PADA menjalankan kuasa yang diberikan oleh seksyen 17 Akta Mahkamah Kehakiman 1964 [Akta 91] dan seksyen 4 Akta Kaedah-Kaedah Mahkamah Rendah 1955 [Akta 55], dan dengan persetujuan Hakim Besar Mahkamah Tinggi di Malaya dan Hakim Besar Mahkamah Tinggi di Sabah dan Sarawak, Jawatankuasa Kaedah-Kaedah dan Jawatankuasa Kaedah-Kaedah Mahkamah Rendah membuat kaedah-kaedah yang berikut: Nama

IN exercise of the powers conferred by section 17

of the Courts of Judicature Act 1964 [Act 91] and section 4 of the Subordinate Courts

Rules Act 1955 [Act 55], and with the consent of the Chief Judge of the High Court in

Malaya and the Chief Judge of the High Court in Sabah and Sarawak, the Rules Committee and the Subordinate Courts Rules Committee make the following rules:

Citation 1.

These rules may be cited as the Rules of Court (Amendment) 2025.

General amendment 2.

The Rules of Court 2012 [P.U. (A) 205/2012], which are referred to as the "principal Rules" in these Rules, are amended—

(a)

by substituting for the word

“Controller”

wherever appearing, except in Order 1, the word “Bank”; and

(b)

by substituting for the words “scheduled territories” wherever appearing, except in Order 1, the word “Malaysia”.

Amendment of Order 1 3.

Order 1, rule 4(1) of the principal Rules is amended—

(a)

by deleting the definition of “Controller”;

(b)

by inserting after the definition of “bailiff” the following definition:

‘ “Bank” has the meaning assigned to it in the Financial Services Act 2013

[Act 758]’;

in the definition of “moneylender’s action”, by substituting for the semicolon at the end of the paragraph a full stop; and

(d)

by deleting the definition of “scheduled territories”.

Amendment of Order 6 4.

Order 6, rule 7 of the principal Rules is amended—

in paragraph (2), by deleting the words “and in admiralty actions five times”;

and

(b)

by inserting after paragraph (5) the following paragraph:

“(6)

Paragraphs (1) and (2) shall not apply to any originating claim relating to Admiralty causes and matters.”.

Amendment of Order 57 5.

Order 57 of the principal Rules is amended—

(a)

in rule 1(2), by deleting the word “only”; and

(b)

by inserting after rule 1 the following rule:

“Transfer of proceedings to Sessions Court (O. 57, r. 1A)

1A. Notwithstanding rule 1, a Judge of the High Court may on his own motion and at the earliest possible stage of the proceedings in the High Court, order the action to be transferred to the Sessions Court if he is satisfied that based on all the circumstances including but not limited to the interests of the parties, subject matter and value of the claim, it would be just and appropriate to be heard and disposed of in the Sessions Court.”.

in rule 3, in the shoulder note, by substituting for the words

“by originating summons” the words “to Court”;

(c)

by inserting after rule 4 the following rule:

“Service of process (O. 87 r. 4A)

4A. Notwithstanding anything in these Rules, service of all applications pursuant to rule 4 may be effected on a party not residing or carrying out business in Malaysia by way of service on its registered trademark agent at the address of service of the registered trademark agent entered into the Registrar’s record or Register.”;

(d)

in rule 6, by substituting for the words “Where under subsection 25(8) or subsection 28(8) of the Act,” the words “Where under subsection 29(9) or subsection 35(11) of the Act,”;

(e)

in rule 7, by inserting after the word “infringement” the words “commenced under the Act”; and

(f)

by inserting after rule 7 the following rule:

“Counterclaim for revocation or invalidation of registered trademark (O. 87, r. 7A)

7A. A defendant in an action for infringement commenced under the Act may, in regard to any registered trademark in issue, counterclaim for the revocation or invalidation of the registered trademark and shall within the time limited for the delivery of the counterclaim serve the Registrar with the same, and the Registrar shall be entitled to take such part in the action as he may think fit without delivering a defence or other pleading.”.

Amendment of Order 88

10. Order 88 of the principal Rules is amended—

(a)

in rule 7(4)—

(i)

by substituting for the words “subsection 64(3)” the words

“subsection 116(3)”; and

(ii)

by substituting for the words “subsection 64(2)” the words

“subsection 116(2)”;

(b)

in rule 14, by substituting for the words “subsection 64(2)” wherever appearing the words “subsection 116(2)”; and

(c)

by deleting rule 17.

Amendment of Appendix A

11. Form No. 72 of the principal Rules is amended by inserting after the fifth paragraph the following paragraph:

“And I further request that where circumstances warrant it, as another means to conduct examination apart from examination to be made by way of viva voce, you permit the examination to be done by way of remote communication technology at such time and place as we may determine jointly and with the sufficient administrative and technical facilities and arrangements to be made at the place where the examination will take place.

The examination shall be recorded and that you will be further pleased to authenticate such examination by the seal of your tribunal together with a note of the charges and expenses payable in respect of the execution of this request through the Malaysian (or British) Consul from whom the same was received (or the Minister of Foreign Affairs) for transmission to the Court of

Malaya/Sabah and Sarawak at ………………………………………..”.

Amendment of Appendix B1

12. Appendix B1 to the principal Rules is amended—

(a)

in item No. 67, in column “Items”, by deleting the word “half”; and

(b)

in item No. 87, in column “Items”, by substituting for the words

“section 7 or 59” the words “section 20E of the Companies Commission of

Malaysia Act 2001 [Act 614]”.

Amendment of Appendix B2

13. Appendix B2 to the principal Rules is amended in item No. 30, in column “Items”, by deleting the word “half”.
