(2)

Before the Bank declares any dividend, it shall apply in writing for the approval of the Minister in respect of the amount proposed to be declared, and the Minister may approve such amount, or a reduced amount, or prohibit payment of any dividend, having regard to the financial condition of the Bank.

(3)

Where the Bank fails to comply with subsection (1) or (2), it shall be guilty of an offence and shall on conviction be liable to a fine not exceeding one million ringgit.

(4)

Where the Bank is guilty of an offence under subsection (3), any person who at the time of the commission of the offence was a person responsible for the Bank shall also be guilty of that offence and shall on conviction be liable to a fine not exceeding one million ringgit or to imprisonment for a term not exceeding one year or to both.
