Jika seseorang kanak-kanak di dalam kenderaan motor didapati tidak diletakkan di dalam sistem kekangan kanak-kanak yang sesuai mengikut subkaedah (1) atau (3), pemandu kenderaan motor itu melakukan suatu kesalahan dan boleh, dalam hal sabitan yang pertama, didenda tidak melebihi dua ribu ringgit atau dipenjarakan selama tempoh tidak melebihi enam bulan dan, dalam hal sabitan kali kedua atau kali kemudian, didenda tidak melebihi empat ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua belas bulan atau kedua-duanya.

Bagi maksud kaedah ini, “sistem kekangan kanak-kanak yang sesuai” ertinya sistem kekangan kanak-kanak yang sesuai dengan umur, berat dan ketinggian seseorang kanak-kanak.

Pengecualian khas berhubung dengan sistem kekangan kanak-kanak.

Walau apa pun subkaedah 4B(4), seseorang pemandu kenderaan motor tidaklah melakukan kesalahan di bawah subkaedah 4B(1)—

(a)

jika tidak mungkin bagi sesuatu kenderaan motor disebabkan oleh pembinaannya untuk

dipasang dengan sistem kekangan kanak-kanak yang sesuai;

  1. IN exercise of the powers conferred by section 66 of the Road Transport Act 1987 [Act 333], the Minister makes the following rules: Citation and commencement 1.

These rules may be cited as the Motor Vehicles (Safety Seat-Belts)

(Amendment) Rules 2019.

These Rules come into operation on 1 January 2020.

Amendment of rule 1 2.

The Motor Vehicles (Safety Seat-Belts) Rules 1978 [P.U. (A) 378/1978], which are referred to as the “principal Rules” in these Rules, are amended in rule 1 by substituting for the words “Motor Vehicles (Safety Seat-Belts)” the words “Motor Vehicles

(Safety Seat-Belts and Child Restraint System)”.

New rule 1A

The principal Rules are amended by inserting after rule 1 the following rule:

“Definition.

In these Rules—

“bus” has the meaning assigned to it in the Land Public

Transport Act 2010 [Act 715] and the Commercial Vehicles

Licensing Board Act 1987 [Act 334], and includes excursion bus;

“stage bus” has the meaning assigned to it in the Land

Public Transport Act 2010 and the Commercial Vehicles

Licensing Board Act 1987;

“child” means a person who is under the age of twelve years and of less than 36 kilogrammes in weight and of less than 136 centimetres in height;

“tourism vehicle” has the meaning assigned to it in the

Land Public Transport Act 2010 and the Tourism Vehicles

Licensing Act 1999 [Act 594];

“public service vehicle” has the meaning assigned to it in the Land Public Transport Act 2010 and the Commercial Vehicles

Licensing Board Act 1987;

“child restraint system" means a device capable of accommodating a child occupant in a sitting or supine position in a motor vehicle, and designed so as to diminish the risk of injury to the child in the event of a collision or abrupt deceleration of the motor vehicle by limiting the mobility of the child’s body.”.

Amendment of rule 2 4.

Rule 2 of the principal Rules is amended—

(a)

in the national language text, by substituting for the words “kereta motor”

wherever appearing including in the marginal note the words

“kenderaan motor”;

in subrule (1), by inserting after the words “such fitting” the words

“in accordance with the specifications specified in the Schedule”;

in subrule (2), by substituting for the words “Paragraph (1)” the words

“Subrule (1)”; and

by substituting for subrule (3) the following subrule:

“(3) Where a motor vehicle referred to in subrule (2) is found not to be fitted with a safety seat-belt in accordance with subrule (1), the registered owner of such motor vehicle shall be guilty of an offence and shall be liable, in the case of a first conviction, to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding six months and, in the case of a second or subsequent conviction, to a fine not exceeding four thousand ringgit or to imprisonment for a term not exceeding twelve months or to both.”.

Rule 2A of the principal Rules is amended—

by substituting for subrule (1) the following subrule:

“(1) Subject to rule 6—

every rear seat of a motor vehicle, other than a motor vehicle referred to in paragraph (b), which is registered on or after 1 January 1995 shall be fitted with a safety seat-belt with three built-in anchorage points located in the best position for such fitting in accordance with the specifications specified in the Schedule; and

(b)

every rear seat of a bus, except a stage bus, which is constructed on or after 1 January 2020 shall be fitted with a safety seat-belt with at least two built-in anchorage points located in the best position for such fitting in accordance with the specifications specified in the Schedule.”;

by inserting after subrule (2) the following subrule:

“(3) Where a motor vehicle referred to in subrule (1) is found not to be fitted with a safety seat-belt in accordance with that subrule, the registered owner of such motor vehicle shall be guilty of an offence and shall be liable, in the case of a first conviction, to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding six months and, in the case of a second or subsequent conviction, to a fine not exceeding four thousand ringgit or to imprisonment for a term not exceeding twelve months or to both.”.

Deletion of rule 3 6.

The principal Rules are amended by deleting rule 3.

Amendment of rule 4 7.

Rule 4 of the principal Rules is amended in the national language text by substituting for the words “kereta motor” wherever appearing including in the marginal note the words “kenderaan motor”.

“Every person in rear seat of motor vehicle to wear safety seat-belts.

“Every child in motor vehicle to be placed in child restraint system.

A forward-facing child restraint system may be fitted in the front passenger seat of a motor vehicle which is equipped with an airbag.

A rearward-facing child restraint system shall not be fitted in the front passenger seat of a motor vehicle which is equipped with an airbag unless the function of the airbag is turned off.

Where it is found that a child in a motor vehicle is not placed in an appropriate child restraint system in accordance with subrule (1) or (3), the driver of the motor vehicle shall be guilty of an offence and shall be liable, in the case of a first conviction, to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding six months and, in the case of a second or subsequent conviction, to a fine not exceeding four thousand ringgit or to imprisonment for a term not exceeding twelve months or to both.

For the purposes of this rule, “appropriate child restraint system” means a child restraint system which is suitable to the age, weight and height of a child.

Notwithstanding subrule 4B(4), a driver of a motor vehicle shall not be guilty of an offence under subrule 4B(1)—

(a)

if it is not possible for a motor vehicle by reason of its constructions to be installed with an appropriate child restraint system;

if it is not possible for a motor vehicle by reason of the number of passengers in the motor vehicle to be installed with an appropriate child restraint system;

if the child in a motor vehicle has been certified by a registered medical practitioner to be medically unfit to be placed in a child restraint system; or

(d)

if, in the case of a public service vehicle or tourism vehicle, there is no appropriate child restraint system provided for the child by the operator or registered owner of the vehicle.”.

The principal Rules are amended by substituting for rule 5 the following rule:

Any motor vehicle which has been fitted with a seat-belt in accordance with the principal Rules before the coming into operation of these Rules shall, on the date of the coming into operation of these Rules, be deemed to have complied with the specifications specified in the Schedule to the principal Rules as amended by these Rules.

Any child restraint system which has been fitted in a motor vehicle immediately before the date of coming into operation of these Rules which does not comply with the specifications specified in the Schedule to these Rules shall, on the date of coming into operation of these Rules, be deemed to have complied with the specifications specified in the Schedule to the principal Rules as amended by these Rules.
