Opening note
Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan
Perkhidmatan Kuarantin dan Pemeriksaan Malaysia (Pendaftaran Pengimport,
Pengeksport dan Ejen) 2013.
Peraturan-Peraturan ini mula berkuat kuasa pada 1 April 2013.
Pendaftaran pengimport, pengeksport dan ejen
Mana-mana orang tidak boleh mengimport atau mengeksport sesuatu tumbuhan, binatang, karkas, ikan, keluaran pertanian, tanih atau mikroorganisma melainkan jika orang itu berdaftar dengan Ketua Pengarah sebagai seorang pengimport, pengeksport atau ejen.
Permohonan dan kelulusan pendaftaran
Seorang pemohon hendaklah membuat suatu permohonan pendaftaran sebagai pengimport, pengeksport atau ejen tumbuhan, binatang, karkas, ikan, keluaran pertanian, tanih atau mikroorganisma kepada Ketua Pengarah mengikut apa-apa cara yang ditentukan oleh Ketua Pengarah.
Ketua
Pengarah boleh, selepas menerima sesuatu permohonan pendaftaran, menghendaki pemohon untuk mengemukakan apa-apa maklumat atau dokumen lain yang difikirkannya perlu dalam meluluskan permohonan pendaftaran itu.
Ketua Pengarah boleh memberikan kelulusan secara bertulis kepada mana-mana pemohon yang telah memenuhi syarat pendaftaran.

Walau apa pun subperaturan (1), mana-mana orang yang telah berdaftar sebagai seorang pengimport, pengeksport atau ejen dengan agensi atau jabatan yang berkaitan hendaklah disifatkan sebagai telah didaftarkan sebagai seorang pengimport, pengeksport atau ejen di bawah Peraturan-Peraturan ini.
Perubahan maklumat pendaftaran
Pengimport, pengeksport atau ejen hendaklah memaklumkan Ketua Pengarah secara bertulis mengenai apa-apa perubahan kepada maklumat pendaftaran pengimport, pengeksport atau ejen itu dalam masa tiga puluh hari daripada perubahan tersebut.
Pembatalan pendaftaran
Ketua Pengarah boleh, pada bila-bila masa, membatalkan mana-mana pendaftaran jika pengimport, pengeksport atau ejen itu melanggar mana-mana peruntukan Peraturan-Peraturan ini atau mana-mana syarat pendaftaran.
Mana-mana pengimport, pengeksport atau ejen yang telah dibatalkan pendaftarannya tidak berhak kepada apa-apa pampasan bagi apa-apa kerugian yang dialaminya kerana pembatalan pendaftaran di bawah Peraturan-Peraturan ini.
Penalti am
Mana-mana orang yang melanggar mana-mana peruntukan di bawah
Peraturan-Peraturan ini melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi satu ribu ringgit atau dipenjarakan selama tempoh tidak melebihi enam bulan atau kedua-duanya.

MALAYSIAN QUARANTINE AND INSPECTION SERVICES
(REGISTRATION OF IMPORTERS, EXPORTERS AND AGENTS) REGULATIONS 2013
IN exercising the powers conferred by paragraph 49(2)(d) of the Malaysian Quarantine and Inspection Services Act 2011 [Act 728], the Minister makes the following regulations:
Citation and commencement 1.
These Regulations may be cited as the Malaysian Quarantine and
Inspection Services (Registration of Importers, Exporters or Agents) Regulations 2013.
These Regulations come into operation on 1 April 2013.
Registration of importers, exporters and agents 2.
Any person shall not import or export any plant, animal, carcass, fish, agricultural produce, soil or microorganism unless that person is registered with the Director
General as an importer, exporter or agent.
Application and approval of registration 3.
An applicant shall make an application for registration as an importer, exporter or agent of plant, animal, carcass, fish, agricultural produce, soil or microorganism to the Director General according to any manner as determined by the
Director General.
The Director General may, upon receiving an application of registration, requires the applicant to submit any other information or documents as he may think necessary in approving the application for registration.
The Director General may give his approval in writing to any applicant who meets the conditions of registration.

Notwithstanding subregulation (1), any person who has registered as an importer, exporter or agent with the relevant agency or department shall be deemed to have been registered as an importer, exporter or agent under these Regulations.
Changes in registration information 4.
The importer, exporter or agent shall notify the Director General in writing regarding any changes made to the registration information of the importer, exporter or agent within thirty days from such changes.
Termination of registration 5.
The Director General may, at any time, terminate any registration if the importer, exporter or agent contravenes any provision of these Regulations or any conditions of the registration.
Any importers, exporters or agents whose registration is revoked shall not be entitled to any compensation for any loss suffered by him due to the cancellation of registration under these Regulations.
General penalty 6.
Any person who contravenes any provision under these Regulations commits an offence and shall, upon conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.
