Court may order information to be made available to beneficiary

Section 64
(1)

In the event that a Labuan foundation does not comply with a request for information under section 62 or does not make the documents available for inspection in accordance with sections 62 and 63 within a reasonable time, the Court may, upon application by the beneficiary, order—

(a)

the provision of the information requested; and

(b)

the inspection of the documents, if appropriate, by a person professionally qualified to assess the information contained in the documents and report to the beneficiary by whom the application to the Court was made.

(2)

Any council member, supervisory person or officer of a

Labuan foundation who fails to take all reasonable steps to secure compliance by the Labuan foundation with the requirements of this section, or has by his own wilful act been the cause of non-compliance, is himself liable for the act of non-compliance and shall be committed to any order as the Court thinks fit.
