MALAYSIAN BIOFUEL INDUSTRY
(SOURCE OF PRODUCTION, BLEND AND PERMITTED ACTIVITIES) REGULATIONS 2022
IN exercise of the powers conferred by paragraph 55(2)(a)
of the Malaysian Biofuel Industry Act 2007 [Act 666], read together with paragraphs 4(a) and (b) of the Act, the Minister, after consultation with the licensing authority, makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Malaysian Biofuel Industry
(Source of Production, Blend and Permitted Activities) Regulations 2022.
(2)
These Regulations come into operation on 16 November 2022.
Requirement of source of production of biofuel 2.
(1)
Any licensee who is granted a licence to produce any biofuel specified in column (1) of the First Schedule for any activity specified in column (2) shall produce the biofuel from—
(a)
crude palm oil resource; or
(b)
refined, bleached and deodorized palm oil resource.
(2)
Any licensee who fails to comply with subregulation (1) commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred and fifty thousand ringgit or to imprisonment for a term not exceeding two years or both.

Requirement of blending biofuel with any fuel 3.
(1)
Any licensee who is granted a licence to blend any biofuel with any fuel specified in column (1) of the Second Schedule shall ensure that the blend—
(a)
contains the biofuel in column (2) according to the percentage of the biofuel in column (3); and
(b)
contains the fuel in column (4).
(2)
Any licensee who fails to comply with subregulation (1) commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred and fifty thousand ringgit or to imprisonment for a term not exceeding two years or both.
Permitted activities for blend of biofuel with fuel 4.
(1)
Any licensee who is granted a licence to blend any biofuel with any fuel specified in column (1) of the Second Schedule shall use the blend for any activity specified in column (5).
(2)
Any licensee who fails to comply with subregulation (1) commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred and fifty thousand ringgit or to imprisonment for a term not exceeding two years or both.
Revocation 5.
The Malaysian Biofuel Industry (Blending Percentage and Mandatory Use)
Regulations 2019 [P.U. (A) 27/2019] are revoked.
