PADA menjalankan kuasa yang diberikan oleh perenggan 26(b) Akta Universiti dan Kolej Universiti 1971 [Akta 30], Yang di-Pertuan Agong, atas nasihat Menteri, membuat perintah yang berikut: Nama

Seksyen 1

Perintah ini bolehlah dinamakan Perintah Universiti dan Kolej Universiti

(Pengubahan dan Penambahan kepada, Perlembagaan) (Universiti Sains

Malaysia) (Pindaan) 2012.

Pindaan Jadual

Penambahan kepada, Perlembagaan) (Universiti Sains Malaysia) 2011

(a)

dalam butiran 14, dengan menggantikan butir-butir dalam ruang (2)

dengan butir-butir yang berikut:

‘Nomborkan semula sebagai seksyen 15.

Gantikan dengan yang berikut:

“Pendaftar, Bursar, Ketua Pustakawan, Penasihat Undang-Undang,

Pegawai Aduan dan Juruaudit Dalaman

Seksyen 15

(1)

Seorang Pendaftar, Bursar, Ketua Pustakawan, Penasihat

Undang-Undang, Pegawai Aduan dan Juruaudit Dalaman hendaklah berkhidmat sebagai pegawai sepenuh masa Universiti dan yang

mempunyai kuasa dan kewajipan sebagaimana yang ditetapkan oleh statut.

(2)

Jawatan Pendaftar, Bursar, Ketua Pustakawan, Penasihat

Undang-Undang, Pegawai Aduan dan Juruaudit Dalaman boleh dikenali dengan apa-apa nama lain sebagaimana yang ditentukan oleh Lembaga.

(3)

Pendaftar, Bursar, Ketua Pustakawan, Penasihat Undang-Undang, Pegawai Aduan dan Juruaudit Dalaman hendaklah dilantik oleh

Lembaga mengikut nasihat Jawatankuasa Pemilih.

(4)

Tertakluk kepada peruntukan Perlembagaan ini, syarat pelantikan Pendaftar, Bursar, Ketua Pustakawan, Penasihat Undang-Undang, Pegawai Aduan dan Juruaudit Dalaman hendaklah ditentukan oleh Lembaga.

(5)

Seseorang yang dilantik sebagai Pendaftar, Bursar dan

Penasihat Undang-Undang hendaklah, melainkan jika dia meletakkan jawatan atau mengosongkan jawatannya atau pelantikannya dibatalkan, memegang jawatan selama tempoh yang tidak melebihi tiga tahun dan apabila tempoh itu habis, Pendaftar, Bursar dan Penasihat Undang-Undang itu adalah layak untuk dilantik semula.

Seseorang yang dilantik sebagai Ketua Pustakawan, Pegawai

Aduan dan Juruaudit Dalaman hendaklah memegang jawatan selama tempoh yang ditetapkan oleh Lembaga.

(7)

Pelantikan Pendaftar, Bursar, Ketua Pustakawan, Penasihat

Undang-Undang, Pegawai Aduan dan Juruaudit Dalaman boleh, pada bila-bila masa, dibatalkan oleh Lembaga dengan menyatakan sebab bagi pembatalan itu.”.’;

dalam butiran 16, dalam subbutiran “- subseksyen (1)”, dengan menggantikan butir-butir yang berkaitan dengannya yang dinyatakan dalam ruang (2) dengan butir-butir yang berikut:

dengan memotong butiran 31 dan butir-butir yang berkaitan dengannya yang dinyatakan dalam ruang (2); dan

dengan memasukkan selepas butiran 32 dan butir-butir yang berkaitan dengannya yang dinyatakan dalam ruang (2) butiran dan butir-butir yang berkaitan dengannya yang berikut:

“32A. Seksyen 21A Nomborkan semula sebagai seksyen 35A.”.

UNIVERSITIES AND UNIVERSITY COLLEGES (VARIATION OF, AND ADDITION TO, THE

CONSTITUTION) (UNIVERSITI SAINS MALAYSIA) (AMENDMENT) ORDER 2012

Opening note

Preamble

IN exercise of the powers conferred by paragraph 26(b) of the Universities and University Colleges Act 1971 [Act 30], the Yang di-Pertuan Agong, on the advice of the Minister, makes the following order: Citation 1. This order may be cited as the Universities and University Colleges (Variation of, and addition to, the Constitution) (Universiti Sains Malaysia) (Amendment) Order 2012. Amendment of Schedule 2. The Schedule to the Universities and University Colleges (Variation of, and Addition to, the Constitution) (Universiti Sains Malaysia) Order 2011 [P.U. (A) 222/2011] is amended—

(a)

in item 14, by substituting for the particulars in column (2) the following particulars:

‘Renumber as section 15.

Substitute with the following:

“Registrar, Bursar, Chief Librarian, Legal Adviser, Complaints Officer and Internal Auditor

Seksyen 15

(1)

There shall be a Registrar, a Bursar, a Chief Librarian, a

Legal Adviser, a Complaints Officer and an Internal Auditor who shall be full-time officers of the University and shall have such powers and duties as may be prescribed by statute.

(2)

The post of the Registrar, the Bursar, the Chief Librarian, the Legal Adviser, the Complaints Officer and the Internal Auditor may be known by such other names as may be determined by the Board.

(3)

The Registrar, the Bursar, the Chief Librarian, the Legal

Adviser, the Complaints Officer and the Internal Auditor shall be appointed by the Board on the advice of the Selection Committees.

(4)

Subject to the provisions of this Constitution, the conditions of appointment of the Registrar, the Bursar, the Chief Librarian, the Legal

Adviser, the Complaints Officer and the Internal Auditor shall be determined by the Board.

(5)

A person appointed as the Registrar, the Bursar and the

Legal Adviser shall, unless he resigns or vacates his office or his appointment is revoked, hold office for a period of not more than three years and upon expiry of such period, the Registrar, the Bursar and the

Legal Adviser shall be eligible for reappointment.

(6)

A person appointed as the Chief Librarian, the Complaints

Officer and the Internal Auditor shall hold office for a period as determined by the Board.

(7)

The appointment of the Registrar, the Bursar, the Chief

Librarian, the Legal Adviser, the Complaints Officer and the Internal

Auditor may, at any time, be revoked by the Board stating the reason for such revocation.”.’;

(b)

in item 16, in subitem “- subsection (1)”, by substituting for the particulars relating to it as specified in column (2) the following particulars:

‘Substitute with the following:

“(1)

The Authorities of the University shall be the Board, the

Senate, the Management Committee of the University or by whatever name it may be referred to, the Faculties, the Schools, the Institutes, the

Academic Centres, the Research Centres, the Academies, the Studies

Committee, the Selection Committees, the Student Welfare Committee, the Students’ Complaints Committee and such other bodies as may be prescribed by statute as Authorities of the University.”.’;

(c)

by deleting item 31 and the particulars relating to it as specified in column

(2)

; and

(d)

by inserting after item 32 and the particulars relating to it as specified in column (2) the following item and the particulars relating to it:

“32A.

Section 21A

Renumber as section 35A.”.
