Section 34

(2)

The arbitral tribunal shall order the termination of the arbitral proceedings where—

(a)

the claimant withdraws the claim, unless the respondent objects to the withdrawal and the arbitral tribunal recognizes the respondent’s legitimate interest in obtaining a final settlement of the dispute;

(b)

the parties agree on the termination of the proceedings;

or

(c)

the arbitral tribunal finds that the continuation of the proceedings has for any other reason become unnecessary or impossible.

(3)

Subject to the provisions of section 35 and subsection 37(6), the mandate of the arbitral tribunal shall terminate with the termination of the arbitral proceedings.

(4)

Unless otherwise provided by any written law, the death of a party does not terminate—

(a)

the arbitral proceedings; or

(b)

the authority of the arbitral tribunal.
