Part V · Acquisition and Disposition by the Corporation

15. Preservation of rights

(1)

A person who is precluded from making a claim against the

Corporation or is precluded from raising a defence against the

Corporation under section 14, shall be entitled to seek compensation against the seller in respect of such claim.

(2)

Where the Court is satisfied that the person referred to in subsection (1) has a claim against the seller including any prior equitable interest in the asset which that person could have raised or claimed but is precluded by section 14, that person shall be entitled to such compensation from the seller in respect of such claim as the

Court considers fair and reasonable.
