Peraturan-Peraturan Bekalan Pemegang Lesen 1990 [P.U. (A) 384/1990], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dengan menggantikan peraturan 2 dengan peraturan yang berikut:

Suatu permintaan oleh pemunya atau penduduk mana-mana premis atau mana-mana orang yang diberi kuasa oleh pemunya atau penduduk bagi pembekalan elektrik kepada premis itu mengikut subseksyen 24(2)

Akta hendaklah disertakan dengan apa-apa maklumat atau dokumen sebagaimana yang dikehendaki oleh pemegang lesen bagi maksud itu.

Maklumat atau dokumen tidak benar, tidak tepat, dsb.

Dalam hal keadaan jika pembekalan elektrik telah diberikan oleh pemegang lesen dan jika pemegang lesen mendapati, pada bila-bila masa selepas itu, maklumat atau dokumen yang dikemukakan oleh pemunya atau penduduk premis atau mana-mana orang yang diberi kuasa oleh pemunya atau penduduk bagi pembekalan elektrik kepada premis itu di bawah subperaturan 2A adalah tidak benar, tidak tepat atau

tidak lengkap, pemegang lesen boleh memberhentikan pembekalan itu.

Apabila diminta oleh pengguna, pemegang lesen hendaklah bertanggungjawab untuk menjadikan tersedia kepada pengguna apa-apa maklumat yang berhubungan dengan pembekalan voltan bagi beban penyambungan berlainan atau apa-apa penyambungan baharu.”.

hendaklah dibayar oleh pengguna dalam tempoh tiga puluh hari dari tarikh pengemukaannya kepada pengguna.”;

Sekiranya berlaku keingkaran pembayaran oleh pengguna bagi jumlah yang kena dibayar kepada pemegang lesen apabila habisnya tempoh yang dinyatakan dalam perenggan (1)(b)—

pemegang lesen hendaklah memberhentikan pembekalan elektrik di premis pengguna—

dengan mengeluarkan suatu notis kepada pengguna mengenai niat untuk memberhentikan pembekalan elektrik di premis pengguna itu;

(ii)

notis itu hendaklah dikeluarkan tidak lewat daripada empat belas hari dari habisnya tempoh yang dinyatakan dalam perenggan (1)(b);

notis itu hendaklah menyatakan alasan bagi pemberhentian pembekalan elektrik di premis pengguna itu dan tarikh yang dicadangkan bagi pemberhentian itu, yang hendaklah tidak boleh lebih awal daripada tujuh hari bekerja dari tarikh notis itu dikeluarkan; dan

notis itu hendaklah disampaikan mengikut subperaturan (2A); dan

(b)

pemegang lesen hendaklah menuntut daripada pengguna sehingga enam bulan jumlah yang belum berbayar yang kena dibayar kepada pemegang lesen.”;

dengan memasukkan selepas subperaturan (2) subperaturan yang berikut:

Pemegang lesen hendaklah menyampaikan notis yang dikeluarkan di bawah subperaturan (2) mengikut cara yang berikut:

dengan memberikan notis itu dengan sendiri kepada pengguna;

(ii)

dengan memberikan notis itu dengan sendiri kepada mana-mana anggota keluarga pengguna yang dewasa atau

mana-mana pekhidmat pengguna yang menetap dengannya, di tempat kediamannya yang biasa atau yang akhir sekali diketahui;

dengan menghantar notis itu melalui pos berdaftar kepada pengguna di tempat kediamannya yang biasa atau yang akhir sekali diketahui;

dengan mengepilkan notis itu kepada bil bagi bulan yang berikutnya yang dihantar ke alamat pengguna sebagaimana yang dinyatakan dalam bil; atau

dengan menghantar notis itu kepada alamat mel elektronik pengguna; atau

(b)

jika pengguna itu ialah suatu syarikat, suatu perkongsian liabiliti terhad, suatu firma, suatu pertubuhan, persatuan atau kumpulan orang lain:

dengan memberikan notis itu kepada setiausaha atau pegawai lain bagi syarikat, perkongsian liabiliti terhad, firma, pertubuhan, persatuan atau kumpulan orang lain, di pejabat berdaftar atau tempat perniagaan utama syarikat, perkongsian liabiliti terhad, firma, pertubuhan, persatuan atau kumpulan orang lain itu;

dengan menghantar notis itu melalui pos berdaftar kepada syarikat, perkongsian liabiliti terhad, firma, pertubuhan, persatuan atau kumpulan orang lain, di pejabat berdaftar atau tempat perniagaan utama syarikat, perkongsian liabiliti terhad, firma, pertubuhan, persatuan atau kumpulan orang lain itu;

dengan mengepilkan notis itu kepada bil bagi bulan yang berikutnya yang dihantar ke alamat syarikat, perkongsian liabiliti terhad, firma, pertubuhan, persatuan atau kumpulan orang lain itu sebagaimana yang dinyatakan dalam bil; atau

(iv)

dengan menghantar notis itu ke alamat mel elektronik syarikat, perkongsian liabiliti terhad, firma, pertubuhan, persatuan atau kumpulan orang lain.

Apa-apa pemberhentian pembekalan elektrik di suatu premis pengguna di bawah subperaturan (2) tidak boleh dijalankan oleh pemegang lesen pada hari kelepasan mingguan atau kelepasan am.”;

(e)

dalam subperaturan (3), dengan menggantikan perkataan “di pejabat sebagaimana yang dinyatakan pada bil, yang telah diberikuasa oleh pemegang lesen untuk menerima wang itu” dengan perkataan

Bagi maksud mengeluarkan bil di bawah peraturan ini, sekiranya dalam keadaan yang mustahil bagi pemegang lesen untuk membaca meter disebabkan hal keadaan yang berikut:

pemunya premis atau ejennya tidak memberi kebenaran masuk;

jika cermin gelas tidak bersih, tidak jelas atau kabur disebabkan perbuatan pengguna;

(f)

hal keadaan adalah di luar kawalan pemegang lesen seperti bencana semula jadi, laluan ke premis dihalang disebabkan rusuhan, kekecohan atau mogok; atau

(g)

apa-apa hal keadaan lain yang membahayakan keselamatan pemegang lesen, pemegang lesen hendaklah mengeluarkan suatu bil kepada pengguna yang menyatakan anggaran jumlah yang kena dibayar kepada pemegang lesen berdasarkan rekod penggunahabisan pengguna dan sejarah bagi tiga bulan terdahulu berturut-turut dan membuat pelarasan yang perlu kepada akaun pengguna apabila bacaan meter yang sebenar diperoleh:

Dengan syarat bahawa, pemegang lesen hendaklah mengambil segala langkah yang munasabah untuk membaca meter apabila berdepan dengan hal keadaan sebagaimana yang dinyatakan.”;

“(4A)

Jika suatu bacaan meter di bawah subperaturan (4)

jatuh pada hari kelepasan am, pemegang lesen hendaklah membaca meter pada hari bekerja yang berikutnya dan hendaklah mengira bacaan meter bagi hari kelepasan am itu sebagai sebahagian daripada bil yang dikeluarkan bagi bulan itu.”; dan

dengan memasukkan selepas subperaturan (6) subperaturan yang berikut:

“(7)

Pemegang lesen boleh mengguna pakai pengiraan sama rata kepada suatu bil yang dikeluarkan di bawah peraturan ini dalam hal keadaan seperti yang berikut:

sekiranya tempoh pengebilan dikira mengikut subperaturan (4A), jumlah kilowatt jam pada setiap blok tarif hendaklah disamaratakan dengan mendarabkan bilangan hari yang dimasukkan dalam tempoh pengebilan itu dan dibahagikan dengan jumlah keseluruhan hari dalam purata sebulan yang akan dikira sebagai tiga puluh hari;

atau

sekiranya meter tidak boleh dibaca disebabkan hal keadaan yang dinyatakan dalam subperaturan (4), jumlah jam kilowatt pada setiap blok tarif hendaklah disamaratakan dengan mendarab bilangan hari yang dimasukkkan dalam bil dengan anggaran jumlah yang kena dibayar dan bil bagi

bulan yang meter boleh dibaca, dan dibahagikan dengan jumlah keseluruhan hari dalam purata sebulan yang akan dikira sebagai tiga puluh hari.

Peraturan ini tidak terpakai bagi apa-apa pembekalan elektrik yang menggunakan meter prabayar.”.

(1)

Apabila suatu meter prabayar dipasang di premis pengguna, pemegang lesen hendaklah memastikan bahawa meter prabayar itu dapat memberi amaran kepada pengguna apabila baki prabayar telah mencapai suatu ambang minimum.

Melainkan jika pengguna membuat pembayaran kepada pemegang lesen untuk meneruskan bekalan elektrik, pemegang lesen boleh memberhentikan bekalan elektrik di premis pengguna selepas unit atau kredit yang dibeli telah digunakan sepenuhnya dan unit atau kredit kecemasan yang dibenarkan telah dihabiskan tanpa apa-apa notis lanjut.

Pemegang lesen hendaklah mengenakan caj kepada pengguna bagi bekalan elektrik selepas hari yang unit atau kredit yang dibeli itu telah digunakan sepenuhnya sehingga bekalan elektrik itu diberhentikan.

Caj yang disebut dalam subperaturan (3)

hendaklah dimasukkan kepada unit atau kredit yang dibeli oleh pengguna semasa penyambungan semula bekalan elektrik.

Dalam hal meter pintar atau meter yang dipasang dengan fungsi telepemeteran, pemegang lesen hendaklah—

(a)

memastikan bahawa tiada perubahan dibuat kepada metrologi meter pintar atau meter yang dipasang dengan fungsi telepemeteran melalui sistem komunikasi;

bertanggungjawab untuk menjaga integriti bagi semua data yang disampaikan dan disimpan ke pusat data dalam sistem;

memastikan bahawa paparan daftar pada meter pintar atau meter yang dipasang dengan fungsi telepemeteran membolehkan pengguna mengesahkan penggunahabisan elektriknya;

  1. IN exercise of the powers conferred by section 53 of the Electricity Supply Act 1990 [Act 447], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Licensee Supply (Amendment)

Regulations 2025.

These Regulations come into operation on 1 October 2025.

Substitution of regulation 2 2.

The Licensee Supply Regulations 1990 [P.U. (A) 384/1990], which are referred to as the “principal Regulations” in these Regulations, are amended by substituting for regulation 2 the following regulation:

A request by an owner or occupier of any premises or any person authorized by the owner or occupier for a supply of electricity to such premises in accordance with subsection 24(2) of the Act shall be accompanied with any information or document as may be required by the licensee for that purposes.

In the case where the supply of electricity has been given by the licensee and if it appears to the licensee, at any time after that, the information or documents submitted by the owner or occupier of the premises or any person authorized by the owner or occupier for a supply of electricity to such premises under regulation 2A is not true, inaccurate or incomplete, the licensee may discontinue such supply.

“electricicity” the word “electricity”; and

Amendment of regulation 4 5.

Regulation 4 of the principal Regulations is amended─

Bills in respect of amounts due to the licensee—

shall be rendered by the licensee to the consumer monthly, based on the consumer’s consumption of electricity for a period of not less than twenty-eight days and not more than thirty-one days; and

“(1A) Other than the amounts due to the licensee under subregulation (1), the bill may contain any tariffs and charges determined by the Commission in accordance with subsection 26(1)

of the Act .”;

In the event of default of payment by the consumer of the amounts due to the licensee at the expiry of the period specified in paragraph (1)(b)—

the licensee shall discontinue the supply of electricity at the consumer's premises—

by issuing a notice to the consumer on the intention to discontinue the supply of electricity at the consumer’s premises;

(ii)

such notice shall be issued not later than fourteen days from the expiry of the period specified in paragraph (1)(b);

such notice shall state the reasons for the discontinuation of supply of electricity at the consumer’s premises and the proposed date for such discontinuation, which shall not be earlier than seven working days from the date such notice is issued; and

such notice shall be served in accordance with subregulation (2A); and

(b)

the licensee shall claim from the consumer up to six months of unpaid amounts due to the licensee.”.

The licensee shall serve the notice issued under subregulation (2) in the following manner:

by giving the notice personally to the consumer;

(ii)

by giving the notice personally to any adult member of the consumer’s family or any of the consumer’s servants residing with him, at his usual or last known place of residence;

by sending the notice by registered post to the consumer at his usual or last known place of residence;

(iv)

by attaching the notice to the bill for the following month that is sent to the address of the consumer as stated on the bill; or

by sending the notice to the electronic mail address of the consumer; or

if the consumer is a company, a limited liability partnership, a firm, a society, an association or other body of persons:

by giving the notice to the secretary or other officer of the company, limited liability partnership, firm, society, association or other body of persons, at its registered office or principal place of business;

(ii)

by sending the notice by registered post to the company, limited liability partnership, firm, society, association or other body of persons, at its registered office or principal place of business;

(iii)

by attaching the notice to the bill for the following month that is sent to the address of the company, limited liability partnership, firm, society, association or other body of persons as stated on the bill; or

(iv)

by sending the notice to the electronic mail address of the company, limited liability partnership, firm, society, association or other body of persons.

Any discontinuation of supply of electricity at a consumer’s premises under subregulation (2) shall not be carried out by a licensee on a weekly holiday or public holiday.”;

(e)

the circumstances are beyond the licensee’s control such as natural disaster, passage to the premise is blocked due to riot, commotion or strike; or

any other circumstances that would endanger the safety of licensee, the licensee shall issue a bill to the consumer stating the estimated amounts due to the licensee based upon the consumer’s consumption record and history for the previous three month consecutively and

make the necessary adjustment to the consumer’s account when the actual meter reading is obtained:

Provided that, the licensee shall take all reasonable measures to read the meter when facing the circumstances as specified.”;

If a meter reading under subregulation (4) falls on a public holiday, the licensee shall read the meter on the next working day and shall calculate the meter reading for that public holiday to be part of the bill issued for that month.”; and

The licensee may apply a pro rate calculation to a bill issued under this regulation in the following circumstances:

in the event the billing period is calculated in accordance with subregulation (4A), the number of kilowatt hours in each of the tariff block shall be prorated by multiplying with the number of days included in the billing period and divided by the total days in an average month which will be taken as thirty days; or

in the event that the meter cannot be read due to the circumstances specified in subregulation (4), the number of kilowatt hours in each of the tariff block shall be prorated by multiplying with the number of days included in the bill with estimated amounts due and the bill for the month when the meter can be read, and divided by the total days in

an average month which will be taken as thirty days.

(8)

This regulation shall not apply to any supply of electricity using a prepaid meter.”.

Amendment of regulation 5 6.

Regulation 5 of the principal Regulations is amended─

If a consumer has been undercharged or overcharged under subregulation (2), the licensee shall inform the consumer by serving a written notice immediately upon the discovery of such undercharge or overcharge situation.

in the case of an undercharged situation, the retrospective adjustments shall be made commencing from the date the notice referred to in subregulation (2A) is served to the consumer, for a period up to three months retrospectively; and

in the case of an overcharged situation, the retrospective adjustments shall be made commencing from the date the overcharge situation occurred.

(2C)

The Commission may not allow any retrospective adjustment where—

(a)

the undercharged situation was due to the negligence or wrongdoing of the licensee; or

(2D)

Any retrospective adjustment made under subregulation (2) shall not be included in the bill issued to the consumer.”;

Unless the consumer makes a payment to the licensee to continue the supply of electricity, the licensee may discontinue the supply of electricity at the consumer’s premises after the purchased unit or credit has been fully utilized and the allowable emergency unit or credit has been exhausted without any further notice.

The licensee shall charge the consumer for the supply of electricity after the day the purchased unit or credit has been fully utilized until the supply of electricity is discontinued.

The charge referred to in subregulation (3)

shall be included to the unit or credit purchased by the consumer during reconnection of the supply of electricity.

In the case of a smart meter or a meter installed with telemetering functions, the licensee shall—

(a)

ensure that no changes are made to the metrology of the smart meter or meter installed with telemetering functions via the communications system;

be responsible for maintaining the integrity of all data that are communicated and stored to the data centre within the system;
