Menteri hendaklah, selepas menimbangkan alasan rayuan yang dinyatakan oleh perayu di bawah subperaturan 2(2), memutuskan rayuan tersebut.

Keputusan Menteri atas rayuan itu hendaklah disampaikan kepada perayu oleh Pendaftar melalui suatu notis bertulis dalam tempoh empat belas hari dari tarikh

Pendaftar diberitahu tentang keputusan sedemikian.

FRANCHISE ACT 1998

FRANCHISE (MANNER OF APPEAL) REGULATIONS 2022

IN exercise of the powers conferred by section 60

of the

Franchise Act 1998 [Act 590], read together with section 17 of the Act, the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Franchise (Manner of Appeal)

Regulations 2022.

(2)

These Regulations come into operation on 28 April 2022.

Manner of Appeal 2.

(1)

A person who is aggrieved by any decision of the Registrar made under

Part II of the Act may appeal to the Minister within stipulated period given in section 17

of the Act by serving a notice of appeal as specified in the Schedule.

(2)

A notice of appeal under subregulation (1) shall state the grounds of appeal stating the substance of the decision of the Registrar appeal against.

Decision of Minister on appeal 3.

(1)

The Minister shall, after considering the grounds of appeal stated by the appellant under subregulation 2(2), decide on the appeal.

(2)

The decision of the Minister on the appeal shall be communicated to the appellant by the Registrar through a written notice within fourteen days from the date the Registrar is notified of such decision.
