Preamble

Pada menjalankan kuasa yang diberikan oleh perenggan 102(t) Akta Kerajaan Tempatan 1976 [Akta 171], Majlis Perbandaran Kemaman membuat dan menurut seksyen 103 Akta tersebut, Pihak Berkuasa Negeri dengan ini mengesahkan undang-undang kecil yang berikut: Nama, pemakaian dan permulaan kuat kuasa

Seksyen 1

(1)

Undang-undang kecil ini bolehlah dinamakan Undang-Undang Kecil

(Mengkompaun Kesalahan) Majlis Daerah Kemaman (Pindaan) 2021 dan hendaklah terpakai bagi kawasan Majlis Perbandaran Kemaman.

(2)

Undang-Undang Kecil ini hendaklah mula berkuat kuasa pada tarikh ianya disiarkan dalam Warta.

Pindaan undang-undang kecil 1

Seksyen 2

Undang-Undang Kecil (Mengkompaun Kesalahan) Majlis Daerah Kemaman 1983 [Tr.P.U. 3/83] yang disebut “Undang-Undang Kecil ibu” dalam Undang-Undang Kecil ini, dipinda dalam undang-undang kecil 1 dengan menggantikan perkataan “Majlis Daerah Kemaman” dengan perkataan “Majlis Perbandaran

Kemaman”.

Seksyen 3

Pindaan am

Daerah Kemaman” di mana-mana jua terdapat dengan perkataan “Majlis

Perbandaran Kemaman”.

Seksyen 4

Pindaan undang-undang kecil 3

Undang-Undang Kecil ibu dipinda dengan menggantikan perenggan 3(1) dengan perenggan yang berikut:

“3. (1) Jumlah wang yang dikehendaki dipungut bagi mengkompaun suatu kesalahan tidak boleh lebih daripada lima puluh peratus daripada denda maksimum yang dengannya kesalahan itu boleh dihukum oleh Akta atau undang-undang kecil yang dibuat di bawahnya.”.

Opening note

Preamble

In exercise of the powers conferred under paragraph 102(t) of the Local Government Act 1976 [Act 171], the Kemaman Municipal Council makes and pursuant to section 103 of the Act, the State Authority hereby confirms the following by-laws: Short title application and commencement 1.

(1)

These by-laws may be cited as the District Council Kemaman

(Compounding of Offences) By-Laws 2021 and shall apply to the Kemaman

Municipal Council.

These By-Laws shall come into operation on the date of its publication in the Gazette.

Amendment of by-laws 1

Seksyen 2

The District Council Kemaman (Compounding of Offences) By-Laws, 1983

[Tr.P.U. 3/83], which are referred to as the “principal By-Laws” in these By-Laws, is amended in by-law 1 by substituting the words “District Council Kemaman”

the words “Kemaman Municipal Council”.

Seksyen 3

General amendment

The principal By-Laws are amended by substituting for the words “District

Council Kemaman” wherever appearing the words “Kemaman Municipal Council”.

Seksyen 4

Amendment of by-laws 3

The principal By-Laws are amended by substituting for the paragraph 3 (1) the following paragraph:

“3. (1) The sum of money to be collected for compounding an offence shall not exceed fifty per centum of the maximum fine with which such offences is punishable under the Act or by-laws made thereunder.”.
