Preamble

PADA menjalankan kuasa yang diberikan oleh seksyen 39 Akta Bekalan Gas 1993 [Akta 501], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

(1)

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Bekalan Gas (Pindaan) 2014.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 1 Januari 2016.

Peraturan-Peraturan Bekalan Gas 1997 [P.U. (A) 287/1997], yang disebut

"Peraturan-Peraturan ibu" dalam Peraturan–Peraturan ini, dipinda—

(a)

dengan menggantikan perkataan “Ketua Pengarah” di mana-mana jua terdapat dengan perkataan “Suruhanjaya”; dan

(b)

dalam teks bahasa kebangsaan, dengan menggantikan perkataan “fee”

di mana-mana jua terdapat dengan perkataan “fi”.

Seksyen 3

Peraturan 15 Peraturan-Peraturan ibu dipinda—

Fi yang kena dibayar untuk memproses permohonan dan pengeluaran kelulusan untuk memasang adalah sebagaimana yang ditetapkan dalam Bahagian I Jadual Ketiga.”.

Seksyen 4

Peraturan 16 Peraturan-Peraturan ibu dipinda—

(a)

dengan menomborkan semula peraturan 16 sebagai subperaturan 16(1);

(b)

dalam subperaturan (1), dengan memasukkan selepas perkataan

“pepasangan gas” perkataan “, pepasangan gas tambahan atau sambungan pepasangan gas”; dan

(c)

dengan memasukkan selepas subperaturan (1) subperaturan yang berikut:

Suruhanjaya boleh meluluskan permohonan itu jika ia berpuas hati bahawa pemohon itu telah memenuhi kehendak Peraturan-Peraturan ini dan seterusnya mengeluarkan kelulusan untuk mengendali, yang mengandungi apa-apa terma dan syarat yang difikirkan patut oleh

Suruhanjaya.

Jika Perakuan Pendaftaran Kontraktor Gas yang dikeluarkan oleh Suruhanjaya hilang, dicuri, termusnah, lusuh, atau rosak, suatu Perakuan gantian boleh dikeluarkan oleh Suruhanjaya apabila suatu akuan berkanun bahawa salinan asal Perakuan tersebut telah hilang, dicuri ataupun termusnah dikemukakan oleh pemegang atau apabila salinan asal Perakuan yang lusuh atau rosak itu diserah balik.

(2)

Fi bagi perakuan gantian yang dikeluarkan di bawah subperaturan (1) adalah sebagaimana yang ditetapkan dalam

GAS SUPPLY (AMENDMENT) REGULATIONS 2014

Opening note

Preamble

IN exercise of the powers conferred by section 39 of the Gas Supply Act 1993 [Act 501], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Gas Supply (Amendment)

Regulations 2014.

(2)

These Regulations come into operation on 1 January 2016.

General Amendment 2.

The Gas Supply Regulations 1997 [P.U. (A) 287/1997], which are referred to as the “principal Regulations” in these Regulations, are amended—

(a)

by substituting for the words “Director General” the words “the

Commission”, wherever appearing; and

(b)

in the national language text, by substituting for the word “fee” the word

“fi”, wherever appearing.

Amendment of regulation 15 3.

Regulation 15 of the principal Regulations is amended─

(a)

in subregulation (1), by substituting for the word “a” before the word

“new” the word “any”;

(b)

in subregulation (1), by substituting for the words “or gas extension” the words “, additional gas installation or extension of gas installation”; and

(c)

by inserting after subregulation (3) the following subregulations:

“(4)

All the terms and conditions of the approval to install shall be complied with by—

(a)

the owner of the installation;

(b)

the competent person engaged to advice on the work on the installation, to the extent of his scope of work; and

(c)

the Gas Contractor registered with the Commission, carrying out the work on the installation, as contained in an approval to install issued by the Commission pursuant to subregulation (3).

(5)

The fee payable for processing the application for and the issuance of the approval to install is as prescribed in Part I of the Third Schedule.”.

Amendment of Regulation 16 4.

Regulation 16 of the principal Regulations is amended—

(a)

by renumbering regulation 16 as subregulation 16(1);

(b)

in subregulation (1), by inserting after the word “installation” the words “, additional gas installation or extension of gas installation”; and

(c)

by inserting after subregulation (1) the following subregulations:

“(2)

The Commission may approve the application if it is satisfied that the applicant has fulfilled the requirements of these Regulations and subsequently issue an approval to operate, containing such terms and conditions as it deems fit.

(3)

The fee payable for processing the application for and the issuance of the approval to operate is as prescribed in Part I of the Third Schedule.”.

Amendment of Regulation 94 5.

Regulation 94 of the principal Regulations is amended by substituting for the word “The” the words “The processing fee for an application for examination and the”.

New Regulation 114A

Seksyen 6

The principal Regulations are amended by inserting after regulation 114 the following regulation:

Seksyen 114A

(1)

If a Certificate of Registration of a Gas Contractor issued by the Commission is lost, stolen, destroyed, mutilated, or defaced, a replacement of the Certificate may be issued by the Commission on production of a statutory declaration by the holder that the original Certificate has been lost, stolen or destroyed or upon surrender of the mutilated or defaced original Certificate.

(2)

The fee for the replacement certificate issued under subregulation (1) is as prescribed in Part II of the Third

Schedule.”.

Amendment of Regulation 118 7.

Regulation 118 of the principal Regulations is amended—

(a)

by renumbering regulation 118 as subregulation 118(1); and

(b)

by inserting after subregulation (1) the following subregulations:

“(2)

If a Certificate of Approval issued by the Commission is lost, stolen, destroyed, mutilated, or defaced, a replacement of the Certificate may be

Amendment of the Third Schedule 8.

The principal Regulations are amended by substituting for the Third Schedule the following Schedule:
