(1)

The Court may order any offender so convicted to be detained and kept in safe custody until return can be made to the warrant of distress, unless he gives security by way of recognizance or otherwise for his appearance before the Court on the day appointed for the return.

(2)

If it appears to the Court, by the admission of the offender or otherwise, that no sufficient distress can be had within the jurisdiction of the Court whereon to levy the fine, forfeiture, damages and costs, the Court shall commit the offender to prison for any term not exceeding six months unless the fine, forfeiture, damages and costs are sooner paid and satisfied.
