Preamble

PADA menjalankan kuasa yang diberikan oleh perenggan 85(2)(l) Akta Eksais 1976 [Akta 176], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan Eksais

(Membotol dan Memindah Liquor yang Memabukkan) (Pindaan) 2019.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 1 Januari 2020.

Peraturan-Peraturan

Liquor yang Memabukkan) 1977 [P.U. (A) 158/1977], yang disebut "Peraturan-Peraturan ibu"

dalam Peraturan-Peraturan ini, dipinda dalam peraturan 2—

(a)

dalam takrif “lesen”, dengan menggantikan koma bernoktah dihujung perenggan itu dengan noktah; dan

(b)

dengan memotong takrif "pemegang lesen" dan takrif “premis berlesen”.

Pindaan peraturan 4

Seksyen 3

Peraturan 4 Peraturan-Peraturan ibu dipinda—

(a)

dengan menggantikan nota birai dengan nota birai yang berikut:

“Pengilang berlesen hendaklah menyimpan rekod”;

(b)

dengan menomborkan semula peraturan 4 yang sedia ada sebagai subperaturan (1);

(c)

dalam subperaturan (1) yang telah dinomborkan semula, dengan menggantikan perkataan “Tiap-tiap pemegang lesen hendaklah, berhubung dengan premis yang diperihalkan dalam lesen itu, menyimpan suatu buku yang ditetapkan oleh Ketua Pengarah dan mencatitkan butir-butir yang berikut di dalamnya tiap-tiap hari pada masa perniagaan ditutup—” dengan perkataan “Tiap-tiap pengilang berlesen hendaklah menyimpan rekod terkini yang lengkap dan benar semua butir-butir berhubung dengan—”;

(d)

dalam perenggan (1)(i), dengan menggantikan perkataan “pemegang lesen”

dengan perkataan “pengilang berlesen”; dan

(e)

dengan memasukkan selepas subperaturan (1) subperaturan yang berikut:

“(2) Rekod yang dinyatakan di bawah subperaturan (1) hendaklah dikemas kini tiap-tiap hari sebelum waktu premis berlesen ditutup dan hendaklah diseimbangkan apabila perniagaan ditutup pada hari akhir tiap-tiap satu bulan kalendar.”.

Seksyen 4

Peraturan 5 Peraturan-Peraturan ibu dipinda—

(a)

dalam nota birai dengan menggantikan perkataan “liquor” dengan perkataan

“liquor yang memabukkan”; dan

(b)

dengan memasukkan selepas subperaturan (2) subperaturan yang berikut:

“(3) Bagi maksud peraturan ini, “premis berlesen” ertinya premis yang mengenainya suatu lesen telah dikeluarkan di bawah seksyen 20

atau 25 Akta.”.

EXCISE ACT 1976

EXCISE (BOTTLING AND MOVEMENT OF INTOXICATING LIQUORS) (AMENDMENT)

REGULATIONS 2019

Opening note

Preamble

IN exercise of the powers conferred by paragraph 85(2)(l) of the Excise Act 1976 [Act 176], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Excise (Bottling and Movement of

Intoxicating Liquors) (Amendment) Regulations 2019.

(2)

These regulations come into operation on 1 January 2020.

Amendment of regulation 2 2.

The Excise (Bottling and Movement of Intoxicating Liquors) Regulations 1977

[P.U. (A) 158/1977], which are referred to as the “principal Regulations” in these

Regulations, are amended in regulation 2—

(a)

in the definition of “licence”, by substituting for the semicolon at the end of the paragraph a full stop; and

(b)

by deleting the definition of “licensee” and the definition of

“licensed premises”.

Amendment of regulation 4 3.

Regulation 4 of the principal Regulations is amended—

(a)

by substituting the marginal notes with the following marginal notes:

“Licensed manufacturer shall keep records”;

(b)

by renumbering the existing regulation 4 as subregulation (1);

(c)

in the renumbered subregulation (1), by substituting for the words

“Every licensee shall, in relation to the premises described in the licence, keep a book prescribed by the Director General and record therein daily at the close of business each day the following particulars—” the words

“Every licensed manufacturer shall keep full and true records up to date of all particulars relating to—”;

(d)

in paragraph (1)(i), by substituting the word “licensee” the words

“licensed manufacturer”; and

(e)

by inserting after subregulation (1) the following subregulation:

“(2) Records stated under subregulation (1) shall be updated daily before the hour at which the licensed premises close and shall be balanced at the close of business on the last day of each calendar month.”.

Amendment of regulation 5 4.

Regulation 5 of the principal Regulations is amended—

(a)

in the marginal note by substituting for the word “liquor” the words

“intoxicating liquor”; and

(b)

by inserting after subregulation (2) the following subregulation:

“(3) For the purpose of this regulation, “licensed premises” means premises in respect of which a licence has been issued under section 20

or 25 of the Act.”.

Substitution of Schedule One 5.

The principal Regulations are amended by substituting for Schedule One the following schedule:
