Seksyen 2

Dalam Peraturan-Peraturan ini—

“anjakan ambang standard” ertinya anjakan purata 10dB atau lebih pada frekuensi 2000, 3000 dan 4000 Hz berbanding dengan audiogram garis pangkal;

“audiogram yang abnormal” ertinya audiogram yang menunjukkan kehilangan pendengaran, kecacatan pendengaran atau anjakan ambang standard kekal;

“bising berlebihan” ertinya paras pendedahan bising harian melebihi 82dB(A), dos bising diri harian melebihi lima puluh peratus, paras tekanan bunyi maksimum melebihi 115dB(A) pada bila-bila masa, atau paras tekanan bunyi puncak 140dB(C);

“dB(A)” ertinya pemberat-A desibel iaitu unit pengukuran paras tekanan bunyi yang dibetulkan pada skala frekuensi pemberat-A melalui rangkaian elektrik yang mempunyai ciri-ciri yang ditentukan oleh Suruhanjaya Elektroteknik Antarabangsa dengan menggunakan rujukan paras tekanan bunyi 20 mikropaskal;

“dB(C)” ertinya pemberat-C desibel iaitu unit pengukuran paras tekanan bunyi yang dibetulkan pada skala frekuensi pemberat-C melalui rangkaian elektrik yang mempunyai ciri-ciri yang ditentukan oleh Suruhanjaya Elektroteknik Antarabangsa dengan menggunakan rujukan paras tekanan bunyi 20 mikropaskal;

“dos bising diri harian” ertinya pendedahan bising kumulatif bagi seorang pekerja yang dibetulkan bagi hari kerja biasa selama lapan jam;

“kecacatan pendengaran” ertinya purata aritmetik paras ambang pendengaran kekal bagi seorang pekerja pada 500, 1000, 2000 dan 3000 Hz yang teranjak sebanyak 25dB atau lebih berbanding dengan paras rujukan audiometrik standard;

“kehilangan pendengaran disebabkan bising” ertinya kehilangan pendengaran akibat daripada pendedahan kepada bising;

“paras pendedahan bising harian” ertinya paras tekanan bunyi berterusan setara yang dibetulkan bagi hari kerja biasa selama lapan jam;

“paras tekanan bunyi puncak” ertinya paras tekanan bunyi seketika pemberat-C tertinggi bagi apa-apa hentakan;

“paras tekanan bunyi”

ertinya paras, dalam desibel, dikira sebagai dua puluh kali logaritma biasa bagi nisbah tekanan bunyi dengan tekanan bunyi rujukan 20 mikropaskal;

“pendedahan bising” ertinya amaun tekanan bunyi yang terdedah pada telinga seseorang yang tidak dilindungi;

“pelindung pendengaran diri” ertinya peranti yang dipakai oleh seseorang untuk mencegah kesan pendengaran yang tidak dikehendaki daripada acoustic stimuli;

“Suruhanjaya Elektroteknik Antarabangsa” ertinya Suruhanjaya Elektroteknik

Antarabangsa yang menyediakan dan menyiarkan Standard Antarabangsa bagi semua elektrik, elektronik dan teknologi yang berkaitan.

Seksyen 3

Pengenalpastian bising berlebihan

Tiap-tiap majikan hendaklah mengenal pasti sama ada pekerjanya mungkin terdedah kepada bising berlebihan di tempat kerja mengikut cara sebagaimana yang ditentukan oleh Ketua Pengarah.

Majikan hendaklah mengenal pasti semula sama ada pekerjanya mungkin terdedah kepada bising berlebihan di tempat kerja di bawah subperaturan (1)—

(a)

jika terdapat perubahan pada jentera, kelengkapan, proses, kerja, langkah-langkah kawalan atau operasi di tempat kerja yang boleh mendedahkan pekerjanya kepada bising berlebihan;

tidak lebih daripada satu tahun selepas tarikh pengenalpastian terdahulu; atau

Suggest a correction

(c)

jika diarahkan untuk berbuat sedemikian oleh Ketua Pengarah.

Mana-mana majikan yang melanggar subperaturan (1) atau (2) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.

Penaksiran risiko bising

Jika majikan mendapati, apabila pengenalpastian dibuat di bawah subperaturan 3(1), bahawa mana-mana pekerjanya mungkin terdedah kepada bising berlebihan, majikan hendaklah melantik penaksir risiko bising untuk menjalankan penaksiran risiko bising.

Penaksir risiko bising yang dilantik oleh majikan di bawah subperaturan (1)

hendaklah—

P.U. (A) 60 5

(a)

berdaftar dengan Ketua Pengarah mengikut cara sebagaimana yang ditentukan oleh Ketua Pengarah; dan

(b)

memiliki perakuan sah yang dikeluarkan oleh Ketua Pengarah untuk menjalankan penaksiran risiko bising.

Penaksir risiko bising hendaklah menjalankan penaksiran risiko bising yang disebut dalam subperaturan

dengan menggunakan kelengkapan mengukur bising yang mematuhi standard yang ditentukan oleh Suruhanjaya

Elektroteknik Antarabangsa.

Apabila selesai penaksiran risiko bising yang disebut dalam subperaturan (1), penaksir risiko bising hendaklah menyediakan laporan dan mengemukakan laporan itu kepada majikan dalam masa satu bulan dari tarikh penaksiran itu selesai.

Laporan yang disebut dalam subperaturan (4) hendaklah termasuk dapatan, dan syor yang dibuat oleh, penaksir risiko bising berkenaan dengan penaksiran risiko bising yang telah dijalankan.

Apabila laporan di bawah subperaturan (4) diterima, majikan hendaklah memberitahu pekerja yang terdedah kepada bising berlebihan mengenai dapatan dan syor yang dibuat di bawah subperaturan (5) dalam masa empat belas hari selepas menerima laporan itu daripada penaksir risiko bising.

Jika laporan yang disediakan di bawah subperaturan (4) mengandungi syor bagi apa-apa tindakan hendaklah diambil menurut Peraturan-Peraturan ini, majikan hendaklah menjalankan syor itu dalam masa tiga puluh hari selepas menerima laporan itu daripada penaksir risiko bising.

Majikan hendaklah menyebabkan penaksiran risiko bising yang disebut dalam subperaturan (1) dikaji semula—

(a)

tidak lebih daripada lima tahun dari tarikh penaksiran risiko bising terdahulu; atau

jika diarahkan untuk berbuat sedemikian oleh Ketua Pengarah.

Mana-mana orang yang melanggar subperaturan (1), (2), (3), (4), (5), (6), (7)

atau (8) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.

Maklumat, arahan, latihan dan penyeliaan

Jika majikan mendapati bahawa mana-mana pekerjanya terdedah kepada bising berlebihan berdasarkan laporan yang disebut dalam subperaturan 4(4), majikan itu hendaklah—

(a)

memberikan maklumat yang mencukupi yang berhubungan dengan kesan pendedahan bising ke atas pendengaran seseorang dan kehendak untuk menjalani ujian audiometrik kepada pekerja-pekerja itu;

memberikan latihan dan arahan mengenai penggunaan yang wajar bagi pelindung pendengaran diri kepada pekerja-pekerja itu; dan

(c)

menyelia pelaksanaan kawalan pendedahan bising di tempat kerja.

Majikan hendaklah memberikan latihan bagi pekerjanya yang disebut dalam subperaturan (1) sekurang-kurangnya sekali setahun.

Mana-mana majikan yang melanggar subperaturan (1) atau (2) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.

Had pendedahan bising

Tiap-tiap majikan hendaklah memastikan bahawa tiada pekerjanya terdedah kepada—

(a)

paras pendedahan bising harian melebihi 85dB(A) atau dos bising diri harian melebihi seratus peratus;

paras tekanan bunyi maksimum melebihi 115dB(A) pada bila-bila masa; atau

Suggest a correction

Jika majikan mendapati bahawa mana-mana pekerjanya terdedah kepada bising berlebihan melebihi had yang dinyatakan dalam subperaturan (1) berdasarkan laporan yang disebut dalam subperaturan 4(4), majikan hendaklah mengambil apa-apa langkah untuk mengurangkan bising berlebihan itu.

Majikan hendaklah, sebelum mengambil langkah-langkah di bawah subperaturan (2), membuat penilaian sama ada adalah praktik untuk mengurangkan bising berlebihan itu dengan cara kawalan kejuruteraan atau kawalan pentadbiran.

Jika setelah penilaian yang dibuat di bawah subperaturan (3) itu selesai majikan mendapati bahawa—

(a)

adalah praktik untuk mengurangkan bising berlebihan itu dengan kawalan kejuruteraan, majikan itu hendaklah mengurangkan bising berlebihan itu dengan kawalan kejuruteraan itu;

adalah tidak praktik untuk mengurangkan bising berlebihan itu dengan kawalan kejuruteraan semata-mata, majikan itu hendaklah mengurangkan bising berlebihan itu dengan kawalan kejuruteraan bersama dengan kawalan pentadbiran;

adalah tidak praktik untuk mengurangkan bising berlebihan itu dengan kawalan kejuruteraan bersama dengan kawalan pentadbiran, majikan itu hendaklah mengurangkan bising berlebihan itu dengan kawalan pentadbiran semata-mata; dan

(d)

adalah tidak praktik untuk mengurangkan bising berlebihan itu dengan kawalan pentadbiran, majikan itu hendaklah mengambil langkah-langkah lain yang berkesan, yang hendaklah termasuk pelindung pendengaran diri, untuk mengurangkan bising berlebihan itu.

Majikan hendaklah membuat laporan mengenai penilaian itu, dan hendaklah, apabila diminta secara bertulis oleh Ketua Pengarah, memberikan Ketua Pengarah sesalinan laporan itu dalam masa tiga puluh hari selepas permintaan itu diterima.

Jika majikan mengurangkan bising berlebihan itu dengan kawalan kejuruteraan yang dinyatakan dalam perenggan (4)(a) dan (b), majikan hendaklah memastikan bahawa kawalan kejuruteraan itu disenggara dalam keadaan efisien dan boleh digunakan.

Mana-mana majikan yang melanggar subperaturan (1), (2), (3), (4), (5) atau

Pelindung pendengaran diri

Jika majikan menyediakan pelindung pendengaran diri kepada seorang pekerja untuk mengurangkan bising berlebihan, majikan itu hendaklah memastikan bahawa pelindung pendengaran diri itu—

(b)

diperiksa dengan sewajarnya, disenggara dan dijadikan tersedia pada setiap masa;

akan secara munasabahnya mengurangkan pendedahan bising diri pekerja itu di bawah had yang dinyatakan dalam perenggan 6(1)(a), (b)

atau (c) apabila pelindung pendengaran diri itu dipakai dengan sewajarnya; dan

Mana-mana majikan yang melanggar subperaturan (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.

Zon perlindungan pendengaran

Majikan hendaklah memastikan bahawa mana-mana kawasan di tempat kerja di mana seseorang terdedah kepada bising berlebihan melebihi had yang dinyatakan dalam perenggan 6(1)(a), (b) atau (c)—

(a)

ditandakan dengan perkataan “ZON PERLINDUNGAN PENDENGARAN”

atau dengan apa-apa cara yang lain sebagaimana yang ditentukan oleh

Ketua Pengarah; dan

(b)

setakat yang boleh dilaksanakan, ditandakan dan dikenal pasti dengan tanda amaran yang sesuai.

Majikan hendaklah—

(a)

menyediakan pelindung pendengaran diri di mana-mana zon perlindungan pendengaran; dan

memastikan bahawa mana-mana pekerja atau orang lain menggunakan pelindung pendengaran diri yang disediakan di bawah perenggan (a)

semasa berada di zon perlindungan pendengaran.

Ujian audiometrik

Jika laporan penaksiran risiko bising yang disebut dalam subperaturan 4(4)

menunjukkan bahawa mana-mana pekerja terdedah kepada bising berlebihan melebihi had yang dinyatakan dalam perenggan 6(1)(a), (b) atau (c), majikan hendaklah menyebabkan ujian audiometrik dijalankan ke atas pekerja itu setiap tahun.

Bagi maksud menjalankan ujian audiometrik di bawah subperaturan (1), majikan hendaklah melantik pusat ujian audiometrik yang diluluskan oleh

Ketua Pengarah.

Pusat ujian audiometrik itu hendaklah melantik doktor kesihatan pekerjaan untuk mentafsirkan audiogram pekerja berdasarkan ujian audiometrik yang telah dijalankan ke atas pekerja itu.

Jika doktor kesihatan pekerjaan itu menentukan mana-mana pekerja mempunyai audiogram yang abnormal, doktor kesihatan pekerjaan itu hendaklah menjalankan pemeriksaan perubatan ke atas pekerja itu.

Pemeriksaan perubatan yang disebut dalam subperaturan (4) hendaklah termasuk mendapatkan sejarah perubatan, pemeriksaan fizikal dan siasatan berkaitan yang lain untuk mendiagnosis atau mengetepikan apa-apa gangguan pendengaran pekerjaan atau bukan pekerjaan.

Jika doktor kesihatan pekerjaan telah memeriksa pekerja itu di bawah subperaturan (4) dan berpendapat bahawa pekerja itu mempunyai kehilangan pendengaran disebabkan bising pekerjaan, kecacatan pendengaran pekerjaan atau anjakan ambang standard kekal pekerjaan, doktor kesihatan pekerjaan itu hendaklah memberitahu Ketua Pengarah dalam masa tujuh hari selepas pemeriksaan perubatan itu.

Pusat ujian audiometrik itu hendaklah mengemukakan laporan ujian audiometrik kepada majikan itu dalam masa tiga puluh hari dari tarikh ujian audiometrik dijalankan.

Apabila laporan di bawah subperaturan (7) diterima, majikan itu hendaklah memberitahu keputusan ujian audiometrik itu kepada pekerja dalam masa dua puluh satu hari selepas menerima laporan itu.

Jika laporan ujian audiometrik itu menunjukkan bahawa mana-mana pekerja mempunyai anjakan ambang standard sementara, majikan itu hendaklah—

(a)

menyebabkan ujian semula dijalankan oleh pusat ujian audiometrik ke atas pekerja itu dalam masa tiga bulan selepas ujian audiometrik terdahulu dijalankan; dan

(b)

mengambil apa-apa langkah untuk melindungi pendengaran pekerja itu daripada menjadi lebih teruk.

Jika laporan ujian audiometrik itu menunjukkan bahawa mana-mana pekerja mempunyai kehilangan pendengaran disebabkan bising pekerjaan, kecacatan pendengaran pekerjaan atau anjakan ambang standard kekal pekerjaan, majikan itu hendaklah—

(a)

memberitahu Pengarah pejabat Jabatan Keselamatan dan Kesihatan

Pekerjaan yang terhampir dalam masa tujuh hari selepas menerima laporan di bawah subperaturan (7);

memberikan pelindung pendengaran diri kepada pekerja itu jika tiada pelindung pendengaran diri diberikan kepada pekerja itu sebelum ini;

dan

Bagi maksud peraturan ini, “doktor kesihatan pekerjaan” ertinya pengamal perubatan yang berdaftar dengan Ketua Pengarah untuk mengendalikan program pengawasan perubatan pekerja.

Kewajipan majikan apabila ujian audiometrik dijalankan

Bagi maksud ujian audiometrik di bawah peraturan 9, majikan hendaklah—

(a)

memastikan bahawa ujian audiometrik itu dijalankan tanpa kos kepada pekerja;

memastikan bahawa ujian audiometrik dijalankan dalam masa tiga bulan selepas pekerja itu mula bekerja di mana-mana kawasan tempat kerja yang terdedah kepada bising melebihi had yang dinyatakan dalam perenggan 6(1)(a), (b) atau (c); dan

memastikan bahawa ujian audiometrik dijalankan selepas pekerja itu diletakkan dalam keadaan senyap selama sekurang-kurangnya empat belas jam tanpa bantuan pelindung pendengaran diri.

Bagi maksud perenggan (1)(c), “senyap” ertinya tiada pendedahan kepada paras tekanan bunyi melebihi 80dB(A).

Rekod hendaklah disimpan

Majikan hendaklah menyimpan dan menyenggara rekod yang mengandungi yang berikut:

(a)

laporan penaksiran risiko bising yang disebut dalam subperaturan 4(4)

selama tempoh tidak kurang daripada tiga puluh tahun; dan

(b)

laporan ujian audiometrik pekerjanya yang disebut dalam subperaturan 9(7) selagi pekerja itu diambil kerja oleh majikan itu dan selama tempoh lima tahun selepas pekerja itu terhenti menjadi pekerjanya.

Jika majikan terhenti daripada menjalankan perniagaan dan orang lain mengambil alih perniagaan itu, majikan itu hendaklah menyerahkan semua rekod yang disebut dalam perenggan (1)(a) dan (b) kepada orang lain yang mengambil alih perniagaan itu, dan orang lain itu hendaklah menyimpan dan menyenggara rekod itu selama tempoh yang dinyatakan dalam perenggan (1)(a) dan (b) masing-masing.

Apabila habis tempoh yang disebut dalam perenggan (1)(a) dan (b), majikan itu hendaklah memberi Ketua Pengarah sekurang-kurangnya tiga bulan notis secara bertulis mengenai niatnya untuk melupuskan rekod itu, dan majikan itu hendaklah memindahkan rekod itu kepada Ketua Pengarah, jika diminta sedemikian.

  1. IN exercise of the powers conferred by section 66 of the Occupational Safety and Health Act 1994 [Act 514], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Occupational Safety and Health

(Noise Exposure) Regulations 2019.

These Regulations come into operation on 1 June 2019.

Interpretation 2.

In these Regulations ─

“standard threshold shift” means an average shift of 10dB or more at frequencies of 2000, 3000 and 4000 Hz compared to the baseline audiogramme;

“abnormal audiogramme” means an audiogramme that shows a hearing loss, hearing impairment or permanent standard threshold shift;

“excessive noise” means daily noise exposure level exceeding 82dB(A), daily personal noise dose exceeding fifty per cent, maximum sound pressure level exceeding 115dB(A) at any time, or peak sound pressure level exceeding 140dB(C);

“dB(A)” means A–weighted decibel which is a unit of measurement of sound pressure level corrected to the A–weighted frequency scale by means of an electrical network having the characteristics determined by the International Electrotechnical

Commission using a reference sound pressure level of 20 micropascals;

“dB(C)” means C–weighted decibel which is a unit of measurement of sound pressure level corrected to the C–weighted frequency scale by means of an electrical network having the characteristics determined by the International Electrotechnical

Commission using a reference sound pressure level of 20 micropascals;

“daily personal noise dose” means the cumulative noise exposure of an employee corrected for a normal working day of eight hours;

“hearing impairment” means the arithmetic average of the permanent hearing threshold level of an employee at 500, 1000, 2000 and 3000 Hz which is shifted by 25dB or more compared to the standard audiometric reference level;

“noise-induced hearing loss” means hearing loss arising from exposure to noise;

“daily noise exposure level” means the equivalent continuous sound pressure level corrected for a normal working day of eight hours;

“peak sound pressure level” means the highest C–weighted instantaneous sound pressure level of any impact;

“sound pressure level” means the level, in decibels, calculated as twenty times the common logarithm of the ratio of a sound pressure to the reference sound pressure of 20 micropascals;

“noise exposure” means the amount of sound pressure exposed to a person’s unprotected ear;

“personal hearing protector” means a device worn by a person to prevent unwanted auditory effects from acoustic stimuli;

“International

means the

Electrotechnical Commission that prepares and publishes International Standards for all electrical, electronic and related technologies.

Identification of excessive noise 3.

(1)

Every employer shall identify whether his employee may be exposed to excessive noise in the place of work in the manner as determined by the

Director General.

The employer shall reidentify whether his employee may be exposed to excessive noise in the place of work under subregulation (1)—

(a)

if there is a change in the machinery, equipment, process, work, control measures or operation at the place of work which may expose his employee to excessive noise;

not more than one year after the date of the previous identification; or

(3)

Any employer who contravenes subregulation (1) or (2) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding one year or to both.

Noise risk assessment 4.

(1)

Where it appears to the employer, upon the identification made under subregulation 3(1), that any of his employees may be exposed to excessive noise, the employer shall appoint a noise risk assessor to carry out noise risk assessment.

(2)

The noise risk assessor appointed by the employer under subregulation (1)

shall—

(a)

be registered with the Director General in the manner as determined by the Director General; and

(b)

possess a valid certificate issued by the Director General to carry out noise risk assessment.

(3)

The noise risk assessor shall carry out the noise risk assessment referred to in subregulation (1) by using noise measuring equipment which comply with the standard determined by the International Electrotechnical Commission.

(4)

Upon completion of the noise risk assessment referred to in subregulation (1), the noise risk assessor shall prepare a report and submit the report to the employer within one month of the date of completion of the assessment.

(5)

The report referred to in subregulation (4) shall include the findings of, and the recommendations made by, the noise risk assessor in respect of the noise risk assessment which has been carried out.

(6)

Upon receipt of the report under subregulation (4), the employer shall notify the employee who is exposed to excessive noise the findings and recommendations made under subregulation (5) within fourteen days after receiving the report from the noise risk assessor.

(7)

Where the report prepared under subregulation (4) consists of recommendations for any action to be taken pursuant to these Regulations, the employer shall carry out such recommendations within thirty days after receiving the report from the noise risk assessor.

(8)

The employer shall cause the noise risk assessment referred to in subregulation (1) to be reviewed—

(a)

not more than five years from the date of the previous noise risk assessment; or

(9)

Any person who contravenes subregulation (1), (2), (3), (4), (5), (6), (7)

or (8) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding one year or to both.

Information, instruction, training and supervision 5.

(1)

Where it appears to an employer that any of his employees is exposed to an excessive noise based on the report referred to in subregulation 4(4), the employer shall—

(a)

provide adequate information relating to the effects of noise exposure on the hearing of a person and the requirement to undergo an audiometric testing to such employees;

give training and instruction on the proper usage of a personal hearing protector to such employees; and

(c)

supervise the implementation of noise exposure control at the place of work.

(2)

An employer shall provide training for the employee referred to in subregulation (1) at least once a year.

(3)

Any employer who contravenes subregulation (1) or (2) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding one year or to both.

Noise exposure limit 6.

(1)

Every employer shall ensure that none of his employee is exposed to—

(a)

the daily noise exposure level exceeding 85dB(A) or daily personal noise dose exceeding hundred per cent;

the maximum sound pressure level exceeding 115dB(A) at any time; or

(c)

the peak sound pressure level exceeding 140dB(C).

(2)

Where it appears to an employer that any of his employees is exposed to an excessive noise exceeding the limit specified in subregulation (1) based on the report referred to in subregulation 4(4), the employer shall take such measures to reduce the excessive noise.

(3)

The employer shall, before taking the measures under subregulation (2), make an assessment whether it is practicable to reduce such excessive noise by way of engineering control or administrative control.

(4)

If upon the completion of the assessment made under subregulation (3) the employer found that—

(a)

it is practicable to reduce such excessive noise by engineering control, the employer shall reduce the excessive noise by such engineering control;

(b)

it is not practicable to reduce such excessive noise by engineering control solely, the employer shall reduce the excessive noise by engineering control together with administrative control;

(c)

it is not practicable to reduce such excessive noise by engineering control together with administrative control, the employer shall reduce the excessive noise by administrative control solely; and

Suggest a correction

(d)

it is not practicable to reduce such excessive noise by administrative control, the employer shall take other effective measures, which shall include personal hearing protector, to reduce such excessive noise.

(5)

The employer shall make a report on the assessment, and shall, upon request in writing from the Director General, give the Director General a copy of that report within thirty days after the request is received.

(6)

Where the employer reduces such excessive noise by engineering control specified in paragraphs (4)(a) and (b), the employer shall ensure that such engineering control is maintained in an efficient state and good working order.

(7)

Any employer who contravenes subregulation (1), (2), (3), (4), (5) or (6)

commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or imprisonment for a term not exceeding one year or to both.

Personal hearing protector 7.

Suggest a correction

(1)

Where an employer provides a personal hearing protector to an employee to reduce excessive noise, the employer shall ensure that the personal hearing protector—

(b)

is properly inspected, maintained and made available at all time;

will reasonably attenuate the employee’s personal noise exposure below the limit specified in paragraph 6(1)(a), (b) or (c) when the personal hearing protector is worn properly; and

(2)

Any employer who contravenes subregulation (1) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding one year or to both.

Hearing protection zone 8.

(1)

An employer shall ensure that any area at the place of work where a person is exposed to excessive noise exceeding the limit specified in paragraph 6(1)(a), (b)

or (c)—

(a)

is marked with the words “HEARING PROTECTION ZONE” or in such other manner as determined by the Director General; and

so far as practicable, is demarcated and identified by an appropriate warning sign.

(2)

An employer shall—

(a)

provide a personal hearing protector in any hearing protection zone;

and

ensure that any employee or other person uses the personal hearing protector provided under paragraph (a) while in the hearing protection zone.

(3)

Any employer who contravenes subregulation (1) or (2) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding one year or to both.

Audiometric testing 9.

(1)

Where a noise risk assessment report referred to in subregulation 4(4)

shows that any employee is exposed to excessive noise exceeding the limit specified in paragraph 6(1)(a), (b) or (c), the employer shall cause an audiometric testing to be carried out on such employee annually.

(2)

For the purpose of carrying out the audiometric testing under subregulation (1), the employer shall appoint an audiometric testing centre approved by the Director General.

(3)

The audiometric testing centre shall appoint an occupational health doctor to interpret the audiogramme of the employee based on the audiometric testing which has been carried out on such employee.

(4)

If the occupational health doctor determines any employee has an abnormal audiogramme, the occupational health doctor shall carry out medical examination on such employee.

(5)

The medical examination referred to in subregulation (4) shall include a medical history taking, physical examination and other relevant investigations to diagnose or rule out any occupational or non-occupational auditory disorder.

(6)

Where the occupational health doctor has examined the employee under subregulation (4) and is of the opinion that the employee has an occupational noise-induced hearing loss, hearing impairment or permanent standard threshold shift, the occupational health doctor shall notify the Director General within seven days after the medical examination.

(7)

The audiometric testing centre shall submit a report of the audiometric testing to the employer within thirty days from the date of the audiometric testing was carried out.

(8)

Upon receipt of the report under subregulation (7), the employer shall notify the result of the audiometric testing to the employee within twenty-one days after receiving the report.

(9)

If the report of the audiometric testing shows that any employee has a temporary standard threshold shift, the employer shall—

(a)

cause a retest to be carried out by the audiometric testing centre on such employee within three months after the previous audiometric testing was carried out; and

take such measures to protect the hearing of such employee from further deterioration.

(10)

If the report of the audiometric testing shows that any employee has an occupational noise-induced hearing loss, hearing impairment or permanent standard threshold shift, the employer shall—

(a)

notify the Director of the nearest office of the Department of

Occupational Safety and Health within seven days after receiving the report under subregulation (7);

provide a personal hearing protector to such employee if no personal hearing protector was provided to such employee previously; and

train such employee on the usage of the personal hearing protector.

(11)

Any person who contravenes subregulation (1), (2), (3), (4), (6), (7), (8), (9)

or (10) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or imprisonment for a term not exceeding one year or to both.

(12)

For the purpose of this regulation, “occupational health doctor” means a medical practitioner who is registered with the Director General to conduct medical surveillance programmes of employees.

Duty of employer when audiometric testing is carried out 10.

(1)

For the purpose of the audiometric testing under regulation 9, the employer shall—

(a)

ensure that the audiometric testing is carried out at no cost to the employee;

ensure that the audiometric testing is carried out within three months after the employee commencing work at any area of the place of work which is exposed to the noise exceeding the limit specified in paragraph 6(1)(a), (b) or (c); and

(c)

ensure that the audiometric testing is carried out after the employee is being put in a quiet state of at least fourteen hours without the aid of personal hearing protector.

(2)

For the purpose of paragraph (1)(c), “quiet” means absence of exposure to sound pressure level exceeding 80dB(A).

Record to be kept 11.

(1)

An employer shall keep and maintain a record which contains the following:

(a)

the report of the noise risk assessment referred to in subregulation 4(4) for a period of not less than thirty years; and

(b)

the report of the audiometric testing of his employee referred to in subregulation 9(7) for so long as the employee is employed by him and for a period of five years after such employee ceases to be his employee.

(2)

Where an employer ceases to carry on business and other person takes over such business, the employer shall hand over all records referred to in paragraphs (1)(a)

and (b) to that other person who takes over such business, and that other person shall keep and maintain such records for a period specified in paragraphs (1)(a) and (b)

respectively.

(3)

At the expiration of the period referred to in paragraphs (1)(a) and (b), the employer shall give the Director General at least three months notice in writing of his intention to dispose of such records, and the employer shall transmit the records to the Director General, if so requested.

Any employer who contravenes subregulation (1), (2) or (3) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding one year or to both.
