Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 38 Akta Pembangunan Sukan 1997 [Akta 576], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa
Seksyen 2
(1)
Mana-mana syarikat yang disebut dalam seksyen 36 Akta yang berhasrat untuk menjalankan apa-apa aktiviti sukan hendaklah memohon bagi suatu lesen kepada
Pesuruhjaya dengan mengemukakan suatu pemohonan bertulis dalam borang yang ditentukan oleh Pesuruhjaya.
(2)
Permohonan yang disebut dalam subperaturan (1) hendaklah dibuat—
(a)
bagi aktiviti sukan tempatan, tidak kurang daripada tiga puluh hari sebelum tarikh aktiviti sukan itu; dan
(b)
bagi aktiviti sukan antarabangsa, tidak kurang daripada sembilan puluh hari sebelum tarikh aktiviti sukan itu.
(3)
Permohonan di bawah subperaturan (1) hendaklah disertakan dengan dokumen yang berikut:
(c)
apa-apa maklumat atau dokumen lain yang dikehendaki oleh
Pesuruhjaya.
Pemberian atau keengganan memberikan lesen
Seksyen 3
(1)
Pesuruhjaya boleh, selepas menimbangkan permohonan bagi suatu lesen di bawah peraturan 2, memberikan lesen atau enggan memberikan lesen itu kepada syarikat.
(2)
Jika Pesuruhjaya memutuskan untuk memberikan lesen di bawah subperaturan (1), Pesuruhjaya hendaklah menghendaki syarikat itu untuk membayar fi sebagaimana yang dinyatakan dalam Jadual.
(3)
Jika Pesuruhjaya enggan memberikan lesen, Pesuruhjaya hendaklah memberitahu syarikat secara bertulis tentang keengganan itu.
(4)
Lesen yang diberikan kepada syarikat di bawah Peraturan-Peraturan ini hendaklah sah bagi apa-apa tempoh sebagaimana yang dinyatakan dalam lesen.
(5)
Pesuruhjaya boleh mengenakan apa-apa syarat apabila memberikan suatu lesen di bawah Peraturan-Peraturan ini.
Syarat lesen
Seksyen 4
Syarikat —
(a)
tidak boleh menjalankan apa-apa aktiviti sukan selain aktiviti sukan sebagaimana yang dinyatakan dalam lesen;

(b)
tidak boleh menjalankan apa-apa aktiviti sukan di tempat atau premis selain di tempat atau premis sebagaimana yang dinyatakan dalam lesen;
(c)
hendaklah mempamerkan lesen di tempat yang mudah dilihat semasa aktiviti sukan; dan
(d)
hendaklah mematuhi syarat lesen yang dikenakan oleh Pesuruhjaya apabila memberikan lesen di bawah Peraturan-Peraturan ini.
Pembatalan lesen
Seksyen 5
(1)
Pesuruhjaya boleh membatalkan lesen yang diberikan di bawah
Peraturan-Peraturan ini jika syarikat tidak mematuhi syarat lesen.
(2)
Sebelum Pesuruhjaya membatalkan lesen, Pesuruhjaya hendaklah memberi syarikat itu suatu notis bertulis tentang niat untuk membatalkan lesen itu.
(3)
Pesuruhjaya boleh menghendaki syarikat untuk membuat representasi bertulis kepada Pesuruhjaya dalam tempoh yang dinyatakan dalam notis yang disebut dalam subperaturan (2).
(4)
Pesuruhjaya hendaklah—
(a)
selepas mempertimbangkan representasi bertulis yang dibuat oleh syarikat di bawah subperaturan (3); atau
(b)
jika tiada representasi bertulis dibuat oleh syarikat di bawah subperaturan (3), memutuskan sama ada untuk membatalkan lesen itu atau selainnya.

(5)
Pesuruhjaya hendaklah memberitahu syarikat tentang keputusan untuk membatalkan lesen itu.
Borang
Seksyen 6
Pesuruhjaya hendaklah menyebabkan borang yang disebut dalam peraturan 2
disiarkan dalam sesawang rasminya.

SPORTS DEVELOPMENT ACT 1997
SPORTS DEVELOPMENT (LICENSING) REGULATIONS 2019
IN exercise of the powers conferred by section 38 of the Sports Development Act 1997
[Act 576], the Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Sports Development (Licensing)
Regulations 2019.
(2)
These Regulations come into operation on 1 March 2019.
Application for licence 2.
(1)
Any company referred to in section 36 of the Act which intends to carry out any sporting activity shall apply for a licence to the Commissioner by submitting a written application in the form as determined by the Commissioner.
(2)
The application referred to in subregulation (1) shall be made—
(a)
for local sporting activity, not less than thirty days before the date of the sporting activity; and
(b)
for international sporting activity, not less than ninety days before the date of the sporting activity.
(3)
The application under subregulation (1) shall be accompanied by the following documents:
(a)
certified copy of certificate of incorporation of the company;
(b)
certified copy of constitution of the company; and

(c)
such other information or documents as the Commissioner may require.
Grant or refusal of licence 3.
(1)
The Commissioner may, after considering the application for a licence under regulation 2, grant the licence or refuse to grant the licence to the company.
(2)
If the Commissioner decides to grant a licence under subregulation (1), the Commissioner shall require the company to pay the fee as specified in the
Schedule.
(3)
Where the Commissioner refuse to grant the licence, the Commissioner shall notify the company in writing of the refusal.
(4)
A licence granted to the company under these Regulations shall be valid for such period as specified in the licence.
(5)
The Commissioner may impose any conditions upon granting a licence under these Regulations.
Conditions of licence 4.
The company—
(a)
shall not carry out any sporting activity other than the sporting activities as specified in the licence;
(b)
shall not carry out any sporting activity in the place or premises other than the place or premises as specified in the licence;

(c)
shall display the licence in a conspicuous place during the sporting activity; and
(d)
shall comply with the conditions of the licence imposed by the
Commissioner upon granting a licence under these Regulations.
Revocation of licence 5.
(1)
The Commissioner may revoke the licence granted under these
Regulations if the company fails to comply with the conditions of the licence.
(2)
Before the Commissioner revokes the licence, the Commissioner shall give the company a written notice of the intention to revoke the licence.
(3)
The Commissioner may require the company to make written representation to the Commissioner within the period specified in such notice referred to in subregulation (2).
(4)
The Commissioner shall—
(a)
after considering the written representation made by the company under subregulation (3); or
(b)
if no written representation is made by the company under subregulation (3), decide whether to revoke the licence or otherwise.
(5)
The Commissioner shall notify the company of the decision to revoke the licence.

Form 6.
The Commissioner shall cause to be published the form referred to in regulation 2
in his official website.
