Section 5
The principal Act is amended by inserting after section 9
the following section:
“Law applicable to arbitration agreement 9a. (1) The parties are free to agree on the law to be applicable to the arbitration agreement.
(2)
Where the parties fail to agree under subsection (1), the law applicable to the arbitration agreement shall be the law of the seat of the arbitration.
(3)
The agreement by the parties on the law applicable to an agreement of which the arbitration agreement forms a part shall not constitute an express agreement that the law shall also be applicable to the arbitration agreement.”.
