(2)
If a Magistrate acting under subsection (1) does not have jurisdiction to try the case and considers further detention unnecessary, he may order such person to be produced before a court having such jurisdiction, or, if the case is triable exclusively by the
High Court, before himself or any Magistrate having jurisdiction with a view to transmitting the case for trial by the High Court.
(3)
Nothing in this section shall be construed as in any manner derogating from section 117 of the Criminal Procedure Code in its application in any case of an offence against this Act where the investigation is made by a police officer.
