PADA menjalankan kuasa yang diberikan oleh perenggan 60(a) Akta Tenaga Boleh Baharu 2011 [Akta 725], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Tenaga Boleh Baharu (Kriteria bagi Sumber Boleh Baharu) 2011.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 1 Disember 2011.

Kriteria bagi sumber boleh baharu

Seksyen 2

Suatu sumber atau teknologi tertentu hendaklah memenuhi kriteria yang dinyatakan dalam ruang kedua Jadual untuk dianggap sebagai sumber boleh baharu yang dinyatakan dalam ruang pertama Jadual bagi maksud Akta.

Kriteria

1. Biogas

(a)

Suatu sumber dalam bentuk gas; dan

(b)

Dihasilkan oleh pencernaan anaerob atau penapaian bahan organik tidak terfosil dan terbiodegradasikan, termasuk baja, enap cemar kumbahan, hasil, hasil sampingan dan baki daripada sisa pertanian, perindustrian atau perbandaran yang berasal dari Malaysia.

2. Biojisim

(a)

Suatu sumber dalam bentuk pepejal; dan

(b)

Terdiri daripada bahan organik tidak terfosil dan terbiodegradasikan, termasuk hasil dan hasil sampingan dan baki daripada sisa pertanian, perindustrian atau perbandaran yang berasal dari Malaysia.

3. Hidrokuasa kecil

Suatu teknologi yang memanfaatkan kuasa air yang mengalir bagi menjanakan tenaga elektrik.

4. Fotovolta suria

Suatu teknologi yang secara langsung mengubah tenaga cahaya matahari kepada tenaga elektrik melalui suatu proses fotoelektrik.

RENEWABLE ENERGY ACT 2011

RENEWABLE ENERGY (CRITERIA FOR RENEWABLE RESOURCES) REGULATIONS 2011

IN exercise of the powers conferred by paragraph 60(a) of the Renewable Energy Act 2011 [Act 725], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Renewable Energy (Criteria for

Renewable Resources) Regulations 2011.

(2)

These Regulations come into operation on 1 December 2011.

Criteria for renewable resources 2.

A particular resource or technology shall satisfy the criteria set out in the second column of the Schedule in order to be regarded as the renewable resource specified in the first column of the Schedule for the purposes of the Act.

1. Biogas

(a)

A resource in gas form; and

(b)

Produced by the anaerobic digestion or fermentation of non-fossilized and biodegradable organic material, including manure, sewage sludge, products, by-products and residues from agricultural, industrial or municipal wastes originating from Malaysia.

2. Biomass

(a)

A resource in solid form; and

(b)

Comprises of non-fossilized and biodegradable organic material, including products and by-products and residues from agricultural, industrial or municipal wastes originating from Malaysia.

3. Small hydropower

A technology that harnesses the power of flowing water to produce electrical energy.

4. Solar photovoltaic

A technology that directly converts sunlight energy into electrical energy via a photoelectric process.
