Section 40

of *INTERNATIONAL TRADE IN ENDANGERED SPECIES ACT 2008

Section 40

A person who—

(a)

assaults, obstructs, impedes or interferes with any enforcement officer in the performance of his functions under this Act;

(b)

rescues or endeavours to rescue any scheduled species, conveyance, machinery, contrivance, equipment, book, record, document or other article seized under this Act; or

(c)

before or after any seizure causes the disappearance of, or damages or destroys any scheduled species, conveyance, machinery, contrivance, equipment, book, record, document or other article in order to prevent the seizure thereof or the securing of the scheduled species, conveyance, machinery, contrivance, equipment, book, record, document or other article, commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or imprisonment for a term not exceeding seven years or both.
