dengan memasukkan selepas takrif “pegawai diberikuasa” takrif yang berikut:

‘ “sistem pengecaman plat nombor automatik” ertinya suatu sistem untuk mengenal pasti, menganalisis dan merekodkan nombor pendaftaran suatu kenderaan motor;’;

ELEKTRONIK ATAU BERKOMPUTER

Seksyen 1

Mana-mana kenderaan motor yang melalui suatu sistem penimbang semasa bergerak elektronik atau berkomputer akan menyentuh sensor gelung induktif dan sensor penimbang semasa bergerak.

Sistem penimbang semasa bergerak elektronik atau berkomputer itu hendaklah merekodkan butir-butir yang berikut:

(a)

imej yang jelas bagi keseluruhan badan suatu kenderaan motor dari pandangan hadapan, belakang dan sisi kenderaan itu;

imej yang jelas bagi nombor pendaftaran kenderaan motor itu, dari pandangan hadapan dan belakang kenderaan motor itu;

bilangan gandar kenderaan motor yang ditimbang itu;

Jika kenderaan motor yang ditimbang itu melebihi berat dengan muatan yang dibenarkan, suatu notis di bawah seksyen 53A Akta dan sijil penimbangan akan dijana secara elektronik dan disampaikan kepada pemunya berdaftar kenderaan motor itu mengikut cara penyampaian di bawah seksyen 118 Akta.

JADUAL KESEPULUH

[Subkaedah 9(6)]

UJIAN KEJITUAN DAN PENENTUSAHAN SISTEM PENIMBANG SEMASA BERGERAK

ELEKTRONIK ATAU BERKOMPUTER

Suatu sistem penimbang semasa bergerak elektronik atau berkomputer hendaklah diuji mengikut prosedur yang berikut:

1.

Suatu sistem penimbang semasa bergerak elektronik atau berkomputer hendaklah diuji dan dikalibrasi mengikut prosedur sebagaimana yang dinyatakan dalam piawaian International Organization of Legal Metrology (OIML) R-134 2009

dan dikeluarkan suatu sijil kalibrasi.

2.

Sistem penimbang semasa bergerak elektronik atau berkomputer itu hendaklah pada setiap masa memiliki sijil kalibrasi yang sah.”.

ROAD TRANSPORT ACT 1987

MOTOR VEHICLES (WEIGHING) (AMENDMENT) RULES 2025

IN exercise of the powers conferred by section 66 of the Road Transport Act 1987

[Act 333], the Minister, after consultation with the Chief Inspector of Weights and

Measures, makes the following rules:

Citation and commencement 1.

(1)

These rules may be cited as the Motor Vehicles (Weighing)

(Amendment) Rules 2025.

(2)

These Rules come into operation on 31 August 2025.

Amendment of rule 2 2.

The Motor Vehicles (Weighing) Rules 1990 [P.U. (A) 466/1990], which are referred to as the “principal Rules” in these Rules, are amended in rule 2—

(a)

by inserting after the definition of “authorised officer” the following definition:

‘ “automatic number plate recognition system” means a system to identify, analyse and record the registration number of a motor vehicle;’;

(b)

by inserting after the definition of “Chief Inspector of Weights and

Measures” the following definition:

‘ “computerized or electronic weigh in-motion system” means a system to weigh, identify and record a laden weight of a motor vehicle while the motor vehicle is moving on the road;’;

(c)

by inserting after the definition of “computerized or electronic weigh in-motion system” as inserted the following definition:

‘ “inductive loop sensor” means an instrument to detect the presence of a motor vehicle through a sensor installed on any road;’; and

(d)

by inserting after the definition of “weigh-in-motion axle weighing machine” the following definition:

‘ “weigh in-motion sensor” means a sensor installed on any road used to weigh and record the laden weight of a moving motor vehicle.’.

Amendment of rule 7 3.

Rule 7 of the principal Rules is amended by inserting after subrule (4)

the following subrule:

“(5)

Where a computerized or electronic weigh in-motion system is being used in determining the laden weight of a motor vehicle, the weighing shall be conducted in accordance with the procedure prescribed in the Ninth Schedule.”.

Amendment of rule 8 4.

Rule 8 of the principal Rules is amended—

(a)

by renumbering the existing rule as subrule (1);

(b)

in the renumbered subrule (1), by inserting after the words

“a motor vehicle” the words “other than using a computerized or electronic weigh in-motion system”; and

(c)

by inserting after the renumbered subrule (1) the following subrule:

“(2)

In a case where a motor vehicle is weighed by using a computerized or electronic weigh in-motion system, the weight certificate issued in respect of the motor vehicle shall contain the following particulars:

(a)

the date, time and place of weighing;

(b)

the motor vehicle registration number;

(c)

the total weight of the axles of each motor vehicle with loads, if applicable;

(d)

the total weight of the axles of the separate unit of the motor vehicle with loads, if applicable;

(e)

the laden weight of the motor vehicle recorded by the system; and

(f)

the name and signature of any road transport officers authorized in writing by the Director General, generated automatically in the electronic notice.”.

Amendment of rule 9 5.

Rule 9 of the principal Rules is amended by inserting after subrule (5)

the following subrule:

“(6)

The accuracy and verification tests of a computerized or electronic weigh in-motion system shall be conducted in accordance with the procedure prescribed in the Tenth Schedule.”.

New Ninth and Tenth Schedules 6.

The principal Rules are amended by inserting after the Eighth Schedule the following schedules:

“NINTH SCHEDULE

[Subrule 7(5)]

WEIGHING PROCEDURE USING COMPUTERIZED OR ELECTRONIC

WEIGH IN-MOTION SYSTEM

1.

Any motor vehicle passing through a computerized or electronic weigh in-motion system will touch the inductive loop sensor and the weigh in-motion sensor.

2.

The computerized or electronic weigh in-motion system shall record the following particulars:

(a)

the clear image of the overall body of a motor vehicle at the front, rear and sides view of the vehicle;

(b)

the clear image of registration number of the motor vehicle, at the front and rear view of the motor vehicle;

(c)

the date, time and location of the weighted motor vehicle;

(d)

the number of axles of the weighted motor vehicle;

(e)

the total laden weight of the weighted motor vehicle; and

(f)

the speed of the motor vehicle while being weighted.

3.

If the weighted motor vehicle exceeds the permissible laden weight, a notice under section 53A of the Act and a weight certificate will be generated electronically and served to the registered owner of the motor vehicle in accordance with the form of service under section 118 of the Act.

TENTH SCHEDULE

[Subrule 9(6)]

ACCURACY AND VERIFICATION TEST OF COMPUTERIZED OR ELECTRONIC

WEIGH IN-MOTION SYSTEM

A computerized or electronic weigh in-motion system shall be tested in accordance with the following procedure:

1.

A computerized or electronic weigh in-motion system shall be tested and calibrated in accordance with the procedure as specified in the International

Organization of Legal Metrology (OIML) R-134 2009 standards and issued with a certificate of calibration.

2.

The computerized or electronic weigh in-motion system shall at all times possess a valid certificate of calibration.”.
