Jemaah Pengarah bagi Pertubuhan Peladang Kebangsaan hendaklah terdiri daripada—

FARMERS’ ORGANIZATION (AMENDMENT) REGULATIONS 2019

  1. IN exercise of the powers conferred by section 35 of the Farmers’ Organization Act 1973 [Act 109], the Farmers’ Organization Authority, with the approval of the Minister, makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the

Farmers’ Organization

(Amendment) Regulations 2019.

These Regulations come into operation on 1 May 2019.

Amendment of regulation 35

The Farmers’ Organization Regulations 1983 [P.U. (A) 303/1983], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 35—

(a)

by substituting for subregulation (1) the following subregulation:

“(1) The

Directors for every

Farmers’

Organization shall consists of—

five members appointed by the Minister, one of whom shall be Peladang Muda and one of whom shall be

by inserting after subregulation (1) the following subregulations:

“(2) A chairman of the Board of Directors for the Area Farmers’

Organization shall be elected by a majority vote of the total members of the Board and if there is an equal number of votes, the candidates who have the equal number of votes shall draw lots to determine whom to be the chairman.

The Board of Directors for every State Farmers’

Organization shall consists of—

(a)

four members elected in the Annual General Meeting;

and

(3A)

A chairman of the Board of Directors for the State Farmers’

Organization shall be nominated by the members of the Board from amongst themselves and approved by the Minister.

The Board of Directors for the National Farmers’

Organization shall consists of—

(a)

five members elected in the Annual General Meeting;

and

six members appointed by the Minister, one of whom shall be the representative from the ministry responsible for agriculture and agro-based industry and one of whom shall be the representative from the ministry responsible for finance.

(3C)

A chairman of the Board of Directors for the National

Farmers’ Organization shall be nominated by the members of the

Board from amongst themselves and approved by the Minister.”;

in subregulation (5), by deleting the words “under paragraph (1)(c)”;

“(8) The quorum for any meeting of the Board of Directors for the Area Farmers’ Organization, the State Farmers’ Organization and the National Farmers’ Organization shall be seven.”.

Amendment of regulation 44 3.

Subregulation 44(1) of the principal Regulations is amended by substituting for the word “three” the word “two”.

Continuance of holding office 4.

(1)

The existing members of the Board of Directors elected in the Annual

General Meeting and appointed by the Minister under paragraphs 35(1)(a), (b) and (c)

of the principal Regulations shall be deemed to have been duly elected or appointed under these Regulations and shall continue to hold office until the expiry of their term of elections or appointments.

(2)

Any act done, action taken or decision made by the members of the Board of

Directors referred to in subregulation (1) shall be deemed to be valid and may accordingly be continued by the Board of Directors.
