Recovery of fares, freight, special charges, etc.
of Land Public Transport Act 2010
When any person is convicted before a court of criminal jurisdiction for an offence under this Act, the court may, in addition to imposing any penalty under this Act, fix or assess the amount of any fares, freight, special charges, surcharges, damages, expenses or other sums of money whatsoever which may have become payable by such person to a licensee, licensed operator, terminal licensee or an intermediation business licensee, and order such amount to be paid by such person to the licensee, licensed operator, terminal licensee or intermediation business licensee.
(2)
Nothing in subsection (1) shall prevent the recovery of any fares, freight, special charges, surcharges, damages, expenses or other sums of money whatsoever which may have become payable by any person to a licensee, licensed operator, terminal licensee or an intermediation business licensee by way of a civil claim before a court of civil jurisdiction.
