Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Lembaga Pembangunan Industri Pembinaan Malaysia (Penyampaian Notis) 2015.

Peraturan-Peraturan ini mula berkuat kuasa pada 1 Jun 2015.

Notis

Seksyen 2

(1)

Notis untuk memberikan maklumat di bawah seksyen 27 Akta hendaklah dalam Borang I, II atau III Jadual.

(2)

Notis untuk berhenti daripada memulakan atau meneruskan kerja pembinaan di bawah seksyen 30 Akta hendaklah dalam Borang IV atau V Jadual.

(3)

Notis untuk berhenti daripada menggunakan bahan binaan yang tidak diperakukan di bawah seksyen 33E Akta hendaklah dalam Borang VI Jadual.

Penyampaian notis

Seksyen 3

(1)

Notis yang disebut dalam subperaturan 2(1) hendaklah disampaikan kepada seseorang melalui penyampaian ke diri atau secara pos berdaftar.

(2)

Notis yang disebut dalam subperaturan 2(2) dan 2(3) boleh disampaikan kepada seseorang dengan cara yang berikut:

(a)

melalui penyampaian ke diri di alamat biasa atau alamat yang akhir diketahui atau tempat perniagaan orang itu; atau

melalui pos biasa atau pos berdaftar Akuan Terima yang dialamatkan ke tempat tinggal atau tempat perniagaan orang itu yang lazim atau yang akhir diketahui.

IN exercise of the powers conferred by paragraph 37(2)(c) of the Lembaga

Pembangunan Industri Pembinaan Malaysia Act 1994 [Act 520], the Lembaga, with the approval of the Minister, makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Lembaga Pembangunan Industri

Pembinaan Malaysia (Service of Notice) Regulations 2015.

(2)

These Regulations come into operation on 1 June 2015.

Notices 2.

(1)

A notice to furnish particulars under section 27 of the Act shall be in

Form I, II or III of the Schedule.

(2)

A notice to abstain from commencing or proceeding with construction works under section 30 of the Act shall be in Form IV or V of the Schedule.

(3)

A notice to abstain from dealing with non-certified construction materials under section 33E of the Act shall be in Form VI of the Schedule.

Service of notice 3.

(1)

The notice referred to in subregulation 2(1) shall be served on a person by personal service or by registered post.

(2)

The notice referred to in subregulations 2(2) and 2(3) may be served on a person in the manner as follows:

(a)

by personal service at the usual or last known address or place of business of that person; or

by ordinary post or prepaid A.R. registered post addressed to the person’s usual or last known place of abode or place of business.

(3)

The notices referred to in regulation 2 are deemed served on an incorporated company or body if the notices have been served on the secretary of the company or body at its registered or principal office.

The Lembaga finds that the construction works above are being undertaken or carried out by you/your company whereas you/your company is not registered with the Lembaga. You/Your company’s have/has contravened subsection 25(1) of the Lembaga Pembangunan Industri Pembinaan Malaysia Act 1994 (the Act) which provides that no person shall carry out/complete/undertake to carry out or complete construction works or hold himself out as a contractor without obtaining a valid certificate of registration from the Lembaga.

Pursuant to section 29 of the Act, any person who contravenes subsection 25(1) shall be guilty of an offence and on conviction, shall be liable to a fine of not less than ten thousand ringgit but not more than one hundred thousand ringgit.

TAKE NOTICE that subject to the conditions contained in Annexure, this Notice issued under subsection 30(1) of the

Act to you/your company requires you/your company and/or your/your company’s employees and/or your/your company’s representatives or your/your company’s agents and/or your/your company’s servants IMMEDIATELY

The Lembaga finds that you have been using construction materials not certified according to the Lembaga

Pembangunan Industri Pembinaan Malaysia Act 1994 (the Act). Your/your company’s action has contravened subsection 33D(1) of the Act.

TAKE NOTICE that this Notice is issued under subsection 33E(1) of the Act which requires you/your company and/or your/your company’s employees and/or your company’s representatives/agents/servants IMMEDIATELY

NOT TO COMMENCE OR PROCEED WITH, ENGAGE IN OR BE INVOLVED IN OR UNDERTAKE TO BE ENGAGED IN

OR BE INVOLVED IN, DEALING WITH THE NON-CERTIFIED CONSTRUCTION MATERIALS.

Pursuant to subsection 33E(2) of the Act, any person who fails to comply with the requirements of the notice under subsection 33E(1) shall be guilty of an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit and in the case of a continuing offence, to a fine not exceeding five hundred ringgit for every day or part of a day during which the offence continues after conviction.
