WATER SERVICES INDUSTRY (WATER RETICULATION AND PLUMBING)
(AMENDMENT) RULES 2021
IN exercise of the powers conferred by section 180
of the
Water Services Industry Act 2006 [Act 655], the Commission makes the following rules:
Citation and commencement 1.
(1)
These rules may be cited as the Water Services Industry
(Water Reticulation and Plumbing) (Amendment) Rules 2021.
(2)
These Rules come into operation on 10 May 2021 except the provisions specified in subrule (3).
(3)
Subparagraphs 11(b)(iv), 11(d)(i), 11(d)(ii) and 11(d)(iii) of these Rules come into operation on 10 May 2023.
Amendment of rule 2 2.
The Water Services Industry (Water Reticulation and Plumbing) Rules 2014
[P.U. (A) 36/2014], which are referred to as the “principal Rules” in these Rules, are amended in rule 2—
(a)
by substituting for the definition of “developer” the following definition:
‘ “developer” means any person or government agency that engages in or carries out or undertake or provides monies for developing works related to water supply systems;’; and
(b)
by inserting after the definition of “sampling station” the following definition:

‘ “service reservoir” means any reservoir for storing treated water at atmospheric pressure, constructed or to be constructed for the purpose of serving a development area;’.
Amendment of rule 7 3.
Rule 7 of the principal Rules is amended—
(a)
in paragraph 3(a), by substituting for the words “and the supply main within the development area” the words “ or the supply main to the development area or both”; and
(b)
in subrule (4)—
(i)
in the national language text, by inserting after the words
“Jika pemegang lesen pengagihan” the word “air”; and
(ii)
by substituting for the words “the centralized service reservoir together with the supply main which is to be connected to the public main” the words “the centralized service reservoir or the supply main which is to be connected to the public main or both”.
New rules 33A and 33B

The principal Rules are amended by inserting after rule 33 the following rules:
“Flow rate of taps and mixing valves 33A.
A person who installs a tap and a mixing valve shall ensure that the flow rate of the tap and the mixing valve not exceeding 8 litres per minute except for—
(a)
cleaning activity that requires higher water flow rate;
(b)
watering plant activity that uses hose and requires higher water flow rate; and

(c)
vehicle washing activity at the car wash centre.
Flow rate of shower taps, shower mixing valves and shower heads 33B.
A person who installs a shower tap, a shower mixing valve and a shower head shall ensure that the flow rate of the shower tap, the shower mixing valve and the shower head not exceeding 10 litres per minute.”.
Amendment of rule 65 5.
Subrule 65(1) of the principal Rules is amended by deleting the words
“Except for flushing cistern using a siphonic system,”.
Amendment of rule 75 6.
Subrule 75(2) of the principal Rules is amended in the national language text by deleting the words “atau penggantian semula”.
Amendment of rule 79 7.
Rule 79 of the principal Rules is amended by substituting for subrule (1)
the following subrule:
“(1) Where—
(a)
a meter has failed to register correctly the volume of the water supplied through it to any premises due to the commission of any offence under the Act or contravention any provisions of these
Rules by a consumer; or
(b) a meter is found to over-register under subrule 78(6), the charge to be made, in respect of any period or part of a period during which in the opinion of a water distribution licensee such failure or over-registration, as the case may be, under paragraph (a) or (b) has occurred or continued, shall be—

(i)
on the basis of an average water consumption of such premises or similar premises for the last three months of billing during which in the opinion of the water distribution licensee there was no such failure;
(ii)
on the basis of an addition to or a subtraction from the amount chargeable for a particular period of billing corresponding to the percentage by which such meter was determined to register too little or too much, as the case may be; or
(iii)
on the basis of an estimated water consumption calculated for three months from the check readings taken from a new meter installed at the premises in accordance with subrule 78(5).”.
Amendment of rule 81 8.
Rule 81 of the principal Rules is amended by deleting the words
“and other fire fighting devices”.
Amendment of rule 83 9.
Rule 83 of the principal Rules is amended by substituting for the definition of
“Management” the following definition:
‘ “Management” means—
(a)
any developer prior to the formation of a joint management body or management corporation established under the relevant written laws;
(b)
a joint management body or its managing agent established or appointed under the relevant written laws;
(c)
a management corporation or its managing agent or administrator established or appointed under the relevant written laws; or

(d)
any authorized person appointed under any other written laws for the management of high-rise residential or gated community;’.
Amendment of rule 98 10.
Subrule 98(1) of the principal Rules is amended—
(a)
in paragraph (a), by inserting after the words “ if applicable;” the word
“and”; and
(b) by deleting paragraph (b).
