Preamble

PADA menjalankan kuasa yang diberikan oleh perenggan 27(b) Akta Penapisan Filem 2002 [Akta 620], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Penapisan Filem (Fi) (Pindaan) 2014.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 1 Julai 2014.

(a)

Jika suatu filem sinematografi asal yang penayangannya disertai dengan bunyi atau tidak disertai dengan bunyi (filem sinematografi bisu)

dikemukakan bagi maksud penapisan dan Lembaga, setelah membuat penapisan—

(i)

meluluskan filem itu untuk ditayangkan tanpa apa-apa pengubahan sebagaimana yang diperuntukkan dalam perenggan 10(1)(a) Akta;

(ii)

meluluskan filem itu untuk ditayangkan dengan pengubahan sebagaimana yang diperuntukkan dalam perenggan 10(1)(b) Akta;

atau

(iii)

enggan meluluskan penayangan filem itu sebagaimana yang diperuntukkan dalam perenggan 10(1)(c) Akta.

(b)

Jika suatu filem sinematografi yang dikemukakan bagi maksud penapisan ialah pendua bagi filem yang dirujuk dalam subperenggan (a), tanpa mengira sama ada Lembaga meluluskan filem itu dengan atau tanpa pengubahan di bawah perenggan 10(1)(a) atau (b) Akta.

(a)

Jika suatu filem sinematografi asal yang diimport atau disewa oleh persatuan filem bona fide atau mana-mana persatuan lain untuk tayangan tanpa keuntungan di suatu festival filem dikemukakan bagi maksud penapisan dan Lembaga, setelah membuat penapisan—

(i)

meluluskan filem itu untuk ditayangkan tanpa apa-apa pengubahan sebagaimana yang diperuntukkan dalam perenggan 10(1)(a) Akta;

(ii)

meluluskan filem itu untuk ditayangkan dengan pengubahan sebagaimana yang diperuntukkan dalam perenggan 10(1)(b) Akta;

atau

(iii)

enggan meluluskan penayangan filem itu sebagaimana yang diperuntukkan dalam perenggan 10(1)(c) Akta.

Preamble

IN exercise of the powers conferred by paragraph 27(b) of the Film Censorship Act 2002 [Act 620], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Film Censorship (Fees)

(Amendment) Regulations 2014.

(2)

These Regulations come into operation on 1 July 2014.

Amendment of Schedule 2.

The Film Censorship (Fees) Regulations 2011 [P.U. (A) 16/2011] are amended by substituting for Schedule the following Schedule:

CINEMATOGRAPH FILM

Seksyen 1

(a)

Where an original cinematograph film of which the projection is accompanied or not accompanied by sound (a silent cinematograph film) is presented for the purpose of censorship and the Board, upon censorship—

(i)

approves the film for exhibition without any alteration as provided for in paragraph 10(1)(a) of the Act;

(ii)

approves the film for exhibition with alteration as provided for in paragraph 10(1)(b) of the Act; or

(iii)

refuses to approve the film for exhibition as provided for in paragraph 10(1)(c) of the Act.

(b)

Where a cinematograph film presented for the purpose of censorship is a duplicate of a film referred to in subparagraph (a), irrespective of whether the Board approves the film with or without alteration under paragraph 10(1)(a) or (b) of the Act.

Where an original cinematograph film is imported or rented by a bona fide film society or any other society for an exhibition without profit at a film festival is presented for the purpose of censorship and the Board, upon censorship—

(i)

approves the film for exhibition without any alteration as provided for in paragraph 10(1)(a) of the Act;

(ii)

approves the film for exhibition with alteration as provided for in paragraph 10(1)(b) of the Act; or

(iii)

refuses to approve the film for exhibition as provided for in paragraph 10(1)(c) of the Act.

Where any film-publicity material in respect of a cinematograph film is presented for the purpose of approval by the Board under subsection 19(1)
