- PADA menjalankan kuasa yang diberikan oleh seksyen 35 Akta Arkitek 1967 [Akta 117], Lembaga Arkitek Malaysia, dengan kelulusan Menteri, membuat kaedah-kaedah yang berikut: Nama dan permulaan kuat kuasa

Kaedah-Kaedah Arkitek 1996 [P.U. (A) 379/1996], yang disebut “Kaedah-Kaedah ibu” dalam Kaedah-Kaedah ini, dipinda—
(a)
dengan menggantikan perkataan “Arkitek Profesional” di mana-mana jua terdapat dengan perkataan “Arkitek”;
(b)
dengan menggantikan perkataan “seorang Arkitek Profesional” di mana-mana jua terdapat dengan perkataan “seorang Arkitek”; dan
(c)
dalam teks bahasa
Inggeris, dengan menggantikan perkataan
“A Professional Architect” di mana-mana jua terdapat dengan perkataan

“Perakuan pendaftaran.
Seksyen 21
Apabila suatu permohonan untuk pendaftaran sebagai seorang Arkitek, seorang Arkitek Siswazah, seorang
Pelukis Pelan Bangunan, seorang Pereka Bentuk Dalaman, seorang Pereka Bentuk Dalaman Siswazah, seorang
Pemeriksa Tapak, seorang Teknologis Seni Bina atau pendaftaran seorang arkitek asing sebagai seorang Arkitek, diluluskan oleh
Lembaga,
Pendaftar hendaklah mengeluarkan suatu perakuan pendaftaran dalam borang sebagaimana yang ditentukan oleh Lembaga.”.

Mana-mana Teknologis Seni Bina yang namanya telah dikeluarkan daripada Daftar menurut perenggan 27Z(b) Akta kerana tidak membaharui pendaftarannya hendaklah dalam masa lima tahun dari tarikh namanya dikeluarkan, apabila memberitahu
Pendaftar akan hasratnya untuk dimasukkan semula menurut subseksyen 27ZA(2) Akta, secara bertulis menyatakan butir-butir penggajian atau pekerjaannya pada tarikh pemberitahuannya kepada
Pendaftar.”.

Pereka Bentuk Dalaman dalam Bahagian Tiga Jadual Kedua.

Pemeriksa
Tapak hendaklah, dalam menjalankan profesionnya, mematuhi dan berpandukan peruntukan
Kod Tatakelakuan Bagi Pemeriksa Tapak sebagaimana yang ditentukan oleh Lembaga.
(7)
Seseorang Teknologis Seni Bina hendaklah, dalam menjalankan profesionnya, mematuhi dan berpandukan peruntukan
Kod Tatakelakuan Bagi Teknologis Seni Bina sebagaimana yang ditentukan oleh Lembaga.”.

Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 30 kaedah yang berikut:
“Lembaga pengarah bagi pertubuhan perbadanan yang didaftarkan sebagai 30A.
(1)
Suatu lembaga pengarah suatu pertubuhan perbadanan yang didaftarkan sebagai pengamal perundingan seni bina di bawah subperenggan 7A(3)(c) Akta hendaklah terdiri daripada—
(a)
sekurang-kurangnya dua pertiga anggotanya ialah Arkitek dan baki anggota lembaga pengarah boleh terdiri daripada mana-mana orang; dan

pengamal perundingan seni bina.
(b)
sekurang-kurangnya seorang orang yang disebut di bawah subperenggan 7A(3)(c)(iv) Akta.
(2)
Walau apa pun subkaedah (1), hanya pengarah yang merupakan seorang Arkitek boleh membuat keputusan berkenaan dengan apa-apa perkhidmatan perundingan seni bina.
Modal berbayar dan pegangan saham oleh pertubuhan perbadanan yang didaftarkan sebagai pengamal perundingan.
30B.
Suatu pertubuhan perbadanan yang didaftarkan sebagai pengamal perundingan di bawah perenggan 7A(3)(c) Akta hendaklah mempunyai—
(a)
suatu modal berbayar minimum sebanyak lima puluh ribu ringgit; dan
(b)
sekurang-kurangnya tujuh puluh peratus ekuiti saham dipegang oleh Arkitek dan baki ekuiti saham boleh dipegang oleh—
(i)
mana-mana orang;
(ii)
mana-mana pertubuhan perbadanan; atau
(iii)
mana-mana orang dan pertubuhan perbadanan.”.

15.
Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 32B kaedah yang berikut:

Perjanjian antara Klien dengan Pelukis Pelan Bangunan.

Sebagai balasan kepada Pelukis Pelan Bangunan memberikan perkhidmatan perundingan seni bina yang dikehendaki, Klien dengan ini bersetuju untuk membayar
Pelukis Pelan Bangunan mengikut fi yang akan ditentukan oleh Lembaga.
4.
Lat tempoh pembayaran *setiap bulan/…………………… bermula dari permulaan pelantikan Pelukis Pelan Bangunan itu.
5.

ARCHITECTS ACT 1967
ARCHITECTS (AMENDMENT) RULES 2015
IN exercise of the powers conferred by section 35 of the Architects Act 1967 [Act 117], the Board of Architects Malaysia, with the approval of the Minister, makes the following rules:
Citation and commencement 1.
(1)
These rules may be cited as the Architects (Amendment) Rules 2015.
(2)
These Rules come into operation on 30 November 2015.
General amendment 2.
The Architects Rules 1996 [P.U. (A) 379/1996], which are referred to as the
“principal Rules” in these Rules, are amended—
(a)
by substituting for the words “Professional Architect” wherever appearing the word “Architect”;
(b)
by substituting for the words “a Professional Architect” wherever appearing the words “an Architect”; and
(c)
in the English language text, by substituting for the words “A Professional
Architect” wherever appearing the words “An Architect”.
Amendment of rule 4 3.
Rule 4 of the principal Rules is amended by inserting after subrule (1) the following subrule:
“(1A)
Notwithstanding subrule (1), in exceptional circumstances the
President may give a written notice of not less than three days to convene a meeting.”.

Amendment of rule 17 4.
Rule 17 of the principal Rules is amended—
(a)
by substituting for paragraph (a) the following paragraph:
“(a)
person desirous of being registered as—
(i)
an Architect under subsection 10(2) of the Act;
a Graduate Architect under subsection 10(1) of the Act;
a Building Draughtsman under section 22 of the Act;
an Interior Designer under subsection 27D(2) of the Act;
(v)
a Graduate Interior Designer under subsection 27D(1)
of the Act;
an Inspector of Works under subsection 27M(1) of the
Act; or
an Architectural Technologist under subsection 27V(1) of the Act; or”; and
(b)
in paragraph (b), by deleting the word “temporarily”.
Amendment of rule 20 5.
Rule 20 of the principal Rules is amended by substituting for the words
“a Graduate Architect, Professional Architect, Building Draughtsman or Interior
Designer, or temporary registration of a foreign architect as a Professional Architect”
the words “an Architect, a Graduate Architect, a Building Draughtsman, an Interior
Designer, a Graduate Interior Designer, an Inspector of Works, an Architectural
Technologist or registration of a foreign architect as an Architect”.

Substitution of rule 21 6.
The principal Rules are amended by substituting for rule 21 the following rule—

Upon an application for registration as an Architect, a Graduate Architect, a Building Draughtsman, an Interior
Designer, a Graduate Interior Designer, an Inspector of
Works, an Architectural Technologist or registration of a foreign architect as an Architect being approved by the
Board, the Registrar shall issue a certificate of registration in the forms as may be determined by the Board.”.
Amendment of rule 22 7.
Rule 22 of the principal Rules is amended—
(a)
in subrule (1), by substituting for the words “Every Graduate Architect or
Professional Architect” the words “Every Architect or Graduate Architect”;
(b)
in subrule (3), by inserting after the words “Every Interior Designer” the words “or Graduate Interior Designer”; and
(c)
by inserting after subrule (3) the following subrules:
“(4)
Every Inspector of Works desirous of renewing his registration under subsection 27M(4) of the Act shall apply to the
Board in writing on or before 31 January of the year following the year of expiration of his registration and such application shall be accompanied with the renewal fee as prescribed in Part Two of the
First Schedule.
(5)
Every Architectural Technologist desirous of renewing his registration under subsection 27V(4) of the Act shall apply to the
Board in writing on or before 31 January of the year following the year of expiration of his registration and such application shall be

accompanied with the renewal fee as prescribed in Part Two of the
First Schedule.”.
Amendment of rule 24 8.
Rule 24 of the principal Rules is amended—
(a)
in subrule (1B), by inserting after the words “Any Interior Designer” the words “or Graduate Interior Designer”; and
(b)
by inserting after subrule (1B) the following subrules:
“(1C)
Any Inspector of Works whose name has been removed from the Register pursuant to paragraph 27Q(b) of the Act for failure to renew his registration shall within five years from the date of the removal, when notifying the Registrar of his desire to be reinstated pursuant to subsection 27R(2) of the Act, in writing state the particulars of his employment or occupation as on the date of his notification to the Registrar.
(1D)
Any Architectural Technologist whose name has been removed from the Register pursuant to paragraph 27Z(b) of the Act for failure to renew his registration shall within five years from the date of the removal, when notifying the Registrar of his desire to be reinstated pursuant to subsection 27ZA(2) of the Act, in writing state the particulars of his employment or occupation as on the date of his notification to the Registrar.”.
Amendment of rule 26 9.
Rule 26 of the principal Rules is amended—
(a)
in subrule (2), by inserting after the words “subrule (1)” the words “and subparagraphs 10(2)(a)(i) and (ii) of the Act”; and

(b)
by inserting after subrule (2) the following subrule:
“(3)
The Corporate Member of the Pertubuhan Arkitek
Malaysia referred to in subparagraph 10(2)(a)(ii) of the Act shall be entitled on application to be registered as an Architect if he—
(a)
holds the qualification recognized by the Board;
(b)
is registered with the Board as a Graduate
Architect; and
(c)
has obtained the practical experience and passed the examination as may be determined by the
Board.”.
Amendment of rule 27 10.
Rule 27 of the principal Rules is amended—
(a)
in subrule (1)—
(i)
by deleting the word “temporary” wherever appearing; and
(ii)
by substituting for the words “the country where he normally practises” the words “his country of origin”; and
(b)
in subrules (3) and (4), by deleting the word “temporary”.
Amendment of heading of Part IV
11.
The heading of Part IV of the principal Rules is amended by deleting the word
“PROFESSIONAL”.

Amendment of rule 28 12.
Rule 28 of the principal Rules is amended—
(a)
in the marginal note, by deleting the word “Professional”;
(b)
in subrules (1) and (2), by substituting for the words “Code of
Professional Conduct for Professional Architect” the words “Code of
Conduct for Architect”; and
(c)
by inserting after subrule (4) the following subrules:
“(5)
A Graduate Interior Designer shall, in the exercise of his profession, observe and be guided by the provisions in paragraph 1, paragraph 4 except subparagraphs 4(5), 4(7), 4(15), subparagraphs 2(4), 2(5), 2(6), 3(1), 3(3), 5(3) and 5(4), and subsubparagraphs 3(5)(b), (c) and (d), of the Code of Conduct for
Interior Designers in Part Three of the Second Schedule.
(6)
An Inspector of Works shall, in the exercise of his profession, observe and be guided by the provisions of the Code of Conduct for
Inspector of Works as may be determined by the Board.
(7)
An Architectural Technologist shall, in the exercise of his profession, observe and be guided by the provisions of the Code of
Conduct for Architectural Technologist as may be determined by the
Board.”.
Amendment of rule 29 13.
Subrule 29(2) of the principal Rules is amended by inserting after the words
“Part Two of the Third Schedule” the words “and the Memorandum of Agreement in
Part Three of the Fourth Schedule” .

New rules 30A and 30B
14.
The principal Rules are amended by inserting after rule 30 the following rules:
“Board of directors of body corporate registered as architectural consultancy practice.
30A.
(1)
A board of directors of a body corporate registered as an architectural consultancy practice under subparagraph 7A(3)(c) of the Act shall comprise—
(a)
at least two third of its members are Architects and the remaining members of the board of directors may be any persons; and
(b)
at least one person referred to under subparagraph 7A(3)(c)(iv) of the Act.
(2)
Notwithstanding subrule(1), only the director who is an
Architect may make any decision relating to architectural consultancy services.
Paid-up capital and shareholding of body corporate registered as architectural consultancy practice.
30B.
A body corporate registered as an architectural consultancy practice under paragraph 7A(3)(c) of the Act shall have—
(a)
a minimum paid up capital of fifty thousand ringgit; and
(b)
at least seventy percent of its share equity held by
Architects and the remaining share equity may be held by—
(i)
any person;
(ii)
any body corporate; or
(iii)
any person and body corporate.”.

15.
The principal Rules are amended by inserting after rule 32B the following rule:

32BA. A Corporate Member of the Malaysian Institute of
