LEMBAGA INDUSTRI PEMBINAAN MALAYSIA (COMPOUNDING OF OFFENCES)

REGULATIONS 2015

IN exercise of the powers conferred by paragraph 37(2)(i) and section 38C of the

Lembaga Pembangunan Industri Pembinaan Malaysia Act 1994 [Act 520], the Lembaga, with approval of the Minister, makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Lembaga Industri Pembinaan

Malaysia (Compounding of Offences) Regulations 2015.

(2)

These Regulations come into operation on 1 June 2015.

Compoundable offences 2.

(1)

The offences specified in the First Schedule are prescribed to be compoundable offences.

(2)

The compoundable offences may be compounded with the consent of the

Public Prosecutor in writing in Form 1 of the Second Schedule.

Offer and acceptance of compound 3.

(1)

An offer to compound an offence shall be made in Form 2 of the Second

Schedule.

(2)

A person who accepts an offer to compound a compoundable offence shall accept the offer in Form 3 of the Second Schedule.

Payment of compound 4.

(1)

If an offer to compound an offence is accepted by the person to whom the offer is made, he may pay the compound—

(a)

by cash and shall be delivered personally to the Lembaga;

(b)

by money order, postal order or banker’s draft made payable to the Fund of the Lembaga Pembangunan Industri Pembinaan

Malaysia and crossed with the words “Account Payee Only”; or

(c)

by credit card or electronic fund transfers.

(2)

If the payment is made under paragraph 4(1)(b), it may be delivered personally or sent by prepaid registered post or courier services addressed to the

Lembaga.

(3)

The Lembaga shall issue an official receipt for the payment of compound to the person to whom the offer to compound was made.

(4)

For the purpose of subregulation (3), “official receipt” includes any electronic receipt issued by the Lembaga if the payment is made by credit card or any other electronic fund transfers.

The offences committed under the following provisions of the Lembaga Pembangunan Industri

Pembinaan Malaysia Act 1994 [Act 520] may be compounded:

(a)

section 28;

(b)

section 29;

(c)

subsection 30(2);

(d)

subsection 33(4);

(e)

subsection 33A(5);

(f)

subsection 33A(6);

(g)

subsection 33D(2);

(h)

subsection 33E(2);

(i)

subsection 34(9); and

(j)

subsection 34(10).
