Preamble

Pada menjalankan kuasa yang diberikan oleh perenggan 102(t) Akta Kerajaan Tempatan 1976 [Akta 171], Majlis Daerah Marang membuat dan menurut seksyen 103 Akta tersebut, Pihak Berkuasa Negeri dengan ini mengesahkan undang-undang kecil yang berikut: Nama, pemakaian dan permulaan kuat kuasa

Seksyen 1

(1)

Undang-undang kecil ini bolehlah dinamakan Undang-Undang Kecil

(Mengkompaun Kesalahan) Majlis Daerah Marang (Pindaan) 2021 dan hendaklah terpakai bagi kawasan Majlis Daerah Marang.

(2)

Undang-Undang Kecil ini hendaklah mula berkuat kuasa pada tarikh ianya disiarkan dalam Warta.

Seksyen 2

Undang-Undang Kecil (Mengkompaun Kesalahan) Majlis Daerah Marang

[Tr.P.U. 4/1984] dipinda dengan menggantikan perenggan 3(1) dengan perenggan berikut:

“3. (1) Jumlah wang yang dikehendaki dipungut bagi mengkompaun suatu kesalahan tidak boleh lebih daripada lima puluh peratus daripada denda maksimum yang dengannya kesalahan itu boleh dihukum oleh Akta atau undang-undang kecil yang dibuat di bawahnya.”.

Diperbuat oleh Majlis Daerah Marang dalam mesyuaratnya pada 27 November 2019 [Rujukan : MDM/438/1/030/2009]

Opening note

Preamble

In exercise of the powers conferred under paragraph 102 (t) of the Local Government Act 1976 [Act 171], the Marang District Council makes and pursuant to section 103 of the Act, the State Authority hereby confirms the following by-laws: Short title, application and commencement 1.

(1)

These by-laws may be cited as the District Council Marang

(Compounding of Offences) (Amendment) By-Laws 2021 and shall apply to the

District Council Marang.

(2)

These By-Laws shall come into operation on the date of its publication in the Gazette.

Amendment of by-laws 3

Seksyen 2

The District Council Marang (Compounding of Offences) By-Laws, 1983

[Tr.P.U.4/1984], is amended by substituting paragraph 3(1) the following paragraph:

“3. (1) The sum of money to be collected for compounding an offence shall not exceed fifty per centum of the maximum fine with which such offences is punishable under the Act or by-laws made thereunder.”.
