“Ahli Kumpulan Wang memerlukan pembiayaan bagi maksud membantunya dalam menampung komitmen kewangannya yang terjejas disebabkan oleh pandemik

Penyakit Koronavirus 2019 (COVID-19) bagi notis pengeluaran yang diberikan kepada

Lembaga sehingga 30 April 2022.

(10ZI) Jika notis pengeluaran dibuat di bawah perenggan 54(6)(n) Akta atas alasan bahawa ahli

Kumpulan

Wang memerlukan pembiayaan bagi maksud membantunya dalam menampung komitmen kewangannya yang terjejas disebabkan oleh pandemik Penyakit Koronavirus 2019

(COVID-19) bagi notis pengeluaran yang diberikan kepada Lembaga sehingga 30 April 2022, ahli

Kumpulan Wang itu hendaklah memberikan suatu notis pengeluaran kepada Lembaga mengikut apa-apa cara sebagaimana yang ditentukan oleh

Lembaga.

(10ZJ) Notis pengeluaran yang disebut dalam subkaedah (10ZI) hendaklah dikemukakan oleh ahli Kumpulan Wang kepada Lembaga pada bila-bila masa sehingga 30 April 2022.

(10ZK) Jika Lembaga berpuas hati dengan notis pengeluaran yang dikemukakan oleh ahli

Kumpulan Wang, Lembaga boleh membenarkan ahli

Kumpulan Wang itu untuk mengeluarkan suatu amaun tidak kurang daripada lima puluh ringgit dan tidak melebihi sepuluh ribu ringgit pada tarikh notis pengeluaran itu dibenarkan tertakluk kepada—

(a)

amaun yang ada pada kredit dalam Akaun II ahli Kumpulan

Wang itu digunakan sepenuhnya; dan

amaun yang ada pada kredit dalam Akaun I ahli Kumpulan

Wang itu digunakan jika terdapat apa-apa kekurangan dalam amaun yang ada pada kredit yang disebut dalam perenggan (a) bagi maksud pengeluaran itu.

Bagi maksud subkaedah

(10ZK), amaun pengeluaran hendaklah dibayar kepada ahli

Kumpulan Wang secara sekali gus.

(10ZM)

Ahli Kumpulan Wang itu hendaklah, pada tarikh pengeluaran, mempunyai amaun

yang ada pada kreditnya dalam

Akaun

I sekurang-kurangnya satu ratus ringgit.

(10ZN) Jika ahli Kumpulan Wang telah mengemukakan notis pengeluaran di bawah subkaedah

Lembaga, notis pengeluaran itu tidak boleh dibatalkan.”.

EMPLOYEES PROVIDENT FUND (AMENDMENT) RULES 2022

  1. IN exercise of the powers conferred by section 73 of the Employees Provident Fund Act 1991 [Act 452], the Board makes the following rules: Citation and commencement 1.

(1)

These rules may be cited as the Employees Provident Fund

(Amendment) Rules 2022.

These Rules have effect for the period from 15 April 2022 to 30 June 2022.

Amendment of rule 41 2.

The Employees Provident Fund Rules 1991 [P.U. (A) 493/1991] are amended in rule 41 by inserting after subrule (10ZH) the following subrules:

“Member of

Fund requires financing for purpose of assisting him in covering his financial commitment which is affected due to

Coronavirus

Disease 2019

(COVID-19)

pandemic for notice of withdrawal given to

Board until 30 April 2022.

(10ZI) Where a notice of withdrawal is made under paragraph 54(6)(n) of the Act on the ground that a member of the Fund requires financing for the purpose of assisting him in covering his financial commitment which is affected due to the Coronavirus Disease 2019 (COVID-19)

pandemic for the notice of withdrawal given to the Board until 30 April 2022, the member of the

Fund shall give a notice of withdrawal to the Board in accordance with any manner as determined by the Board.

(10ZJ) The notice of withdrawal referred to in subrule (10ZI) shall be submitted by the member of the Fund to the Board at any time until 30 April 2022.

(10ZK) Where the Board is satisfied with the notice of withdrawal submitted by the member of the Fund, the Board may authorize the member of the Fund to withdraw an amount not less than fifty ringgit and not exceeding ten thousand ringgit on the date of the notice of withdrawal is authorized subject to—

(a)

the amount standing to the credit in Account II of the member of the Fund is fully utilized; and

the amount standing to the credit in Account I of the member of the Fund is utilized if there is any deficiency in the amount standing to the credit referred to in paragraph (a)

for the purposes of the withdrawal.

(10ZL) For the purposes of subrule (10ZK), the amount of withdrawal shall be paid to the member of the Fund in lump sum.

(10ZM) The member of the Fund shall, on the date of the withdrawal, have an amount standing to his credit in Account I at least one hundred ringgit.

(10ZN) Where the member of the Fund has submitted the notice of withdrawal under subrule (10ZI) to the Board, such notice of withdrawal shall not be revoked.”.
