ahli Pehak-berkuasa atau badan itu; dan

(b)

sa-saorang yang berhenti apabila habis tempoh jawatan-nya boleh di-pileh atau di-lantek sa-mula jika layak.

(2)

Jika sa-saorang menjadi ahli ex-officio sa-suatu Pehak-berkuasa, maka sa-saorang yang di-lantek untok memangku jawatan-nya itu hendak-lah juga menjadi ahli ex-officio Pehak-berkuasa itu sa-lagi ia memangku jawatan itu dan layak.

Keputusan sa-suatu Pehak-berkuasa ada-lah sah walau pun ada kekosongan antara ahli?-nya.

24. (1) Tertaklok kapada peruntokan Perlembagaan ini dan kapada mana? Statut, Akta atau Peratoran?, sa-suatu soal dalam sa-suatu meshuarat mana? Pehak-berkuasa hendak-lah di-putuskan mengikut kelebehan undi ahli? yang hadhir.

Pengerusi dan tiap? ahli ada-lah berhak mempunyai dan boleh menggunakan satu undi tiap? sa-orang, tetapi jika sa-kira-nya bilangan undi sama banyak-nya Pengerusi ada-lah berhak mempunyai dan boleh menggunakan undi kedua atau undi pemutus.

Statut, Akta, pindaan atau pembatalan itu hendak-lah di-dalam masa satu bulan sa-lepas ia-nya di-buat, di-pinda atau di-batalkan, di-siarkan dalam Warta dan dengan apa? chara lain mengikut sa-bagaimana di-arah oleh Majlis.

BAHAGIAN V

PERUNTOKAN KEWANGAN

32. Majlis hendak-lah melantek suatu Jawatankuasa Tetap Kewangan bagi mengator dan mengawal kewangan Universiti.

33. Ada-lah menjadi kewajipan mana? pegawai atau pegawai?

Universiti sa-bagaimana di-tetapkan oleh Statut menyediakan, untok pertimbangan Naib Chanselar, anggaran pendapatan dan perbelanjaan

Universiti bagi tiap? satu tahun kewangan.

34. (1) Bagi maksud Bahagian ini tahun kewangan ia-lah satu tahun kalendar, atau apa? tempoh lain sa-bagaimana di-tetapkan oleh Majlis.

(2)

Akaun Majlis hendak-lah dengan sa-berapa segera yang boleh di-imbangkan bagi tahun kewangan yang lalu dan suatu penyata tahunan atau chabutan-nya hendak-lah di-sediakan.

(3)

Penyata tahunan atau chabutan yang tersebut dalam sekshen-kechil (2) hendak-lah di-sediakan mengikut bentok dan mengandongi maklumat sa-bagaimana di-arah oleh Majlis dari sa-masa ka-samasa.

35. (1) Majlis hendak-lah, tidak kurang daripada empat bulan sa-belum akhir tahun kewangan, meluluskan anggaran hasil dan per-belanjaan yang lengkap bagi Universiti bagi tahun kewangan yang berikutan dan mengemukakan anggaran itu, bersama dengan ulasan?

Majlis mengenai-nya kapada Menteri.

Sa-belum tarikh yang di-tetapkan bagi meshuarat Majlis bagi maksud meluluskan anggaran itu, Jawatankuasa Tetap Kewangan hendak-lah menyediakan deraf anggaran itu untok di-kemukakan kapada Majlis dan salinan anggaran itu hendak-lah di-serahkan kapada tiap? sa-orang ahli Majlis tidak kurang daripada tujoh hari sa-belum tarikh yang di-tetapkan bagi meshuarat itu.

Tertaklok kapada peruntokan sekshen-kechil (1), Majlis boleh, menurut budibichara-nya, meluluskan, mengubahsuai atau menolak kesemua atau mana? butiran yang terdapat dalam deraf anggaran itu atau merujok kembali mana? butiran itu kapada Jawatankuasa Tetap

Kewangan untok pertimbangan-nya atau menambah apa? butiran dalam deraf anggaran itu.

36. Jika tambahan peruntokan kewangan ada-lah di-kehendaki dalam sa-suatu tahun, Majlis boleh dari sa-masa ka-samasa meluluskan anggaran? tambahan bagi maksud menunjokkan puncha? dari mana sa-suatu perbelanjaan tambahan yang di-lakukan oleh-nya boleh di-bayar.

37. (1) Majlis tidak boleh melakukan apa? perbelanjaan yang tidak termasok dalam sa-suatu anggaran yang di-luluskan:

Dengan sharat bahawa tertaklok kapada peruntokan Perlembagaan ini Majlis boleh memindahkan segala atau mana? bahagian wang yang di-untokkan—

(a)

bagi satu butiran perbelanjaan ulang tahunan kapada satu butiran perbelanjaan ulang tahunan yang lain;

(b)

bagi satu butiran perbelanjaan modal kapada satu butiran perbelanjaan modal yang lain.

(2)

Peruntokan sekshen-kechil (1) tidak di-pakai bagi—

(a)

wang yang di-deposit dengan Universiti oleh mana? orang jika, menurut sharat? deposit itu, mana? wang itu telah genap masa-nya di-bayar balek;

(b)

wang yang di-pungut dan di-kredit kapada Kumpulanwang

Universiti dengan silap;

(c)

wang yang kena di-bayar oleh Universiti menurut apa? hukuman atau perentah mahkamab;

(d)

wang yang di-belanjakan oleh Universiti bagi membawa atau membela pembicharaan di-sisi undang?; dan

(e)

perbelanjaan yang berbangkit dari apa? harta atau wang yang tersebut dalam sekshen 39,

38. Anggaran tahunan dan anggaran tambahan hendak-lah di-sediakan mengikut bentok dan mengandongi maklumat sa-bagaimana di-arah oleh Majlis, dan hendak-lah menunjokkan dalam bahagian?

yang berasing-asing perbelanjaan ulang tahunan dan perbelanjaan modal Universiti.

39. (1) Majlis boleh bagi pehak Universiti menerima sa-bagai pemberian, hadiah, pemberian berwasiat atau lain?, harta atau wang bagi membantu kewangan Universiti atas apa? sharat yang di-tetapkan oleh-nya.

Daftar hendak-lah di-senggara mengenai derma yang di-beri kapada Universiti termasok nama? penderma kapada Universiti dan apa? sharat khas mengenai sa-suatu derma yang di-beri.

40. Segala Harta atau wang yang di-beri bagi sa-suatu maksud tertentu hendak-lah di-guna dan di-tadbirkan mengikut maksud? harta atau wang itu telah di-beri dan hendak-lah di-akaun berasing-asing.

41. Sa-suatu kontrek yang melibatkan perbelanjaan oleh Universiti lebeh daripada lima ribu ringgit hendak-lah di-buat dengan bertulis serta di-tandatangani bagi pehak Universiti oleh sa-orang yang ber-tindak dengan kuasa Universiti yang nyata atau di-sifatkan ada:

Dengan sharat bahawa sa-suatu kontrek (kechuali kontrek yang tersebut dalam sekshen 45 (3) yang melibatkan perbelanjaan oleh

Universiti lebeh daripada sa-puloh ribu ringgit, dan sa-suatu kontrek yang, jika di-buat antara orang? persendirian akan di-kehendaki oleh undang? supaya di-meteri, hendak-lab di-sempurnakan dengan menge-chapkan meteri Universiti pada kontrek itu.

42. Tiada apa? dividen atau bonos boleh di-bayar dan tiada apa?

pemberian atau pembahagian wang boleh di-buat oleh atau bagi pehak

Universiti kapada atau antara mana? ahli-nya kechuali sa-bagai hadiah atau pemberian khas atau menurut sa-suatu sekim simpanan.

44. (1) Konvokeshen untok mernyampaikan ijazah? hendak-lah di-ada-kan tiap tahun, atau sa-berapa kerap mengikut sa-bagaimana yang di-arah oleh Chanselar, pada tarikh yang di-luluskan oleh Chanselar.

Jika Chanselar tidak hadhir atau jika Pro-Chanselar yang di-berikuasa bagi maksud ini oleh Chanselar tidak hadhir maka Naib

Chanselar hendak-lah menjadi pengerusi Konvokeshen.

(3)

Achara Konvokeshen hendak-lah di-tetapkan oleh Akta, tetapi tiada sa-suatu Akta itu boleh di-buat sa-hingga peruntokkan?-nya telah di-rundingkan dengan Chanselar.

45. (1) Semua orang yang di-ambil bekerja oleh Universiti sa-bagai guru,

Pendaftar, Bursar atau Pegawai Perpustakaan, hendak-lah di-lantek sa-bagai demikian oleh Majlis mengikut nasihat Lembaga Pemileh.

Semua orang yang di-ambil atau akan di-ambil bekerja oleh

Universiti kechuali orang? yang tersebut dalam sekshen-kechil (1)

hendak-lah, tertaklok kapada mana? Akta, di-lantek oleh Majlis.

Tiap? orang yang di-ambil bekerja oleh Universiti hendak-lah

Memegang jawatan mengikut apa? sharat sa-bagaimana di-tetapkan oleh

Majlis dan sharat? yang akan di-tetapkan sa-demikian hendak-lah di-sifatkan sa-bagai termasok peruntokan—

(a)

berhubong dengan kewajipan? mengajar, memereksa, menyelia dan lain? kewajipan yang sa-umpama-nya, bahawa kerja-nya ada-lah tertaklok kapada peruntokan Perlembagaan ini dan kapada peruntokan semua Statut, Akta dan Peratoran? sa-bagai-mana di-pinda darj sa-masa ka-samasa; dan

berhubong dengan semua sharat perkhidmatan yang lain, bahawa kerja-nya ada-lah tertaklok kapada peruntokan Perlembagaan ini dan kapada peruntokan semua Statut, Akta dan Peratoran?

yang berkuatkuasa pada tarikh ia mula bekerja.

Tiada apa? jua dalam sekshen ini melarang Majlis daripada membuat apa? kontrek khas dengan sa-saorang yang hendak di-ambil bekerja oleh Universiti jika Majlis berpendapat mustahak berbuat demikian.

46. (1) Walau apa pun peruntokan sekshen 20 dan 45, Yang di-Pertuan

Agong boleh, sa-lepas berunding dengan Chanselar, dari sa-masa ka-samasa melantek orang? yang mempunyai kepujian akademik yang luarbiasa sa-bagai profesor Universiti:

Dengan sharat bahawa bilangan orang yang di-lantek sa-demikian tidak boleh pada bila? masa lebeh daripada tiga orang.

47. Sa-orang pelajar tidak boleh di-terima masok ka-Universiti dalam sa-suatu kursus pengajian untok suatu ijazah melainkan ia (dalam

Bahagian ini di-sebut kemudian daripada ini sa-bagai “siswa berdaftar”)

telah memenohi kehendak? yang di-tetapkan oleh Akta:

Dengan sharat bahawa, kechuali dengan persetujuan Menteri, pelajar yang telah di-beri biasiswa Persekutuan atau biasiswa Negeri, pinjaman atau bantuan kewangan lain yang sa-umpama-nya dari wang awam untok kursus ijazah Universiti, tidak boleh di-tolak jika mereka memenohi kehendak? itu.

48. (1) Ada-lah dengan ini di-tubohkan suatu badan yang di-namakan

Persatuan Mahasiswa Universiti Malaya (kemudian daripada ini di-sebut sa-bagai “Persatuan Mahasiswa”) yang terdiri daripada semua siswa berdaftar Universiti itu yang belum di-beri sa-suatu ijazah.

Tertaklok kapada sekshen-kechil (3), Perlembagaan Persatuan

Mahasiswa dan apa? pindaan atau pembatalan-nya hendak-lah di-luluskan oleh Majlis atau oleh mana? pehak-berkuasa lain sa-bagaimana di-berikuasa bagi maksud ini oleh Statut dan tidak boleh berkuatkuasa sa-hingga di-luluskan sa-demikian.

Tiada apa? jua dalam sekshen ini memberi kuasa kapada Majlis atau pehak-berkuasa yang tersebut dalam sekshen-kechil (2) untok meluluskan Perlembagaan Persatuan Mahasiswa atau apa? pindaan-nya jika Perlembagaan itu tidak mengandongi peruntokan? sekshen-kechil yang berikut.

Kechuali sa-bagaimana di-peruntokkan dalam sekshen-kechil (5)

tiap? ahli Persatuan Mahasiswa ada-lah layak di-pileh untok memegang jawatan dalam Persatuan Mahasiswa.

Tiada sa-saorang graduan layak di-pileh untok memegang jawdtan dalam Persatuan Mahasiswa, tetapi jika sa-saorang ahli Persatuan

Mahasiswa yang sedang memegang jawatan dalam-nya telah menjadi graduan ia boleh terus memegang jawatan itu sa-hingga ijazah telah di-beri sa-benar-nya kapada-nya. Bagi maksud sekshen ini “graduan”

erti-nya sa-orang siswa berdaftar yang telah lulus pepereksaan akhir yang di-adakan oleh Universiti bagi kursus pengajian-nya tetapi belum di-beri ijazah.

Tiada apa? dalam sekshen ini menahan mana? siswazah, yang menjadi pelajar berdaftar, daripada menjadi ahli bersekutu Persatuan

membuat rayuan? kapada Naib Chanselar mengenai segala perkara berhubong dengan keadaan hidup dan kerja pelajar?

mewakili pelajar? yang di-tudoh dalam penyiasatan tatatertib; dan

menjalankan apa? kegiatan lain sa-bagaimana di-tetapkan oleh ajlis dari sa-masa ka-samasa.

Kumpulanwang Persatuan Mahasiswa hendak-lah terdiri dari-pada yuran yang di-bayar oleh ahli? dan derma yang di-terima daripada orang? atau persatuan? yang di-luluskan oleh Majlis. Kumpulanwang tersebut tidak boleh di-belanjakan kechuali bagi tujuan? yang di-nyata-kan dalam sekshen-kechil (9) sahaja dan yang di-luluskan menurut ketetapan yang di-buat oleh Persatuan Mahasiswa mengikut Perlem-bagaan-nya; dan tiada apa? pembayaran boleh di-buat melainkan bitir?

yang menghendaki pembayaran itu (kechuali jika mengikut keadaan hal-nya suatu tesit tidak boleh di-dapati) di-sokong dengan bil méngandongi butir? itu dan juga dengan resit.

Kumpulanwang Persatuan Mahasiswa boleh di-belanjakan untok membayar belanja? pentadbiran Persatuan Mahasiswa termasok belanja mengodit akaun?-nya dan untok membayar apa? belanja berkaitan dengan atau berbangkit daripada apa? yang di-jalankan oleh Petsatuan

Mahasiswa bagi melaksanakan mana? daripada tujuan yang di-nyatakan dalam sekshen-kechil (7):

Dengan sharat bahawa tiada apa? jua yang terkandong dalam ini menghakkan Persatuan Mahasiswa atau mana? pemegang jawatan-nya menggunakan kumpulanwang Persatuan Mahasiswa sa-chara langsong atau sa-chara tidak langsong bagi memajukan tujuan sa-suatu parti politik atau badan kesatuan sekerja atau bagi memajukan tujuan mana?

Persatuan Mahasiswa dan minit? itu hendak-lah di-sahkan dalam meshuarat yang berikut-nya.

49. (1) Walau apa pun peruntokan sekshen 48, tertaklok kapada sekshen-kechil yang berikut dan kelulusan Majlis, maka ada-lah sah bagi sa-ramai tidak kurang daripada sa-puloh orang pelajar pelajar”) yang terdiri daripada pelajar2 Universiti bagi memajukan sa-suatu tujuan atau kepentingan yang tertentu dalam Universiti.

Peruntokan sekshen 48 hendak-lah mutatis mutandis di-pakai bagi sa-suatu badan pelajar yang di-tubohkan di-bawah sekshen ini sa-bagaimana peruntokan itu di-pakai bagi Persatuan Mahasiswa:

Persatuan Mahasiswa dan sa-suatu badan pelajar yang di-tubohkan di-bawah sekshen 49 tidak boleh mengadakan apa? pergabongari dengan mana? parti politik atau badan kesatuan sekerja atau lain? pertubohan yang di-daftar atau di-perbadankan di-bawah mana? undang? bertulis yang berkuatkuasa berhubong dengan-nya:

Menteri boleh membenarkan Persatuan Mahasiswa atau mana?

badan pelajar yang di-tubohkan di-bawah sekshen 49 bergabong dengan mana? badan pelajar antarabangsa.

51. Jika Persatuan Mahasiswa atau sa-suatu badan pelajar yang di-tubohkan di-bawah sekshen 49 menjalankan urusan-nya sa-chara yang, pada pendapat Majlis, boleh merosak atau memudharatkan kesentosaan atau nama baik Universiti atau melakukan perbuatan? bersalahan dengan,

Perlembagaan Universiti atau Perlembagaan-nya sendiri, atau mana?

Statut, Akta atau Peratoran? Universiti, maka Majlis boleh meng-gantong atau membubarkan Persatuan Mahasiswa atau badan pelajar tersebut, mengikut mana yang berkenaan; dan dengan tidak menyentoh apa? tanggongan yang mungkin berbangkit di-bawah mana? undang? ber-tulis lain yang berkuatkuasa, tiap? pemegang jawatan dalam Persatuan

Mahasiswa atau badan pelajar tersebut, mengikut mana yang ber-kenaan, boleh di-buang daripada Universiti atau di-kenakan apa?

hukuman tatatertib.

52. (1) Jika menurut peruntokan? Perlembagaan ini atau mana? Statul,

Akta atau Peratoran?, sa-saorang pegawai atau sa-suatu pehak-berkuasa di-berikuasa menjalankan apa? kuasa atau melaksanakan apa? kewa-jipan, maka pegawai atau pehak-berkuasa itu boleh dengan suratchara bertulis dan tertaklok kapada peruntokan sekshen ini dan kapada apa?

sharat dan sekatan yang di-tetapkan dalam suratchara itu, mewakilkan kuasa atau kewajipan itu supaya di-jalankan oleh mana? pehak-ber-kuasa atau jawatankuasa atau mana? orang yang di-nyatakan dalam suratchara itu mengikut nama atau jawatan-nya.

Sa-suatu perwakilan di-bawah sekshen ini boleh di-batalkan pada bila? masa oleh pegawai atau pehak-berkuasa yang membuat perwakilan itu.

(3)

Tiada apa? perwakilan kuasa atau perwakilan kewajipan di-bawah sekshen ini boleh menyentoh hak bagi pegawai atau pehak-berkuasa yang membuat perwakilan itu menjalankan kuasa atau melaksanakan kewajipan itu.

(4)

Tiada apa? jua dalam sekshen ini di-pakai terhadap apa? kuasa bagi membuat atau meluluskan Statut, Akta atau Peratoran?.

53. Jika mana? ahli sa-suatu Pehak-berkuasa, atau sa-saorang mahasiswa Universiti, atau sa-saorang yang telah menerima diploma atau lain? kepujian akademik daripada Universiti, di-thabitkan oleh sa-suatu mahkamah atas suatu kesalahan jenayah yang burok sama ada dalam atau luar Persekutuan, atau pada pendapat Majlis, melakukan perbuatan skandal, maka ada-lah sah bagi Chanselar, dengan sokongan dari tidak kurang daripada dua pertiga daripada semua ahli Majlis—

(a)

membuang-nya daripada menjadi ahli Pehak-berkuasa itu; atau

(b)

meluchutkan apa? ijazah, diploma atau lain kepujian akademik yang telah di-beri kapada-nya oleh Universiti.

55. Bagi maksud Bahagian ini perbahasaan “tarikh yang di-tetapkan”

ia-lah 1 haribulan Januari, 1972.

56. Tertaklok kapada Peruntokan Perlembagaan ini, Statut? yang ada,

Akta dan Peratoran? yang ada bagi Universiti Malaya yang berkuat-kuasa sa-belum sahaja tarikh yang di-tetapkan, hendak-lah pada dan sa-lepas tarikh itu terus berkuatkuasa.

57. (1) Tertaklok kapada peruntokan Perlembagaan ini dan kapada mana? arahan oleh Majlis harta dan aset yang sa-belum sahaja tarikh yang di-tetapkan terletakhak pada Universiti Malaya atau pada mana?

orang bagi pehak Universiti itu, hendak-lah pada tarikh tersebut terletakhak pada Universiti itu.

Mana? tanah dalam Persekutuan yang sa-belum sahaja tarikh yang di-tetapkan terletakhak pada Universiti Malaya, hendak-lah pada tarikh itu terletakhak pada Universiti itu.

58. Tertaklok kapada peruntokan Perlembagaan ini, segala hak, tanggongan dan kewajipan berhubong dengan apa? perkara yang sa-belum sahaja tarikh yang di-tetapkan menjadi tanggongjawab Univer-siti Malaya hendak-lah pada tarikh itu berpindah kapada Universiti itu.

59. Tertaklok kapada peruntokan Perlembagaan ini, Fakulti, Yayasan dan Sekolah Universiti Malaya yang wujud sa-belum sahaja tarikh yang di-tetapkan hendak-lah masing? menjadi Fakulti, Yayasan dan Sekolah

Universiti itu.

60. Tertaklok kapada peruntokan Perlembagaan ini, semua orang yang sa-belum sahaja tarikh yang di-tetapkan telah di-ambil bekerja oleh Universiti Malaya hendak-lah pada masa dan sa-lepas tarikh itu di-sifatkan sa-bagai di-ambil bekerja sa-bagai sa-demikian oleh Univer-siti itu mengikut sharat? sama saperti di-pakai bagi mereka sa-belum sahaja hari itu.

61. Segala perlantekan, suratchara dan suratan yang berkuatkuasa sa-belum sahaja tarikh yang di-tetapkan hendak-lah terus berkuatkuasa mempunyai kesan sa-olah? telah di-buat atau di-beri di-bawah Per-lembagaan ini.

62. (1) Semua pelajar yang sa-belum sahaja tarikh yang di-tetapkan telah di-terima masok untok menjalani kursus? pengajian yang di-jalankan untok atau atas nama Universiti dan pada tarikh itu maseh menjalani kursus? pengajian itu hendak-lah pada dan sa-lepas tarikh itu di-sifatkan sa-bagai siswa berdaftar di-bawah sekshen 47 Per-lembagaan ini dan pelajar? itu hendak-lah menjadi ahli Persatuan

Mahasiswa Universiti Malaya yang di-tubohkan di-bawah sekshen 48

THE CONSTITUTION OF THE UNIVERSITY OF MALAYA

IN pursuance of the powers conferred upon him under section 8 of the

Universities and University Colleges Act, 1971, the Yang di-Pertuan

Agong has appointed the first day of January, 1972 as the date on which the provisions of the Constitution of the University of Malaya estab-lished under the University of Malaya Act, 1961 as specified in the

Schedule hereto shall be deemed to have effect.

2. The Constitution of the University of Malaya as specified in the

Schedule to the University of Malaya Act, 1961 shall cease to have effect.

This Constitution may be cited as the Constitution of the Univer-sity of Malaya.

2. (1) In this Constitution, unless the context otherwise requires—

“Act” means any Act made in accordance with this Constitution or any Statute;

“Authority” means any of the Authorities of the University referred to in section 12, and includes any Authority established by Statute;

“Chair” means the post of professor;

“Convocation” means a Convocation held in accordance with section 44;

- “Council” means the Council of the University constituted in accor-dance with section 15;

“Court” means the Court of the University constituted in accordance with section 13;

“Faculty” means a Faculty established under section 18;

“Foundation Day” means the date appointed under section 1 of the

University of Malaya Act, 1961;

“Guild of Graduates” means the Guild constituted in accordance with section 22;

“Institution” means a department, school or other body established under section 18;

“Officer” means the Chancellor, a Pro-Chancellor, the Vice-Chancellor, the Deputy Vice-Chancellor, the Dean of a Faculty, the

Registrar, the Bursar, the Librarian, or the holder of any office created by Statute;

“Regulation” means any regulation made by any Authority or officer or other body of the University in accordance with the provisions of this Constitution or any Statute or Act;

“Senate” means the Senate of the University constituted in accordance with section 17;

“Statute” means any Statute made in accordance with this Consti-tution;

“Teacher” means a person appointed to be a teacher by the Council in accordance with this Constitution, and includes a Professor, Reader,

Associate Professor, Lecturer and Assistant Lecturer;

“The University” means the University of Malaya.

References in this Constitution to a section are reference to a section of this Constitution.

Part I

THE UNIVERSITY

Beaiiishing 3. There is hereby established in accordance with the provisions of as body this Constitution, a University with the name and style of “The Univer-corporate. sity of Malaya” by which name and style the Chancellor, the Pro-Chancellors, the Vice-Chancellor and the members for the time being of the Court, the Council and the Senate are hereby constituted a body corporate with perpetual succession, and with full power and authority under such name—

(@) to sue and be sued in all courts;

(b)

to have and use a common seal and from time to time to break, change, alter and make anew such seal as it shall think fit;

(c)

for the purposes of this Constitution, and subject to the Statutes,

Acts and Regulations to purchase any property, movable or

immovable, and to take, accept and hold any stich ptoperty which may become vested in it by virtue of any such purchase, or by any exchange, grant, donation, lease, testamentary dis-position or otherwise;

(d)

to sell, mortgage, lease, exchange or otherwise dispose of any such property; and

(e)

to exercise and perform, in accordance with the provisions of this Constitution and of the Statutes, Acts and’Regulations, all powers and: duties conferred or imposed upoli the University by such provisions.

4. (1) The University shall, subject to the provisions of this Constitu-Powers of tion, have the following powers— University.

(a)

to provide courses of iistruction, to hold examinations, to make provision for research, and to take such other ‘steps as may appear necessary or desirable for the advancement and dis-semination of knowledge;

(b)

to confer degrees and diplomas including éxternal degrees and diplomas upon persons who have followed courses of study approved by the University and have satisfied such other requirements as may be prescribed by Act;

(c)

to recognize the degrees and diplomas of other institutions of higher learning, for the purpose of admission to the courses and examinations of the University and of the award of higher degrees on holders of such degrees or diplomas or..on. graduates re the University on such conditions as may be prescribed by ct;

(d)

to confer degrees upon teachers of the University, who have satisfied such requirements as may be prescribed by Act;

(e)

to confer honorary degrees on persons who have contributed to the advancement or dissemination of knowledge or who have rendered distinguished public service;

(f)

to grant certificates to persons who have attained proficiency in any branch or branches of knowledge;

(g)

to institute chairs, lectureships, and other posts and offices, and to make appointments thereto;

(h)

to establish a University printing press and to publish books and other matter;

() to erect, equip and maintain libraries, laboratories, museums, lecture halls, halls of residence and all other buildings required for the purposes of the University, whether in the Federation or elsewhere;

(f)

to institute and award fellowships, scholarships, exhibitions, bursaries, medals, prizes and other titles, distinctions, awards and other forms of assistance towards the advancement and dissemination of knowledge;

(k)

to invest in land or securities (whether authorised as trustee investments or not) such funds as may be vested in it for the purpose of endowment, whether for general or special purposes, or such other funds as may not be immediately required for current expenditure, with power from time to time to vary any such investment and to deposit any moneys for the time being uninvested with any bank either upon fixed deposit or upon current account;

(J)

to enter into contracts, to appoint such staff and to establish such trusts, as may be required for the purposes of the Univer-sity;

(mm)

to appoint, promote and discipline officers, teachers and staff of the University;

(n)

to regulate the conditions of service of the staff of the Univer-sity, including schemes of service, salary scales, leave and discipline;

(0)

to establish pension or superannuation or provident fund schemes for the benefit of its employees, and to enter into arrangements with other organisations or persons for the establishment of such schemes;

(p)

to regulate and provide for the residence of officers, teachers, staff and students of the University and the welfare and discipline of teachers, staff and students;

(q)

to demand and receive such fees as may from time to time be prescribed by Act; and

(r)

to do all such acts and things, whether or not incidental to the powers aforesaid as may be requisite in order to further instruction, research, finance, administration, welfare and discipline in the University.

(2)

If the Yang di-Pertuan Agong is satisfied, with a view to main-tenance and promotion of the Federation’s foreign relations, that it is necessary to confer an honorary degree upon a foreign dignitary, on the direction by the Yang di-Pertuan Agong the University shall confer such degree as stated in the direction.

5. Subject to the provision of Article 153 of the Federal Constitution, membership of the University, whether as an officer, teacher or student, shall be open to all persons irrespective of sex, race, religion, nationality or class; and no test of religious belief or profession shall be adopted or imposed in order to entitle any persons to be admitted to such membership or to be awarded any degree or diploma of the University, nor shall any fellowship, scholarships, exhibition, bursary, medal, prize or other distinction or award be limited to persons of any particular race, religion, nationality or class if the cost of the same is met from the general funds of the University.

6. (1) The common seal of the University shall be such seal as may be approved by the Chancellor on the recommendation of the Council and such seal may in like manner from time to time be broken, changed, altered and made anew.

(2)

The common seal of the University shall be kept in the custody of the Vice-Chancellor.

(3)

The common seal of the University shall not be affixed to any instrument except in the presence of—

(a)

the Vice-Chancellor; and

(b)

one other member of the Council, who shall sign their names to the instrument in token of such presence;

and such signature shall be sufficient evidence that such seal was duly and properly affixed and that the same is the lawful seal of the

University.

(4)

The seal of the University shall be officially and judicially noticed.

Any document or instrument which (if executed by a person not being a body corporate) will not required to be under seal may in like manner be executed by the University provided that such document or instrument shall be executed on behalf of the University by an officer or any person generally or specially authorised by the Council on their behalf and provided further that the name of such officer or person so authorised is duly gazetted.

Part JI

THE OFFICERS OF THE UNIVERSITY

7. (1) There shall be a Chancellor who shall be the Head of the Univer-the sity and shall preside when present at—

(a)

meetings of the Court;

(b)

meetings of the Council; and

(c)

any Convocation, and shall have such other powers and perform such other duties as may be conferred or imposed upon him by this Constitution or any

Statute, Act or Regulation.

(2)

The Chancellor shall hold office for a period of seven years from the date of his appointment, or until he shall by writing under his hand addressed to the Council earlier resign his office, or until he shall be removed for good cause by the Court.

(3)

The Chancellor shall be appointed by the Court on the nomina-tion of the Council in accordance with such procedure as may be prescribed by Statute.

(4)

A person shall be eligible for reappointment to the office of

Chancellor.

8. (1) The Chancellor may appoint such persons to be Pro-Chancellors as he may consider proper.

(2)

If for any reason the Chancellor is unable to exercise any of his functions under this Constitution or any Statute, Act or Regulation, he may authorise any of the Pro-Chancellors to exercise such functions on his behalf.

(3)

Every Pro-Chancellor shall hold office during the pleasure of the

Chancellor.

9. (1) There shall be a Vice-Chancellor who shall be appointed by the

Council.

(2)

In making an appointment under subsection (1) the Council shall act on the advice of a Committee consisting of—

(a)

a Chairman appointed by the Chancellor;

(b)

two persons elected by the Council from among its own members;

(c)

ig persons elected by the Senate from among its own members;

an

(d)

non-voting assessors, not exceeding two in number (who need not be present at meetings of the Committee) appointed by the

Council after consultation with the Senate.

(3)

The Vice-Chancellor shall be the principal executive and academic officer of the University.

It shall be the duty of the Vice-Chancellor to see that the provi-sions of this Constitution and the Statutes, Acts and Regulations are observed, and he shall have all such powers as may be necessary for this purpose and, in particular, to ensure that every Authority or committee keeps within its powers or terms of reference.

(5)

The Vice-Chancellor shall, subject to the provisions of this

Constitution, exercise general supervision over the arrangements for instruction, research, finance, administration, welfare and discipline in the University, and may exercise such other powers as may be con-ferred upon him by this Constitution and any Statute, Act or

Regulation.

(6)

The power of the Vice-Chancellor to exercise general supervision over welfare and discipline in the University shall include the: power—

(a)

to suspend a member of the staff (academic or non-academic)

from exercising his function or office for a period not exceeding two months or for such longer period as may be approved by the Council;

(b)

to suspend a student from the use of the University facilities for a period not exceeding an academic term of for such longer period as may be approved by the Council; and

(c)

to fine summarily a student not exceeding $25. The moneys collected from the fine shall be used for the student welfare at the discretion of the Vice-Chancellor. ©’

(7)

The terms of office. and other conditions of service of the Vice-Chancellor shall be determined by the Council, and shall be embodied in a contract under the. seal of the University.

(8)

There may be one or more than one Deputy Vice-Chancellor who shall be appointed by the Council after consultation with the Senate for such period as the Council after consultation with the Senate may determine, or as may be prescribed by Act.

(9)

If for any substantial period the Vice-Chancellor is unable by reason of illness, leave of absence or any other cause to exercise any of the functions of his office, the Deputy Vice-Chancellor shall exercise such functions; and in the event of the absence or disability of the

Deputy Vice-Chancellor the Council. shall make such temporary)

arrangements as it may think fit for the exercise of such functions.

10. (1) There shall be a Registrar, a Bursar and a Librarian, who shall be whole-time officers of the University and shall have such powers and duties as may be prescribed by Statute.

(2)

The Registrar, the Bursar and the Librarian shall be appointed by the Council on the advice of the Board of Selection.

(3)

Subject to the provisions of this Constitution, the terms of office and other conditions of appointment of the Registrar, the Bursar and the Librarian shall be determined by the Council.

11. The University may appoint such other officers or servants as may be prescribed by Statute.

Part III

THE UNIVERSITY AUTHORITIES

12. (1) The Authorities of the University shall be the Court, the

Council, the Senate, the Faculties, the Institutions, the Boards of Studies, the Board of Selection, the Board of Student Welfare, and such, other bodies as may be prescribed by Statute ‘as Authorities of the

University.

(2)

Subject to the provisions of this Constitution, the composition, powers and procedure of the Authorities shall be prescribed by Statute.

13. The Court shall consist of—

(a)

the Chancellor;

(b)

the Pro-Chancellors;

(c)

the Vice-Chancellor;

(d)

the Vice-Chancellors of all the Universities established in the

Federation and the Vice-Chancellor of such other University, at the discretion of the University;

(e)

the members for the time being of the Council;

(f)

the members for the time being of the Senate;

(g)

eight persons appointed by the Yang di-Pertuan Agong;

(A)

one person appointed by each Ruler or Governor of a State;

({ one or more persons appointed by the head of state of any country, at the discretion of the University;

(j)

such representatives of the Guild of Graduates as may be prescribed by Statute;

(A)

such representatives of the Federal and State Legislatures and local authorities as may be prescribed by Statute;

(J such representatives of organisations engaged in teaching or research, learned societies, hospitals and educational institutions as may be prescribed by Statute;

(m)

not more than thitty persons appointed by the Chancellor on the recommendation of the Vice-Chancellor being persons representative of professional, commercial, industrial, cultural and other organisations in the Federation; and

(n)

the President and the Secretary for the time being of the

University of Malaya Students’ Union.

14. The Court shall, subject to the provisions of this Constitution, have power—

(a)

to receive an annual report on the University from the Vice-Chancellor;

(b)

to receive such special reports as the Council may submit to

Court;

(c)

to receive the audited annual accounts of the University;

(d)

to pass such resolutions relating to any reports or accounts submitted to the Court as the Court may think fit;

(e)

to receive copies of all Statutes;

(f)

to pass such resolutions relating to any Statute received by the

Court as the Court may think fit; and

(g)

to exercisé such other functions as may be conferred on the

Court by Statute.

15. (1) The Council shall consist of—

(a)

The Vice-Chancellor;

(b)

three persons appointed by the Yang di-Pertuan Agong;

(c)

two persons appointed by the Conference of Rulers;

(d)

one person appointed by the Ruler or Governor of the State in which the University is situated;

(e)

two persons appointed by the Chancellor;

(f)

two persons elected by the Court from among its own members;

(g)

one person (not being a Dean of a Faculty) elected by the

Senate from among its own members in such manner as may be prescribed by Statue;

(h)

one Dean elected in rotation in such manner as may be pres-cribed by Statute; and

(i} two persons ordinarily resident in the Federation, elected by the Guild of Graduates from among its own members.

(2)

Subject to subsection (4), the Council shall from time to time elect one of its members to the Chairman and one to be Deputy

Chairman, and shall transact no business while the office of Chairman is vacant other than the election of a Chairman.

(3)

During any absence of the Chairman from any sitting, the

Deputy Chairman or, if he also is absent, subject to subsection (4)

such other member as may be elected by the members present, shall sit as Chairman of the Council.

(4)

No member of the Council who is a member of the staff or a student of the University shall be eligible for election or to sit as

Chairman or Deputy Chairman of the Council:

Provided that if at any time there shall be no member of the Council so eligible or, although so eligible, willing to accept office or sit as

Chairman or Deputy Chairman, then during any period of such ineligibility or unwillingness the provisions of this subsection shall cease to apply to the Council.

(5)

The Chairman and Deputy Chairman shall vacate the chair on ceasing to be a member of the Council or on becoming disqualified for sitting as Chairman and Deputy Chairman.

(6)

A Deputy Vice-Chancellor, if not a member of the Council under paragraph (g) or (A) of subsection (1), may attend meetings of the

Council but shall have no vote.

ee 16. The Council shall be the executive body of the University, and may exercise all the powers conferred on the University, save in so far as they are by this Constitution or the Statute, Acts and Regulations conferred on some other Authority or body or on some officer of the

University :

Provided that—

(a)

no resolution shall be passed by the Council relating to any matter within the powers of the Senate, unless the Senate has first been given the opportunity of recording and transmitting to the Council its opinion thereon;

(b)

no member of the Council who is a member of the academic staff (other than the Vice-Chancellor and a Dean) shall take part in the proceedings of the Council when it is holding discus-sions or making decisions on the appointment, promotion and other matters relating to the service of a member of the academic staff; and

(c)

no member of the Council who is a student shall take part in the proceedings of the Council when it is holding discussions or making decisions on the appointment, promotion and other matters relating to the service of a member of the academic staff and on the discipline of a student.

17. (1) The Senate shall consist of—

(a)

the Vice-Chancellor, who shall be Chairman;

(b)

the Deputy Vice-Chancellor;

(c)

the professors and deans of the University; and

(d)

such other persons as may be prescribed by Statute.

(2)

The Senate shall be the academic body of the University and, subject to the provisions of this Constitution, the Statutes, Acts and

Regulations, shall have the control and general direction of instruction, research and examination, and the award of degrees, diplomas and certificates.

(3)

In the performance of its duties, functions and responsibilities, the Senate may delegate any of its duties, functions and responsibilities to its members or a committee consisting of its members,

18. (1) The University shall be divided into such number and names of Faculties, Institutions and Schools as may be prescribed by Statute.

(2)

A Faculty, Institution or School shall be responsible to the Senate for the organisation of instruction in the subject of study within the purview of the Faculty, Institution or School, as the case may be, and may exercise such other functions as may be conferred on it by Statute,

Act or Regulation.

(3)

A Faculty shall elect from among its members a Dean and at least one Deputy Dean. The Dean shall be chairman of the Faculty and shall exercise such other functions as may be vested in him by

Statute, Act, or Regulation; and if owing to his absence on leave or for any other reason the Dean is unable to perform the duties of his

Office, it shall be lawful for the Deputy Dean to perform such duties of the Dean for such time as such disability may continue.

(4)

Subject to the provisions of any Statute, the Vice-Chancellor shall have power to appoint a person to be head of an Institution or School, and such head shall be styled by such title as may be prescribed by

Statute, Act or Regulation; and if owing to absence on leave or for any other reason the head of an Institution or School is unable to perform his duties, the Vice-Chancellor may, except as otherwise provided by

Statute, appoint any person to perform such duties for such time as such disability shall continue.

19. A Board of Studies may be appointed by the Senate for either of the following purposes—

(a)

to deal with matters pertaining to one or more Faculties or

Institutions or Schools;

(b)

to consider proposals referred to it by the Senate for the establishment of a new Faculty, Institution or School; and in either case to report thereon to a Faculty or Faculties or to an

Institution or Institutions or School or Schools or to the Senate as the case may require.

20. (1) A Board of Selection shall, subject to any Statute, consist of—

(a)

the Vice-Chancellor. who shall be chairman;

(b)

two members of the Council appointed by the Council;

(c)

the Dean or head of the Faculty, Institution or School or the

Deans or heads of the Faculties, Institutions or Schools (if any)

to which the Chair will be allocated;

(d)

two members of the Senate appointed by the Senate; and

(e)

in the case of a vacancy in a Clinical Chair, two members appointed by the Board of Management of the appropriate

Teaching Hospital, or if there be no such Board of Manage-ment, two members appointed by the Council after consultation with the Minister charged with responsibility for health.

(2)

Save as provided in subsection (3) the Boards of Selection shall be convened and presided by the Vice-Chancellor.

(3)

Whenever it is decided to fill an appointment other than that to a Chair, the Board of Selection convened for the purpose shall bé presided by the Deputy Vice-Chancellor, or, in his absence, by a member elected by the members present at the meeting.

(4)

Where the Deputy Vice-Chancellor is not a member of the Board of Selection, he shall for the purpose of the meeting in which he presides under subsection (3) and the decision made thereat, be deemed to be a member of the Board of Selection.

(5)

The association of external experts with the making of appoint-ments may be prescribed by Statute.

21. (1) There shall be established a Board of Student Welfare which shall consist of the Vice-Chancellor and such other persons as may be appointed by the Senate.

(2)

The Board of Student Welfare shall have such powers as may be prescribed by Statute.

22. (1) Subject to the approval of the Council, it shall be lawful for not less than thirty graduates of the University to form and establish an association to be known as the Guild of Graduates.

(2)

The Guild of Graduates shall be governed and administered in accordance with its constitution and rules made by it and no such con-stitution and rules so made or any amendments thereto shall come into force unless and until approval thereof shall have first been obtained from the Council.

(3)

Nothing in this section shall be construed as constituting the

Guild of Graduates to be an Authority of the University or as conferring any power thereon to elect as its representatives to the Council persons who are for the time being employed by the University as members of its academic and non-academic staff.

23. (1) Except as may be prescribed by this Constitution or by any

Statute, the term of office of a person elected or appointed to be a member of an Authority, otherwise than ex-officio, shall be three years:

Provided that—

(a)

where the person is elected or appointed because he holds an office or is a member of some other Authority or body, he shall cease to be a member of the Authority if before the expiry of his term of office he ceases to hold such office or to be a member of such Authority or body; and

(b)

a person who retires at the end of his term of office shall be eligible for re-election or re-appointment if he is otherwise qualified.

(2)

Where a person is a member of an Authority ex-officio, a person appointed to act for him shall be a member of the Authority ex-officio so long as he is so acting and is otherwise qualified.

(3)

The decisions of an Authority shall be valid notwithstanding any vacancy among its members,

24. (1) Subject to the provisions of this Constitution and to any

Statutes, Acts or Regulations, a question at any meeting of any Autho-rity shall be decided by a majority of the votes of the members present.

(2)

The Chairman and every member shall have and may exercise one vote each, but in the event of an equality of votes the Chairman shall have and may exercise a second or casting vote.

Part IV

STATUTES, ACTS AND REGULATIONS

25. Subject to the provisions of this Constitution, Statutes may be made to deal with any or all of the following matters—

(a)

the powers and duties of the officers of the University;

(b)

the composition, powers, duties and procedure of the Autho-rities of the University;

(c)

the methods of appointment and the conditions of service of the officers and teachers of the University;

(d)

the determination of the degrees, diplomas and other academic distinctions to be conferred by the University;

(e)

the conditions of admission and of residence and the discipline and welfare of students;

(f)

the management of the library;

(g)

all other maters which under this Constitution may be regulated by Statute; and

(A)

matters incidental to or consequential upon any of the matters aforesaid.

26. (1) The Chancellor may, subject to the provisions of this section, make, revoke or amend any Statute.

(2)

The proposal for the making of any new Statute or the revoca-tion .or amendment of any Statute, shall be prepared by the Council.

(3)

A proposal for a new Statute, or of any amendment to a Statute, dealing with any of the following matters, that is to say—

(a)

the powers and duties of the Dean of a Faculty or the Head of an Institution or school;

(b)

the composition, powers, duties and procedure of the Senate, a Faculty, an Institution, a School, a Board of Studies, a Board of Selection, or the Board of Student Welfare;

(c)

the determination of degrees, diplomas, and other academic distinctions to be conferred by the University;

(d)

the methods of appointment and the conditions of service of teachers;

(e)

the conditions of residence and the welfare and discipline of students;

(f)

the management of the library; and

(g)

all other matters within the jurisdiction of all the Senate under this Constitution or any Statute, shall not be submitted to the Chancellor until it has been referred to the Senate and the Senate has reported to the Council its observations thereon.

Every Statute made under this section shall be laid on the table at the next meeting of the Court then following the making of such

Statute.

27. Subject to the provisions of this Constitution and the Statute, Acts may be made for all or any of the following matters—

(a)

the principles governing the award of degrees, diplomas and other academic distinctions;

(b)

the number and scope of examinations;

(c)

the appointment, powers, duties, remuneration and conditions of service of examiners and the conduct of examinations;

(d)

the admission of students to the examinations, degree and diploma courses of the University and to residence in the

University;

(e)

the methods of appointment and the conditions of service of persons in the employment of the University;

(f)

the establishment and regulation of pension, superannuation and provident fund schemes for the benefit of the employees of the University or any section of them;

(g)

the conditions of residence and the welfare and discipline of students;

(h)

the fees to be charged for courses of study, for residence, for admission to examination, for degrees and diplomas, and any other fees that may be levied by the University;

(i)

the management of the lecture halls, the laboratories, research institutes, halls of residence, and all branches of University activity not specifically provided for in this Constitution or by

Statute;

(jf) the constitution, powers and duties of any Board, committee or other body not specifically provided for in this Constitution or by Statute;

(k)

all matters which by this Constitution or any Statute may be prescribed by Act; and

(2.all matters within the powers of the University and not other-wise provided for by this Part of this Constitution.

28. (1) The Council may, subject to the provisions of this section make, amend or revoke any Act.

(2)

The draft of any Act dealing with—

(a)

any matter referred to in paragraphs (a), (b), (c), (d), (g) and

(i)

of section 27; or

(b)

any matter within the jurisdiction of the Senate, shall be proposed by the Senate; and the Council may approve the draft or refer it back to the Senate with observations or proposals for amend-ment, and no such Act shall be made until the Senate has agreed to its terms.

29. (1) The Court, the Council and the Senate may each make regula-tions for its own procedure.

(2)

The Council may after consulting the Senate make regulations for the procedure of Boards of Selection.

(3)

The Senate may make regulations for the procedure of a Faculty,

Institution, School or Board of Studies, or of any other board or com-mittee subject to the jurisdiction of the Senate.

The Senate may make regulations prescribing courses of study or syllabi of examinations,

Regulations may be made by any Authority if it is so empowered by this Constitution, Statute or an Act.

30. (1) When any new Statute or Act is made, amended or revoked every such Statute, Act, amendment or revocation shall within one month after the same shall have been made or done be published in the

Gazette and in such other manner as the Council may direct.

(2)

The Statutes, Acts and Regulations of the University as amended from time to time shall be published in book form at such intervals as the Council may direct, and copies shall be made available for pur-chase at a reasonable price by members of the public.

(3)

Nothing in this section shall apply to—

(a)

any Act or Regulation containing only instructions to examiners or invigilators; or

(b)

any Act or Regulation which the Council resolves not to publish.

31. In the event of—

(a)

any Statute being inconsistent with the provisions of this

Constitution; or

(b)

any Act being inconsistent with the provisions of this Consti-tution or any Statute; or

(c)

any regulation being inconsistent with the provisions of this

Constitution or any Statute or Act, then the provisions of the Constitution, Statute or Act, as the case may be, shall prevail, and such Statute, Act or Regulations, as the case may be, shall to the extent of the inconsistency be void.

Part V

FINANCIAL PROVISIONS

32. The Council shall appoint a Standing Finance Committee for regulating and controlling the finances of the University.

33. It shall be the duty of such officer or officers of the University as may be prescribed by Statute to prepare for the consideration of the

Vice-Chancellor the estimates of income and expenditure of the

University for each financial year.

34, (1) For the purposes of this Part the financial year shall be the calendar year or such other period as the Council may determine.

(2)

The accounts of the Council shall, as soon as may be, be balanced for the preceding financial year and an annual statement or abstract thereof shall be prepared.

(3)

The annual statement or abstract referred to in subsection (2)

shall be prepared in such form and shall contain such information as the Council may from time to time direct.

35. (1) The Council shall, not less than four months before the end of the financial year, approve detailed estimates of revenue and expenditure of the University for the next financial year and present such estimates, together with the comments of the Council thereon, to the Minister.

Before the date fixed for the meeting of the Council for the purpose of approving such estimates the Standing Finance Comimittee shall prepare draft estimates for submission to the Council, and the copy of such estimates shall be delivered to each member of the Council not less than seven days before the date fixed for such meeting.

, (3) The Council may, subject to the provisions of subsection (1), in its discretion approve, modify or reject all or any of the items appearing in such draft estimates or refer any item back to the Standing Finance

Committee for its consideration or add any item hereto.

36. Where additional financial provision is required in any year the

Council may from time to time approve supplementary estimates fot the purpose of showing the sources from which any additional ex-penditure incurred by it may be met.

37, (1) The Council shall not incur any expenditure which has not been included in any approved estimates:

Provided that subject to the provisions of this Constitution the

Council may transfer all or any part of the moneys assigned—

(a)

to one item of annually recurrent expenditure to another item of annually recurrent expenditure;

(b)

to one item of capital expenditure to another item of capital expenditure.

(2)

The provisions of subsection (1) shall not apply to—

(a)

moneys deposited with the University by any person, wherever by the conditions of such deposit any such sum has become repayable;

(b)

moneys collected and credited to the Funds of the University in error;

(c)

moneys payable by the University under any judgment or order of court;

(d)

moneys expended by the University in instituting or defending legal proceedings; and

(e)

expenditure arising out of any property of moneys referred to in section 39,

38. The annual and supplementary estimates shall be prepared in such form and shall contain such information as the Council may direct, and shall show in separate parts the annually recurrent expen-diture of the University.

39. (1) The Council may on behalf of the University accept by way of grant, gift, testamentary disposition or otherwise, property and moneys in aid of the finances of the University on such conditions as it may determine.

(2)

Registers shall be kept of all donations to the University including the names of donors to the University and any special conditions on which any donation may have been given.

40. All property, moneys or funds given for any specific purposes shall be applied and administered in accordance with the purposes for which they may have been given and shall be separately accounted for.

41. Any contract involving the expenditure by the University of more than five thousand dollars shall be in writing, signed on behalf of the

University by a person acting under the express or implied authority of the University:

Provided that any contract (other than a contract referred to in subsection (3) of section 45) involving expenditure by the University of more than ten thousand dollars, and any contract which if made between private persons would be required by law to be under seal shall be executed by affixing thereto the common seal of the University.

42, No dividend or bonus shall be paid and no gift or division of money shall be made by or on behalf of the University to or among any of its members except by way of prize, reward or special grant or under any provident scheme.

43. (1) The accounts of the University shall be audited annually by auditors appointed by the Council.

(2)

The audited accounts, with any observation made thereon by the auditors, shall be presented to the Court at its next meeting.

Part VI

GENERAL PROVISIONS

44, (1) A Convocation for the conferment of degrees shall be held annually, or as often as the Chancellor may direct, on such date as may be approved by the Chancellor.

(2)

In the absence of the Chancellor or of a Pro-Chancellor, authorised for this purpose by the Chancellor, the Vice-Chancellor shall preside over

Convocation.

(3)

The procedure of Convocation shall be prescribed by Act, but no such Act shall be made until the Chancellor has been consulted about its terms.

45. (1) All persons employed or to be employed by the University as teachers, the Registrar, the Bursar or the Librarian, shall be appointed as such by the Council on the advice of the Board of Selection.

(2)

All persons employed or to be employed by the University other than those mentioned in subsection (1) shall, subject to any Act, be appointed by the Council.

(3)

Every person employed by the University shall hold office on such terms and conditions as may be prescribed by the Council and the terms and conditions to be so prescribed shall be deemed to include a provision—

(@) in relation to teaching, examining, invigilating and other similar duties, that his employment is subject to the provisions of this

Constitution and to the provisions of all Statutes, Acts and

Regulations as from time to time amended; and

(b)

in relation to all other terms and conditions of service that his employment is subject to the provisions of this Constitution and to the provisions of all Statute, Acts and Regulations in force on the date of the commencement of his employment.

(4)

Nothing in this section shall prevent the Council from entering into a special confractual arrangement with a person to be so employed by the University if it is in-the opinion of the Council expedient so to do.

46. (1) Notwithstanding the provisions of section 20 and 45, the

Yang di-Pertuan Agong may, after consultation with the Chancellor, from time to time appoint persons of exceptional academic distinction to be professors of the University:

Provided that the number of persons so appointed shall not at any time exceed three in number.

(2)

Any person appointed under subsection (1) shall be known as a

Royal Professor and—

(a)

shall hold office upon such terms and conditions as the

Chancellor with the approval of the Yang di-Pertuan Agong may deem appropriate; and

(b)

subject to the terms of his appointment and to any direction by the Chancellor, shall have all the powers and perform all the duties conferred or imposed upon professors by this

Constitution, and any Statute, Act and Regulation made there-under.

47. A student shall not be admitted to the University to a course of study for a degree unless he (hereinafter in this Part referred to as a

“matriculated student”) shall have satisfied such requirements as may be prescribed by Act:

Provided that, except with the agreement of the Minister, students who have been awarded Federal or State scholarships, loans or other similar financial assistance from public funds for University degree courses, shall not be refused admission if they satisfy such requirements.

48. (1) There is hereby established a body to be known as the University of Malaya Students’ Union (hereinafter referred to as “the Students’

Union”) consisting of all matriculated students of the University who have not been conferred a degree.

(2)

Subject to subsection (3), the Constitution of the Students’ Union and any amendment or revocation thereof shall be approved by the

Council or by such other authority as may be authorised for this purpose by Statute and shall have no effect until so approved.

(3)

Nothing in this section shall empower the Council or the authority referred to in subsection (2) to approve the Constitution of the Students’

Union or any amendment thereof where the Constitution does not contain the provisions of the following subsections.

(4)

Except as provided in subsection (5) every member of the Students’

Union shall be eligible to be elected to hold office in the Students’ Union.

(5)

No graduand shall be eligible to be elected to hold office in the

Students’ Union, but if a member of the Students’ Union who is holding office therein has become a graduand he may continue to hold the office until a degree shall have in fact been conferred upon him.

For the purpose of this section a “graduand” means a matriculated student who has passed the final examination held by the University for his course of studies but has not yet been conferred a degree.

(6)

Nothing in this section shall preclude any graduate, who is a registered student, from becoming an associate member of the Students’

nion.

(7)

The objects and functions of the Students’ Union shall be—

(a)

to foster a spirit of corporate life among the students of the

University;

(b)

to organize and supervise, subject to the direction of the Vice-Chancellor, student welfare facilities in the University including recreational] facilities, spiritual and religious activities, and the supply of meals and refreshments;

(c)

to make representations to the Vice-Chancellor on all matters relating to, or connected with, the living and working conditions of the students of the University;

(d)

to be represented on any body which may in accordance with an Act made by the Council for the purpose, be appointed to undertake student welfare activities in the University;

(e)

to assist the University authorities to maintain discipline among students;

(f)

to represent students who are accused in disciplinary inquiries;

and

(g)

to undertake such other activities as may be determined by the

Council from time to time.

(8)

The fund of the Students’ Union shall consist of subscriptions paid by members and donations received from persons or organisations approved by the Council. The said fund shall not be expended except only for the objects stated in subsection (9) and approved by the resolution passed by the Students’ Union in accordance with its Consti-tution; and no payment shall be made unless the particulars requiring payment shall (except where from the nature of the case a receipt is not obtainable) be vouched for by a bill stating the particulars and by a receipt.

(9)

The fund of the Students’ Union may be expended for payment of administrative costs of the Students’ Union including audit of its accounts and for any payment connected with or arising out of the carrying out by the Students’ Union of any of the objects specified in subsection (7):

Provided that nothing herein contained shall entitle the Students’

Union or any office bearer thereof to apply the fund of the Students’

Union either directly or indirectly for the promotion of the objects of a political party or a trade union body or for the promotion of the objects of any organization to which it is not affiliated.

(10)

The Treasurer shall keep proper accounts of income and expenditure of the fund of the Students’ Union and not later than three months after the end of every financial year as defined by the Consti-tution of the Students’ Union a copy of the said accounts which shall be audited by a person appointed by the Council and renumerated by the Students’ Union shall be submitted by the Students’ Union for approval to the Council.

The Students’ Union shall hold meetings from time to time as it may deem necessary and it shall be the duty of the Secretary to keep minutes of every meeting of the Students’ Union and such minutes shall be confirmed at a subsequent meeting.

49. (1) Notwithstanding section 48, it shall be lawful for not less than ten students, subject to the following subsections and the approval of the Council, to establish a body (hereinafter referred to as “a student body”) consisting of students of the University for the promotion of specific object or interest within the University.

(2)

The provisions of section 48 shall mutatis mutandis apply to a student body established under this section as they apply to the

Students’ Union:

Provided that nothing in this section or section 48 shall prevent the

Students’ Union from giving such contributions or grants as it may deem necessary.

50. The Students’ Union and a student body established under section 49 shall have no affiliation with any political party or a trade union body or other organisation registered or incorporated under any written law in force relating thereto:

Provided that—

(a)

the Council may permit the Students’ Union or any student body established under section 49 to affiliate with another student body registered under any law relating to the registra-tion of societies; and

(b)

the Minister may permit the Students’ Union or any student body established under section 49 to affiliate with any inter-national student body.

51. If the Students’ Union or a student body established under section 49 conducts itself in a manner which in the opinion of the Council is detrimental or prejudicial to the well-being or reputation of the

University or acts in contravention of the Constitution of the University or its own Constitution, or any Statute, Act or Regulation of the

University, the Council may suspend or dissolve the Students’ Union or the said student body, as the case may be; and without prejudice to any liability that may arise under any other written law in force, every office bearer of the Students’ Union or the said student body, as the case may be, shall be liable to dismissal from the University or to any other disciplinary punishment that may be inflicted upon him.

52. (1) Where by the provisions of this Constitution or any Statute, Act or Regulation any officer or authority is empowered to exercise any power or perform any duty, such officer or authority may by instrument in writing subject to the provisions of this section and to such conditions and restrictions as may be prescribed in such instrument, delegate the exercise of such powers or the performance of such duties to any authority or to any committee or to any person described therein by name or office.

(2)

A delegation under this section may be revoked at any time by the officer or authority making such delegation.

(3)

No delegation of any power or duty under this section shall affect the exercise of such power or the performance of such duty by the officer or Authority making such delegation.

(4)

Nothing in this section shall apply to any power to make or approve Statutes, Acts or Regulations.

53. If any member of an Authority, or any graduate of the University, or any person who has received a diploma or other academic distinction from the University, is convicted by a court of law of any heinous offence whether within or without the Federation, or is in the opinion of the Council guilty of scandalous conduct, it shall be lawful for the

Chancellor, on the recommendation of not less than two-thirds of all the members of the Council—

(a)

to remove him from membership of the Authority; or

(b)

to deprive him of any degree, diploma or other academic distinction conferred upon him by the University.

54. If any question arises whether any person has been duly elected, appointed, nominated or co-opted to membership, or is entitled to be or to remain a member of any Authority or other body in the University, the question shall be referred to the Chancellor, whose decision thereon shall be final.

Part VII

TRANSITIONAL PROVISIONS

55. For the purpose of this Part the expression “the appointed date”

shall be the 1st day of January, 1972.

56. Subject to the provisions of this Constitution, the existing Statutes,

Acts and Regulations of the University of Malaya in force immediately before the appointed date, shall on and after that date continue to be in force.

57. (1) Subject to the provisions of this Constitution and to any direction by the Council, all property and assets which immediately before the appointed date were vested in the University of Malaya or in any person on behalf of the University, shall on that date vest in the

University.

(2)

Any land in the Federation which immediately before the appointed date was vested in the University of Malaya, shall on that date vest in the University. :

58. Subject to the provisions of this Constitution, all rights, liabilities and obligations relating to any matter which immediately before the appointed date was the responsibility of the University of Malaya shall on that date devolve upon the University.

59. Subject to the provisions of this Constitution, the Faculties,

Institutions and Schools of the University of Malaya in existence immediately before the appointed date shall respectively be the

Faculties, Institutions and Schools of the University.

60. Subject to the provisions of this Constitution, all persons which immediately before the appointed date were employed by the University of Malaya shall on and after that date be deemed to be employed as such by the University upon the same terms and conditions as were applicable to them immediately before that date.

61. All appointments, instruments and documents which are in force immediately before the appointed date shall continue to be in force and have effect as if they had been made or granted under this

Constitution.

62. (1) All students who immediately before the appointed date were admitted to undergo courses of studies run for or in the name of the

University and on that date are still undergoing the courses of studies shall on and after that date be deemed to be matriculated students under section 47 of this Constitution and such students shall become members of the University of Malaya Students’ Union constituted under section 48 of this Constitution.

(2)

All properties and assets which immediately before the appointed date were vested in the University of Malaya Students’ Union or in any person for or on behalf of the University of Malaya Students’ Union shall on and after that date vest in the Students’ Union.

All rights, liabilities and obligations relating to any matter which immediately before the appointed date were the responsibility of the

University of Malaya Students’ Union shall on and after that date devolve upon the Students’ Union, or on such person or office bearer as the Vice-Chancellor may by order appoint.

Pei, Libis 63. Any student body formed under the Schedule to the University of obligations Malaya Act, 1961 with the approval of the Board of Student Welfare of student before the appointed date shall be deemed to be student bodies under

‘ the provisions of section 48 of this Constitution and any rights, liabilities and obligations relating to any matter which immediately before the appointed date were the responsibility of such student body shall on and after that date devolve upon the student body, or on such person or office bearers as the Vice-Chancellor may by order appoint.

Tho Guildof 64. Every person who is a member of the Guild of Graduates of the

Graduates, University of Malaya under the provisions of section 22 of the Schedule to the University of Malaya Act, 1961, shall for the purpose of section 22 of this Constitution be deemed to be a member of the Guild of

Graduates of the University.
