Nama dan permulaan kuat kuasa

(b)

kelahiran mati tiap-tiap kanak-kanak hendaklah diberikan kepada

Pendaftar dalam Borang JPN.LM01-LM Jadual Pertama.

Borang itu hendaklah disertakan dengan dokumen yang berikut:

(a)

dokumen pengenalan diri pemberitahu;

(b)

dokumen pengenalan diri ibu kanak-kanak itu, kecuali dalam hal kanak-kanak baru lahir yang dijumpai ditinggalkan tanpa perlindungan;

(c)

dokumen pengenalan diri bapa kanak-kanak itu, jika ada; dan

(d)

apa-apa dokumen lain yang dikehendaki oleh Pendaftar untuk menyokong ketepatan maklumat yang diberikan oleh pemberitahu.

(3)

Jika Pendaftar berpuas hati bahawa maklumat dan dokumen yang diberikan adalah tepat, dia hendaklah mengeluarkan, kepada pemberitahu—

(a)

Sijil Kelahiran dalam Borang JPN.LM05 Jadual Pertama, dalam hal kelahiran hidup atau kanak-kanak baru lahir yang hidup yang dijumpai ditinggalkan tanpa perlindungan; atau

(b)

Sijil Lahir Mati dalam Borang JPN.LM06 Jadual Pertama, dalam hal kelahiran mati.

Permohonan bagi pendaftaran lewat kelahiran 3.

(1)

Bagi maksud pendaftaran lewat kelahiran di bawah seksyen 12 Akta, pemberitahu hendaklah memperoleh kelulusan bertulis daripada Pendaftar Besar—

(a)

dengan memberikan kepada Pendaftar Besar—

(i)

dua akuan berkanun yang diikrarkan oleh dua orang yang berlainan, selain orang yang meminta untuk didaftarkan

dan pemberitahu itu, berkenaan dengan pengetahuan mereka mengenai kelahiran kanak-kanak itu;

(ii)

dokumen yang disebut dalam perenggan 2(2)(a), (b)

dan (c); dan

(iii)

apa-apa dokumen lain yang dikehendaki oleh Pendaftar

Besar untuk menyokong ketepatan maklumat yang diberikan oleh pemberitahu; dan

(b)

dengan membayar fi yang ditetapkan sebagaimana yang dinyatakan dalam butiran 1 Jadual Kedua.

(2)

Jika Pendaftar Besar berpuas hati bahawa maklumat dan dokumen yang diberikan adalah tepat, Pendaftar Besar hendaklah membenarkan kelahiran itu didaftarkan dan mengeluarkan Sijil Kelahiran kepada pemberitahu.

Pendaftaran atau pengubahan nama 4.

Permohonan bagi pendaftaran atau pengubahan nama di bawah seksyen 15 Akta hendaklah dibuat dalam Borang JPN.LM21 Jadual Pertama dan disertakan dengan—

(a)

bayaran fi yang ditetapkan sebagaimana yang dinyatakan dalam butiran 2, 3 atau 4 Jadual Kedua, mengikut mana-mana yang berkenaan; dan

(b)

dokumen yang berikut:

(i)

salinan asal Sijil Kelahiran atau salinan Sijil Kelahiran yang diperakui sah kanak-kanak yang namanya hendak didaftarkan atau diubah, atau orang yang namanya hendak didaftarkan;

(ii)

dokumen pengenalan diri pemohon;

(iii)

suatu akuan berkanun yang diikrarkan oleh pemohon; dan

(iv)

apa-apa dokumen lain yang dikehendaki oleh Pendaftar Besar untuk menyokong ketepatan maklumat yang diberikan oleh pemohon.

Pendaftaran semula kelahiran orang disahtarafkan 5.

(1)

Permohonan bagi pendaftaran semula kelahiran seseorang yang menjadi orang disahtarafkan di bawah seksyen 17 Akta hendaklah dibuat dalam

Borang JPN.LM01-ST Jadual Pertama dan disertakan dengan dokumen yang berikut:

(a)

dokumen pengenalan diri pemohon;

(b)

salinan asal Sijil Kelahiran orang disahtarafkan itu;

(c)

dokumen pengenalan diri ibu dan bapa orang disahtarafkan itu;

(d)

perintah yang dikeluarkan oleh mahkamah yang kompeten di Malaysia mengenai kesahtarafan orang itu; dan

(e)

apa-apa dokumen lain yang dikehendaki oleh Pendaftar Besar untuk menyokong ketepatan maklumat yang diberikan oleh pemohon.

(2)

Jika Pendaftar Besar berpuas hati bahawa maklumat dan dokumen yang diberikan adalah tepat, Pendaftar Besar hendaklah mengeluarkan Sijil Kelahiran baharu dalam Borang JPN.LM05 Jadual Pertama kepada pemohon.

(3)

Jika permohonan bagi pendaftaran semula di bawah subkaedah (1) dibuat selepas habis tempoh tiga bulan dari tarikh perkahwinan, Pendaftar Besar hendaklah membenarkan pendaftaran semula hanya apabila fi yang ditetapkan sebagaimana yang dinyatakan dalam butiran 5 Jadual Kedua dibayar.

BAHAGIAN III

PENDAFTARAN KEMATIAN

Pendaftaran kematian 6.

(1)

Maklumat berkenaan dengan kematian tiap-tiap orang hendaklah diberikan kepada Pendaftar dalam Borang JPN.LM02 Jadual Pertama dan disertakan dengan dokumen yang berikut:

(a)

dokumen pengenalan diri pemberitahu;

(b)

dokumen pengenalan diri si mati, jika ada;

(c)

jika dokumen pengenalan diri si mati tidak dapat dikesan, suatu pernyataan yang ditandatangan oleh pemberitahu;

(d)

suatu perakuan penyebab kematian yang dikeluarkan oleh pegawai perubatan di bawah seksyen 22 Akta, jika ada; dan

(e)

apa-apa dokumen lain yang dikehendaki oleh Pendaftar untuk menyokong ketepatan maklumat yang diberikan oleh pemberitahu.

(2)

Jika Pendaftar berpuas hati bahawa maklumat dan dokumen yang diberikan adalah tepat, Pendaftar hendaklah mengeluarkan Sijil Kematian kepada pemberitahu dalam Borang JPN.LM03 Jadual Pertama.

Pendaftaran lewat kematian 7.

(1)

Bagi maksud pendaftaran lewat kematian di bawah seksyen 21 Akta, pemberitahu hendaklah memperoleh kebenaran bertulis daripada Pendaftar Besar—

(a)

dengan memberikan kepada Pendaftar Besar—

(i)

dua akuan berkanun yang diikrarkan oleh dua orang yang berlainan selain pemberitahu berkenaan dengan pengetahuan mereka mengenai kematian itu;

(ii)

dokumen yang disebut dalam perenggan 6(1)(a), (b), (c)

dan (d); dan

(iii)

apa-apa dokumen lain yang dikehendaki oleh Pendaftar

Besar untuk menyokong ketepatan maklumat yang diberikan oleh pemberitahu; dan

(b)

dengan membayar fi yang ditetapkan sebagaimana yang dinyatakan dalam butiran 1 Jadual Kedua.

(2)

Jika Pendaftar Besar berpuas hati bahawa maklumat dan dokumen yang diberikan adalah tepat, Pendaftar Besar hendaklah mengeluarkan suatu kebenaran bertulis bagi kematian itu didaftarkan dan mengeluarkan

Sijil

Kematian kepada pemberitahu.

Pendaftaran anggapan kematian 8.

(1)

Maklumat berkenaan dengan anggapan kematian orang yang hilang hendaklah diberikan kepada Pendaftar dalam Borang JPN.LM02-AM Jadual Pertama dan disertakan dengan dokumen yang berikut:

(a)

perintah anggapan kematian yang dikeluarkan oleh mahkamah di

Malaysia; dan

(b)

dokumen pengenalan diri orang yang kepadanya perintah itu diberikan.

(2)

Jika Pendaftar berpuas hati bahawa maklumat dan dokumen yang diberikan adalah tepat, Pendaftar hendaklah mengeluarkan Sijil Anggapan Kematian kepada pemohon dalam Borang JPN.LM03-AM Jadual Pertama.

Perakuan dan pemeriksaan post-mortem oleh pengamal perubatan 9.

Perakuan bagi maksud seksyen 22 dan 23 Akta hendaklah dibuat dalam

Borang JPN.LM09 dan JPN.LM10 Jadual Pertama masing-masing.

BAHAGIAN IV

INDEKS

Indeks catatan dalam daftar kelahiran 10.

Indeks catatan dalam daftar kelahiran hendaklah mengandungi butir-butir yang berikut:

(a)

nama kanak-kanak (atau nama bapa atau ibu jika kanak-kanak itu didaftarkan tanpa nama);

(b)

jantina kanak-kanak;

(c)

tarikh (hari, bulan dan tahun) kelahiran kanak-kanak itu;

(d)

kawasan pendaftaran;

(e)

pusat pendaftaran; dan

(f)

Nombor Sijil (Daftar).

Indeks catatan dalam daftar kematian 11.

Indeks catatan dalam daftar kematian hendaklah mengandungi butir-butir yang berikut:

(a)

nama si mati;

(b)

jantina si mati;

(c)

umur si mati;

tarikh kematian (sekurang-kurangnya tahun) si mati;

(e)

kawasan pendaftaran;

(f)

pusat pendaftaran; dan

(g)

Nombor Sijil (Daftar).

BAHAGIAN V

CARIAN DAN SIJIL YANG DIPERAKUI

Carian dalam daftar atau indeks 12.

(1)

Permohonan bagi carian dalam daftar atau indeks hendaklah dibuat—

(a)

berkenaan dengan kelahiran atau kelahiran mati, dalam

Borang JPN.LM12 Jadual Pertama; dan

(b)

berkenaan dengan kematian atau anggapan kematian, dalam

Borang JPN.LM13 Jadual Pertama.

(2)

Permohonan itu hendaklah disertakan dengan—

(a)

bayaran fi yang ditetapkan sebagaimana yang dinyatakan dalam butiran 6 Jadual Kedua;

(b)

dokumen pengenalan diri pemohon; dan

(c)

apa-apa dokumen lain yang dikehendaki oleh Pendaftar Besar untuk menentusahkan tujuan carian itu dibuat.

Keputusan carian hendaklah diberikan dalam Borang JPN.LM14

Jadual Pertama.

Walau apa pun subkaedah (3), Pendaftar Besar boleh mengeluarkan suatu sijil yang diperakui kepada pemohon dalam Borang JPN.LM15, Borang JPN.LM16 atau

Borang JPN.LM16-AM Jadual Pertama, mengikut mana-mana yang berkenaan, apabila fi yang dinyatakan dalam butiran 7 Jadual Kedua dibayar oleh pemohon.

Sijil yang diperakui 13.

(1)

Permohonan bagi apa-apa sijil yang diperakui di bawah subseksyen 32(1)

Akta hendaklah dibuat dalam Borang JPN.LM12 atau Borang JPN.LM13 Jadual Pertama, mengikut mana-mana yang berkenaan.

(2)

Permohonan di bawah subkaedah (1) hendaklah disertakan dengan—

(a)

bayaran fi yang ditetapkan sebagaimana yang dinyatakan dalam butiran 7 Jadual Kedua;

(b)

dokumen pengenalan diri pemohon; dan

(c)

apa-apa dokumen lain yang dikehendaki oleh Pendaftar Besar untuk menentusahkan tujuan permohonan itu.

(3)

Jika permohonan itu dibenarkan,

Penguasa

Pendaftar boleh mengeluarkan suatu sijil yang diperakui kepada pemohon dalam Borang JPN.LM15,

Borang JPN.LM16 atau Borang JPN.LM16-AM Jadual Pertama, mengikut mana-mana yang berkenaan.

BAHAGIAN VI

PEMBETULAN DAN PENGUBAHAN DALAM DAFTAR

Pembetulan kesilapan perkeranian 14.

(1)

Bagi maksud pembetulan kesilapan perkeranian di bawah subseksyen 27(2) Akta, Pendaftar Besar boleh menghendaki mana-mana orang untuk memberikan maklumat kepada Pendaftar Besar sebelum mengarahkan apa-apa pembetulan dibuat kepada daftar oleh Penguasa Pendaftar.

Mana-mana orang yang dikehendaki untuk memberikan maklumat di bawah subkaedah (1) hendaklah memberikan maklumat dalam Borang JPN.LM21

Jadual Pertama.

(3)

Selepas pembetulan dibuat kepada daftar, Pendaftar Besar boleh menghendaki sama ada—

(a)

orang yang daftarnya itu dibetulkan; atau

(b)

orang yang kepadanya telah dikeluarkan Sijil Lahir Mati,

Sijil Kelahiran, Sijil Kematian atau Sijil Anggapan Kematian, mengikut mana-mana yang berkenaan, untuk menyerahkan sijil itu dan salinannya yang diperakui, jika ada, dalam milikan orang itu kepada Pendaftar Besar.

(4)

Apabila sijil itu dan salinannya yang diperakui diserahkan kepada

Pendaftar Besar, Pendaftar Besar hendaklah mengeluarkan sijil baharu dalam

Borang JPN.LM15, Borang JPN.LM16 atau Borang JPN.LM16-AM Jadual Pertama, mengikut mana-mana yang berkenaan.

Pembetulan kesilapan fakta atau isi 15.

(1)

Permohonan untuk membetulkan apa-apa kesilapan fakta atau isi dalam mana-mana daftar hendaklah dibuat dalam Borang JPN.LM21 Jadual Pertama.

(2)

Permohonan hendaklah disertakan dengan—

(a)

bayaran fi yang ditetapkan sebagaimana yang dinyatakan dalam butiran 8 Jadual Kedua;

(b)

dokumen pengenalan diri pemohon;

(c)

Sijil Lahir Mati, Sijil Kelahiran, Sijil Kematian atau Sijil Anggapan

Kematian orang yang daftarnya mengandungi kesilapan fakta atau isi, mengikut mana-mana yang berkenaan;

(d)

suatu akuan berkanun yang dikehendaki di bawah seksyen 27

Akta; dan

(e)

apa-apa dokumen lain yang dikehendaki oleh Pendaftar Besar untuk menyokong ketepatan maklumat yang diberikan oleh pemohon.

(3)

Selepas pembetulan dibuat kepada daftar, Pendaftar Besar hendaklah menghendaki pemohon untuk menyerahkan sijil itu dan salinannya yang diperakui, jika ada, yang berada dalam milikan pemohon kepada Pendaftar Besar.

(4)

Apabila sijil itu dan salinannya yang diperakui diserahkan kepada

Pendaftar Besar, Pendaftar Besar hendaklah mengeluarkan sijil baharu dalam Borang

JPN.LM15, Borang JPN.LM16 atau Borang JPN.LM16-AM Jadual Pertama, mengikut mana-mana yang berkenaan.

Pembatalan pendaftaran 16.

(1)

Pada pengakhiran siasatan di bawah seksyen 37B Akta, Pendaftar Besar boleh membatalkan sesuatu pendaftaran jika dia mendapati bahawa pendaftaran itu diperoleh melalui fraud, salah nyataan atau kesilapan.

(2)

Pendaftar Besar boleh menghendaki mana-mana orang yang memiliki sesuatu sijil atau salinannya yang diperakui bagi mana-mana pendaftaran yang telah dibatalkan di bawah subkaedah

untuk menyerahkan sijil itu kepada

Pendaftar Besar.

BAHAGIAN VII

PELBAGAI

Simbol, catatan atau tanda 17.

Pendaftar Besar boleh memasukkan apa-apa simbol, catatan atau tanda dalam mana-mana sijil yang dikeluarkan di bawah Kaedah-Kaedah ini jika kemasukan itu difikirkan perlu oleh Pendaftar Besar.

Pembatalan 18.

Kaedah-Kaedah Pendaftaran Kelahiran dan Kematian, 1958 [L.N. 225/1958]

dibatalkan.

Kecualian dan peralihan 19.

(1)

Apabila Kaedah-Kaedah ini mula berkuat kuasa, semua permohonan, kelulusan dan pendaftaran yang belum selesai hendaklah diuruskan mengikut

Kaedah-Kaedah ini.

(2)

Apa-apa garis panduan yang dikeluarkan sebelum permulaan kuat kuasa

Kaedah-Kaedah ini hendaklah terus terpakai setakat yang garis panduan itu tidak bertentangan dengan mana-mana peruntukan Kaedah-Kaedah ini.

IN exercise of the powers conferred by section 39

of the

Births and Deaths Registration Act 1957 [Act 299], the Minister makes the following rules:

PART I

PRELIMINARY

Citation and commencement 1.

(1)

These rules may be cited as the Births and Deaths Registration

Rules 2019.

(2)

These Rules come into operation on 1 March 2019.

PART II

REGISTRATION OF BIRTH

Registration of birth 2.

(1)

The information concerning—

(a)

the birth of every child or every living new-born child who is found exposed shall be given to the Registrar in Form JPN.LM01 of the

First Schedule; or

(b)

the stillbirth of every child shall be given to the Registrar in

Form JPN.LM01-LM of the First Schedule.

(2)

The Form shall be accompanied by the following documents:

(a)

an identification document of the informant;

(b)

an identification document of the mother of the child, except in the case of new-born child who is found exposed;

(c)

an identification document of the father of the child, if any; and

(d)

any other documents as the Registrar may require to support the accuracy of the information given by the informant.

(3)

If the Registrar is satisfied that the information and documents given are accurate, he shall issue to the informant—

(a)

a Certificate of Birth in Form JPN.LM05 of the First Schedule, in the case of living birth or a new-born child who is found exposed; or

(b)

a Certificate of Stillbirth in Form JPN.LM06 of the First Schedule, in the case of stillbirth.

Application for late registration of birth 3.

(1)

For the purpose of late registration of birth under section 12 of the Act, an informant shall obtain a written authority from the Registrar-General—

(a)

by giving to the Registrar-General—

(i)

two statutory declarations affirmed by two different persons, other than the person sought to be registered and the informant, concerning their knowledge on the birth of the child;

(ii)

the documents referred to in paragraphs 2(2)(a), (b)

and (c); and

(iii)

any other documents as the Registrar-General may require to support the accuracy of the information given by the informant; and

(b)

by paying the prescribed fee as specified in item 1 of the

Second Schedule.

(2)

If the Registrar-General is satisfied that the information and documents given are accurate, the Registrar-General shall authorize the birth to be registered and issue a Certificate of Birth to the informant.

Registration or alteration of name 4.

An application for the registration or alteration of name under section 15 of the

Act shall be made in Form JPN.LM21 of the First Schedule and accompanied by—

(a)

the payment of prescribed fee as specified in item 2, 3 or 4 of the

Second Schedule, as the case may be; and

(b)

the following documents:

(i)

the original Certificate of Birth or the certified copy of the

Certificate of Birth of the child whose name is to be registered or altered, or the person whose name is to be registered;

(ii)

the identification document of the applicant;

(iii)

a statutory declaration affirmed by the applicant; and

(iv)

any other documents as the Registrar-General may require to support the accuracy of the information given by the applicant.

Re-registration of birth of legitimated person 5.

(1)

An application for re-registration of birth of a person who becomes a legitimated person under section 17 of the Act shall be made in Form JPN.LM01-ST of the First Schedule and accompanied by the following documents:

(a)

the identification document of the applicant;

(b)

the original Certificate of Birth of the legitimated person;

(c)

the identification document of the mother and father of the legitimated person;

(d)

an order issued by a competent court in Malaysia pertaining to the legitimacy of such person; and

(e)

any other documents as the Registrar-General may require to support the accuracy of the information given by the applicant.

(2)

If the Registrar-General is satisfied that the information and documents given are accurate, the Registrar-General shall issue a new Certificate of Birth in

Form JPN.LM05 of the First Schedule to the applicant.

(3)

If an application for re-registration under subrule (1) is made after the expiration of three months from the date of marriage, the Registrar-General shall allow the re-registration only upon payment of the prescribed fee as specified in item 5 of the

Second Schedule.

PART III

REGISTRATION OF DEATH

Registration of death 6.

(1)

The information concerning the death of every person shall be given to the Registrar in Form JPN.LM02 of the First Schedule and accompanied by the following documents:

(a)

an identification document of the informant;

(b)

an identification document of the deceased, if any;

(c)

if the identification document of the deceased could not be traced, a statement signed by the informant;

(d)

a certificate of cause of death issued by the medical officer under section 22 of the Act, if any; and

(e)

any other documents as the Registrar may require to support the accuracy of the information given by the informant.

(2)

If the Registrar is satisfied that the information and documents given are accurate, the Registrar shall issue a Certificate of Death to the informant in

Form JPN.LM03 of the First Schedule.

Late registration of death 7.

(1)

For the purpose of late registration of death under section 21 of the Act, an informant shall obtain a written authority from the Registrar-General—

(a)

by giving to the Registrar-General—

(i)

two statutory declarations affirmed by two different persons other than the informant concerning their knowledge on the death;

(ii)

the documents referred to in paragraphs 6(1)(a), (b), (c)

and (d); and

(iii)

any other documents as the Registrar-General may require to support the accuracy of the information given by the informant; and

(b)

by paying the prescribed fee as specified in item 1 of the

Second Schedule.

(2)

If the Registrar-General is satisfied that the information and documents given are accurate, the Registrar-General shall issue a written authority for the death to be registered and issue a Certificate of Death to the informant.

Registration of presumed death 8.

(1)

The information concerning a missing person's presumed death shall be given to the Registrar in Form JPN.LM02-AM of the First Schedule and accompanied by the following documents:

(a)

a presumed death order issued by a court in Malaysia; and

(b)

an identification document of the person to whom the order is granted.

(2)

If the Registrar is satisfied that the information and documents given are accurate, the Registrar shall issue a Certificate of Presumed Death to the applicant in

Form JPN.LM03-AM of the First Schedule.

Certification and post-mortem examination by medical practitioner 9.

The certificates for the purposes of sections 22 and 23 of the Act shall be in

Forms JPN.LM09 and JPN.LM10 of the First Schedule respectively.

PART IV

INDICES

Indices of entries in the register of birth 10.

The indices of entries in the register of birth shall contain the following particulars:

(a)

the name of the child (or name of father or mother if the child has been registered without a name);

(b)

the sex of the child;

(c)

the date (day, month and year) of birth of the child;

(d)

the registration area;

(e)

the registration centre; and

(f)

the Certificate (Register) Number.

Indices of entries in the register of death 11.

The indices of entries in the register of death shall contain the following particulars:

(a)

the name of the deceased;

(b)

the sex of the deceased;

(c)

the age of the deceased;

the date of death (at least year) of the deceased;

(e)

the registration area;

(f)

the registration centre; and

(g)

the Certificate (Register) Number.

PART V

SEARCH AND CERTIFIED CERTIFICATE

Search in the register or indices 12.

(1)

An application for a search in the register or indices shall be made—

(a)

in respect of birth or stillbirth, in Form JPN.LM12 of the

First Schedule; and

(b)

in respect of death or presumed death, in Form JPN.LM13 of the

First Schedule.

(2)

The application shall be accompanied by—

(a)

the payment of prescribed fee as specified in item 6 of the

Second Schedule;

(b)

an identification document of the applicant; and

(c)

any other documents as the Registrar-General may require to verify the purpose of conducting the search.

(3)

The result of a search shall be given in Form JPN.LM14 of the

First Schedule.

(4)

Notwithstanding subrule (3), the Registrar-General may issue a certified certificate to the applicant in Form JPN.LM15, Form JPN.LM16 or Form JPN.LM16-AM of the First Schedule, as the case may be, upon payment of the fee specified in item 7 of the

Second Schedule by the applicant.

Certified certificate 13.

(1)

An application for any certified certificate under subsection 32(1) of the

Act shall be made in Form JPN.LM12 or Form JPN.LM13 of the First Schedule, as the case may be.

(2)

The application under subrule (1) shall be accompanied by—

(a)

the payment of prescribed fee as specified in item 7 of the

Second Schedule;

(b)

an identification document of the applicant; and

(c)

any other documents as the Registrar-General may require to verify the purpose of the application.

(3)

If the application is allowed, the Superintendent-Registrar may issue a certified certificate to the applicant in Form JPN.LM15, Form JPN.LM16 or

Form JPN.LM16-AM of the First Schedule, as the case may be.

PART VI

CORRECTION AND ALTERATION IN REGISTER

Correction of clerical error 14.

(1)

For the purpose of correction of clerical error under subsection 27(2) of the Act, the Registrar-General may require any person to give information to the

Registrar-General before directing any correction to be made to the register by the

Superintendent-Registrar.

(2)

Any person who is required to give information under subrule (1) shall give the information in Form JPN.LM21 of the First Schedule.

(3)

After a correction is made to the register, the Registrar-General may require either—

(a)

the person whose register is corrected; or

(b)

the person who has been issued with the Certificate of Stillbirth,

Certificate of Birth, Certificate of Death or Certificate of Presumed

Death, as the case may be, to surrender the certificate and its certified copy, if any, in that person’s possession to the Registrar-General.

(4)

When the certificate and its certified copy is surrendered to the

Registrar-General, the Registrar-General shall issue a new certificate in Form JPN.LM15,

Form JPN.LM16 or Form JPN.LM16-AM of the First Schedule, as the case may be.

Correction of error of fact or substance 15.

(1)

An application to correct any error of fact or substance in any register shall be made in Form JPN.LM21 of the First Schedule.

(2)

The application shall be accompanied by—

(a)

the payment of prescribed fee as specified in item 8 of the Second Schedule;

(b)

the identification document of the applicant;

(c)

the Certificate of Stillbirth, Certificate of Birth, Certificate of Death or Certificate of Presumed Death of the person whose register contains an error of fact or substance, as the case may be;

(d)

a statutory declaration required under section 27 of the Act; and

(e)

any other documents as the Registrar-General may require to support the accuracy of the information given by the applicant.

(3)

After a correction is made to the register, the Registrar-General shall require the applicant to surrender the certificate and its certified copy, if any, which is in the applicant’s possession to the Registrar-General.

(4)

When the certificate and its certified copy is surrendered to the

Registrar-General, the Registrar-General shall issue a new certificate to the applicant in

JPN.LM15, Form JPN.LM16 or JPN.LM16-AM of the First Schedule, as the case may be.

Revocation of registration 16.

(1)

At the end of an inquiry under section 37B of the Act, the Registrar-General may revoke a registration if he finds that the registration is procured under fraud, misrepresentation or mistake.

(2)

The Registrar-General may require any person who possesses a certificate or its certified copy of any registration which has been revoked under subrule (1) to surrender the certificate to the Registrar-General.

PART VII

MISCELLANEOUS

Symbol, note or indication 17.

The Registrar-General may insert any symbol, note or indication in any certificate issued under these Rules if he thinks the insertion is necessary.

Revocation 18.

The Births and Deaths Registration Rules, 1958 [L.N. 225/1958] are revoked.

Savings and transitional 19.

(1)

Upon the coming into operation of these Rules, all applications, approvals and registrations which are pending shall be dealt with in accordance with these Rules.

(2)

Any guidelines issued before the coming into operation of these Rules shall continue to be applicable in so far as the guidelines are not contrary to any of the provisions of these Rules.
