Section 109
(1)
Any police officer not below the rank of Sergeant or any officer in charge of a police station may without the order of the
Public Prosecutor exercise all or any of the special powers in relation to police investigations given by this Chapter in any seizable case.
(2)
No proceedings of a police officer in any such case shall at any stage be called in question on the ground that the case was one in which

that officer was not empowered under this section to exercise the special powers of police investigations given by this Chapter.
