Section 42

(1)

The Authority, with the approval of the Minister, and a board, with the approval of the State Authority, may from time to time by order published in the Gazette establish a corporation by such name as may be specified in the order to carry out and have the charge, conduct and management of any project, scheme or enterprise which has been planned or undertaken by the Authority or such board in execution of its duty or discharge of its functions under this Act, and may in like manner cancel, vary or amend any such order:

Provided that the Authority shall not make any such order in, or in relation to, Sabah or Sarawak unless the concurrence of the Yang di-Pertua Negeri of Sabah or Sarawak, has first been obtained for the making of such order, and such concurrence may be granted either in respect of a particular case or generally in respect of a particular case or generally in respect of a class or classes of cases.

(2)

An order under subsection (1) shall, in addition to the matters referred to in section 43, make provision in respect of the following:

(a)

the constitution of the corporation;

(b)

the finances of the corporation;

(c)

the repayment of loans to the corporation;

(d)

the accounts to be kept by the corporation and the audit of the accounts.
