Section 38
Replacement title protected from adverse possession
of National Land Code (Penang and Malacca Titles) Act 1963
On and after the appointed day no title or interest adverse to or in derogation of the replacement title or any replacement interest vested in the proprietor of any holding or in any other person pursuant to this Chapter shall be acquired by any length of possession by virtue of the Limitation Act 1953 [Act 254], or otherwise, nor shall such replacement title or replacement interest be extinguished by the operation of that Act.
(2)
Nothing in this section shall affect—
(a)
the right of any person to make any claim (whether by virtue of adverse possession or otherwise) under section 53, or the due investigation and disposal of such claim;
(b)
the powers of the Court, the Board or the Director to make any decision or order under this Act; or
(c)
the exercise of any powers conferred by the National
Land Code.
