Tafsiran

“kontraktor” ertinya seseorang yang bukannya pekerja di lombong yang dilantik oleh pemegang lesen, yang menjalankan kerja-kerja tertentu di lombong;

“lombong permukaan” ertinya suatu lombong selain lombong bawah tanah dan termasuklah lombong dedah, lombong lelubang terbuka, lombong tarah, lombong jalur, tempat pengorekan dan pensluisan tanah tetapi tidak termasuk pendulangan;

“pekerja” ertinya pekerja pemegang lesen tetapi tidak termasuk pekerja kontraktor;

“pelan pengurusan keselamatan” ertinya suatu pelan yang diluluskan di bawah peraturan 3;

“pemegang lesen” ertinya pemegang lesen mencari gali, lesen penjelajahan, lesen melombong tuan punya atau pajakan melombong, mengikut mana-mana yang berkenaan;

“penyelia” ertinya seseorang yang diambil kerja sebagai penyelia oleh pemegang lesen;

“tempat kerja” ertinya suatu kawasan di mana penjelajahan, perlombongan atau pemprosesan mineral dijalankan dalam suatu tenemen mineral.

Bahagian II

BAHAGIAN II

PELAN PENGURUSAN KESELAMATAN

Seksyen 3

(1)

Pemegang lesen hendaklah menyediakan dan mengemukakan suatu pelan pengurusan keselamatan kepada Penolong Pengarah untuk kelulusannya, dalam masa enam bulan dari bermulanya apa-apa kerja pembangunan dalam suatu lombong, atau tiga bulan dari bermulanya penjelajahan.

Pelan pengurusan keselamatan hendaklah disediakan oleh seorang perunding yang adalah seorang jurutera profesional perlombongan atau sumber mineral yang berdaftar dengan Lembaga Jurutera Malaysia.

(3)

Pelan pengurusan keselamatan hendaklah mengandungi butir-butir yang berikut:

(a)

pengenalpastian kawasan, bahan dan aktiviti bermudarat dan penilaian tahap risiko yang timbul daripada mudarat itu;

langkah-langkah pengurangan untuk mengawal risiko yang disebut dalam perenggan (a);

(d)

tatacara keselamatan apabila kemalangan berlaku dan kekinian pengemukaan laporan;

(e)

tatacara tindak balas kecemasan yang hendaklah termasuk yang berikut:

(i)

langkah-langkah bagi memastikan keselamatan dan kestabilan muka lombong, bukaan, longgokan buangan dan pembendungan hampas;

(ii)

bagi pengorekan luar pesisir, langkah-langkah pencegahan yang berhubungan dengan kelajuan angin, arus laut dan ketinggian gelombang;

(iii)

peruntukan yang sewajarnya mengenai kemudahan, kelengkapan dan sistem amaran keselamatan;

(v)

cara memaklumkan pihak berkuasa yang berkenaan jika berlaku apa-apa kecemasan; dan

(f)

apa-apa butiran lain sebagaimana yang dikehendaki oleh Penolong

Penolong Pengarah hendaklah dalam masa tiga puluh hari memutuskan sama ada untuk meluluskan atau menolak pelan pengurusan keselamatan itu dan memberitahu keputusannya secara bertulis.

Pemegang lesen boleh mengemukakan kepada Penolong Pengarah untuk kelulusan suatu ubah suaian pada pelan pengurusan keselamatan yang telah diluluskan oleh Penolong Pengarah di bawah subperaturan (4).

Jika Penolong Pengarah menolak pelan pengurusan keselamatan itu atau ubah suaian pelan itu, dia hendaklah memberitahu pemegang lesen secara bertulis tentang keputusannya.

(7)

Selepas diberitahu tentang keputusan itu, pemegang lesen boleh, dalam masa tiga puluh hari, mengemukakan suatu pindaan pelan pengurusan keselamatan untuk kelulusan Penolong Pengarah.

Mana-mana pemegang lesen yang terkilan dengan keputusan Penolong

Pengarah di bawah peraturan ini boleh, dalam masa tiga puluh hari dari tarikh diberitahu tentang penolakan itu, merayu secara bertulis kepada Pengarah yang keputusannya adalah muktamad.

Pemegang lesen hendaklah mematuhi dan melaksanakan langkah-langkah keselamatan mengikut pelan pengurusan keselamatan yang diluluskan.

(10)

Seorang pemegang lesen yang tidak mengemukakan pelan pengurusan keselamatan atau tidak mematuhi pelan pengurusan keselamatan yang diluluskan melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima puluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya.

(1)

Walau apa pun subperaturan 3(5), pemegang lesen boleh mengkaji semula pelan pengurusan keselamatan bila perlu atau apabila diminta oleh Penolong Pengarah.

Pemegang lesen hendaklah mengemukakan pelan pengurusan keselamatan yang dikaji semula itu kepada Penolong Pengarah untuk kelulusan.

(3)

Penolong Pengarah hendaklah dalam masa tiga puluh hari memutuskan sama ada untuk meluluskan pelan pengurusan keselamatan yang dikaji semula itu dan memberitahu secara bertulis tentang keputusannya.

Jika Penolong Pengarah menolak pelan pengurusan keselamatan yang dikaji semula itu, dia hendaklah memberitahu pemegang lesen tentang keputusannya.

Selepas diberitahu tentang keputusan itu, pemegang lesen boleh, dalam masa tiga puluh hari, mengemukakan suatu pelan pengurusan keselamatan yang dikaji semula yang telah dipinda untuk kelulusan Penolong Pengarah.

BAHAGIAN III

KEWAJIPAN PEMEGANG LESEN TENTANG KESELAMATAN DI TEMPAT KERJA

Kewajipan am tentang keselamatan di tempat kerja

Seksyen 5

(1)

Pemegang lesen hendaklah mengambil semua langkah yang perlu untuk menghapuskan atau meminimumkan risiko kepada keselamatan di tempat kerja dan terutamanya―

(a)

hendaklah memastikan bahawa tempat kerja itu dilengkapkan, dikendalikan dan disenggarakan supaya pekerja boleh melaksanakan kerja mereka tanpa membahayakan keselamatan mereka;

hendaklah mengawasi, menilai dan membuat pemeriksaan tetap tentang persekitaran kerja untuk mengenal pasti pelbagai mudarat dan bahaya yang mungkin yang kepadanya pekerja boleh terdedah serta untuk menilai tahap pendedahan mereka;

(c)

hendaklah mengambil langkah berjaga-jaga yang sewajarnya berhubungan dengan sifat pengendalian di tempat kerja bagi mengesan, mencegah dan memerangi bermulanya dan merebaknya kebakaran dan letupan atau bahaya lain;

(d)

hendaklah memastikan bahawa apabila terdapat bahaya yang serius kepada keselamatan pekerja, semua kerja dihentikan operasinya dan pekerja dipindahkan ke tempat yang selamat;

(e)

hendaklah menyediakan seliaan dan kawalan yang mencukupi pada setiap syif kerja untuk memastikan keselamatan di tempat kerja;

(f)

hendaklah menyediakan kelengkapan keselamatan yang mencukupi termasuklah kemudahan pertolongan cemas dan rawatan kecemasan;

dan

Suggest a correction

(g)

hendaklah menampal notis di tempat kerja yang mudah dilihat yang mengandungi tindakan yang hendaklah diambil jika berlaku kecemasan dan suatu pelan yang menunjukkan tempat telefon atau komunikasi lain, kelengkapan, stesen pertolongan cemas, alat pemadam kebakaran dan alat penyelamat lain.

Jika pekerja terdedah kepada mudarat fizikal, kimia atau biologi, pemegang lesen―

(a)

hendaklah memaklumkan pekerja dengan cara yang komprehensif tentang mudarat yang berkaitan dengan kerja mereka, risiko kesihatan yang terlibat dan langkah-langkah pencegahan dan perlindungan yang berkaitan yang hendaklah diambil;

(b)

hendaklah mengambil langkah-langkah yang sewajarnya untuk menghapuskan atau meminimumkan risiko akibat mudarat itu; dan

Suggest a correction

(c)

jika perlindungan yang mencukupi terhadap risiko kemalangan atau kecederaan kepada kesihatan termasuklah pendedahan kepada keadaan buruk tidak dapat dipastikan, hendaklah menyediakan dan menyenggarakan tanpa kos kepada pekerja, kelengkapan perlindungan persendirian, kelengkapan pernafasan dan resusitasi kecemasan, pakaian dan kemudahan lain.

Jika risiko kepada keselamatan mana-mana orang timbul disebabkan ketidakpatuhan kepada pelan pengurusan keselamatan oleh kontraktor atau pekerjanya, kontraktor atau pekerjanya itu hendaklah diarahkan oleh pemegang lesen untuk

menghentikan kerja dengan segera dan tidak boleh memulakan semula kerja sehingga apa-apa kehendak dipatuhi oleh kontraktor atau pekerjanya.

Walau apa pun subperaturan (3), jika pemegang lesen berpendapat bahawa penghentian kerja dengan segera berkemungkinan meningkatkan risiko kepada keselamatan, dia hendaklah mengarahkan kontraktor untuk menghentikan kerja sebaik sahaja ia selamat untuk berbuat demikian.

Seseorang pemegang lesen hendaklah mengambil segala tindakan perlu untuk memastikan bahawa pekerjanya—

(a)

mematuhi apa-apa langkah keselamatan yang disediakan di tempat kerja;

(b)

sebelum memulakan kerja dan pada selang yang kerap semasa syifnya, memeriksa keselamatan tempat kerja dan apa-apa kelengkapan atau kemudahan yang dimaksudkan untuk digunakan olehnya selamat untuk digunakan;

(c)

mengambil apa-apa jagaan yang munasabah bagi keselamatan dan kesihatannya sendiri dan orang lain yang mungkin terjejas oleh perbuatan atau peninggalannya semasa kerja, termasuklah jagaan dan penggunaan yang sepatutnya bagi pakaian, kemudahan dan kelengkapan;

(d)

melaporkan dengan segera kepada pemegang lesen tentang apa-apa situasi yang dia percaya boleh mengakibatkan risiko kepada keselamatan atau kesihatan orang lain; dan

(e)

bekerjasama dengan pemegang lesen berkenaan dengan aspek kewajipan dan tanggungjawab pekerja di tempat kerja.

Program latihan keselamatan

Seksyen 6

(1)

Seseorang pemegang lesen hendaklah memastikan bahawa tiada pekerja yang menjalankan tugas di lombong permukaan melainkan jika pekerja itu telah selesai latihan asas.

Pemegang lesen hendaklah memastikan bahawa pekerja diberikan latihan ulang kaji sekurang-kurangnya dua puluh empat jam setahun.

Pemegang lesen hendaklah menyediakan program latihan keselamatan bagi pekerjanya seperti yang berikut:

(a)

latihan asas dan latihan ulang kaji mengenai perkara keselamatan yang hendaklah termasuk yang berikut:

pengenalan kepada pelan pengurusan keselamatan dan tatacara tindak balas kecemasan;

(ii)

latihan khusus kaedah-kaedah perlombongan dan kelengkapan yang digunakan; dan

(iii)

pengenalan kepada hak dan tanggungjawab yang diperuntukkan di bawah Akta;

(b)

suatu latihan khusus bagi pasukan penyelamat lombong yang hendaklah termasuk yang berikut:

latihan pertolongan cemas yang sewajarnya yang menekankan tentang keselamatan orang yang memberi pertolongan cemas dan keselamatan orang yang menerima pertolongan cemas;

(ii)

pengenalan kepada penggunaan, jagaan dan penyenggaraan kelengkapan menyelamat; dan

apa-apa keperluan latihan tambahan sebagaimana yang dikehendaki oleh Penolong Pengarah.

Pemegang lesen hendaklah―

(a)

melantik mana-mana orang yang, pada pendapatnya, kompeten untuk mengendalikan program latihan keselamatan; dan

(b)

menyimpan dan menyenggara rekod latihan dan apa-apa penilaian yang diberikan atau dijalankan.

Pemegang lesen hendaklah, sebelum permulaan apa-apa kerja bukaan, lelubang atau pemaritan, mengemukakan suatu pelan kepada Penolong Pengarah yang menunjukkan tempat kerja yang dicadangkan.

Pemegang lesen hendaklah memastikan sebelum permulaan apa-apa kerja di bawah subperaturan (1)―

(b)

cerun atau dinding distabilkan.

Apabila selesai kerja penjelajahan, pemegang lesen―

hendaklah menimbus atau menyebabkan ditimbus semua bukaan, lubang dan parit;

hendaklah merobohkan atau menyebabkan diroboh semua binaan dan struktur tapak khemah;

hendaklah melupuskan atau menyebabkan dilupus apa-apa bahan kimia dengan sewajarnya; dan

hendaklah menanam atau menyebabkan ditanam apa-apa sampah.

Kewajipan tentang keselamatan dalam menguruskan bahan peroi

Pemegang lesen hendaklah memastikan bahawa timbunan simpanan bahan peroi―

(a)

diperiksa secara tetap oleh seorang yang kompeten untuk mengesan apa-apa keadaan bermudarat;

dijadikan selamat sebelum seseorang pekerja dibenarkan untuk bekerja dekat dengan atau di bahagian atas timbunan simpanan itu;

dan

(c)

dilonggokkan atau disusun dengan sedemikian cara untuk mencegah pergerakan atau runtuhan yang tidak sengaja.

Pemegang lesen hendaklah memastikan bahawa sebelum seseorang pekerja memasuki suatu struktur, semua bekalan bahan ke dalamnya atau pemindahan bahan darinya hendaklah dihentikan.

Pemegang lesen hendaklah memastikan bahawa semasa bekerja di bahagian atas bahan peroi dalam suatu struktur—

(a)

pekerja hendaklah memakai sistem penahan jatuh; dan

(b)

sekurang-kurangnya seorang pekerja yang lain, yang dilengkapi dengan penggera yang sesuai sentiasa berada di luar struktur itu.

Dalam peraturan ini, “struktur” ertinya silo, tong, corong tuang atau bekas lain yang digunakan sebagai bekas bahan peroi.

Kewajipan tentang keselamatan dalam menguruskan bahan lebur

Pemegang lesen tidak boleh menyebabkan―

(a)

apa-apa sentuhan antara bahan lebur dengan permukaan lembap, berkarat atau sejuk, air atau bahan lain jika sentuhan tersebut boleh menyebabkan letupan; dan

(b)

apa-apa tumpahan bahan lebur daripada centong, pot sanga atau bekas yang serupa yang boleh membahayakan mana-mana orang.

(2)

Jika centong, pot sanga atau bekas yang serupa yang digunakan untuk mengendalikan bahan lebur didapati rosak atau dicemari oleh suatu bahan yang boleh menyebabkan letupan, centong, pot sanga atau bekas yang serupa itu tidak boleh digunakan.

Pemegang lesen hendaklah memastikan bahawa—

setiap kapal korek dilengkapi dengan alat-alat yang berikut:

bilangan boya keselamatan dan pencangkuk bot yang mencukupi, yang hendaklah diletakkan di tempat yang sewajarnya;

(ii)

tali keselamatan dipasang di sekeliling kapal korek pada ketinggian yang sesuai;

bilangan bot penumpang yang mencukupi untuk membawa semua orang yang berada dalam kapal korek dalam kes pemindahan;

(iv)

jaket keselamatan bagi setiap orang dalam kapal korek; dan

(v)

notis yang menunjukkan tempat semua jaket keselamatan, alat pertolongan cemas dan menyelamatkan nyawa;

notis amaran dilekatkan di tempat yang mudah dilihat untuk memberikan orang amaran tentang bahaya daripada tali haluan dan sisi terutamanya jika tali haluan atau sisi merentasi laluan atau jalan besar;

(c)

hanya orang yang diberi kuasa oleh orang yang bertanggungjawab bagi kapal korek dibenarkan untuk bekerja di kawasan atau dalam zon bahaya tali haluan dan sisi semasa kapal korek sedang beroperasi;

(i)

bekerja di hujung lelantai kapal korek melainkan jika dia menggunakan perkakas keselamatan atau jaket keselamatan;

(ii)

memijak atau menaiki apa-apa timba, rantai atau penapis berputar semasa ia sedang bergerak; atau

(iii)

melintasi telaga kapal korek semasa timba sedang bergerak kecuali dengan menggunakan laluan yang disediakan bagi maksud tersebut;

(e)

orang yang bertanggungjawab bagi suatu kapal korek semasa tiap-tiap syif hendaklah memeriksa—

jika orang yang bertanggungjawab itu menemui apa-apa kerosakan pada mana-mana alat keselamatan atau apa-apa keadaan bahaya, dia hendaklah dengan segera membaiki kerosakan itu atau mengambil langkah-langkah pemulihan yang sewajarnya, dan semua pemeriksaan, pembaikan atau langkah pemulihan yang diambil, jika ada, hendaklah direkodkan dan disenggarakan.

Pemegang lesen yang melanggar Bahagian III melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi seratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi lima tahun atau kedua-duanya.

MINERAL DEVELOPMENT (SAFETY IN EXPLORATION AND SURFACE MINING)

REGULATIONS 2014

  1. IN exercise of the powers conferred by paragraphs 63(2)(i) and (k) of the Mineral Development Act 1994 [Act 525], the Minister makes the following regulations:

Bahagian I

PART I

PRELIMINARY

Citation 1.

These regulations may be cited as the Mineral Development (Safety in

Exploration and Surface Mining) Regulations 2014.

Interpretation 2.

In these Regulations, unless the context otherwise requires―

“contractor” means a person who is not an employee at a mine engaged by the holder of a licence, who undertakes certain works at the mine;

“surface mine” means a mine other than an underground mine and includes open cast mine, open pit mine, open cut mine, strip mine, places of dredging and ground sluicing but does not include panning;

“employee” means an employee of a holder of a licence but does not include an employee of a contractor;

“safety management plan” means a plan approved under regulation 3;

“holder of a licence” means a holder of a prospecting licence, exploration licence, proprietary mining licence or mining lease, as the case may be;

“supervisor” means a person employed as a supervisor by a holder of a licence;

“workplace” means an area where exploration, mining or mineral processing is carried out in a mineral tenement.

PART II

(1)

A holder of a licence shall prepare and submit a safety management plan to the Assistant Director for his approval, within six months of the start of any development work in a mine, or three months of the start of exploration.

The safety management plan shall be prepared by a consultant who shall be a professional mining or mineral resources engineer registered with the Board of Engineers

Malaysia.

The safety management plan shall consist of the following details:

(a)

identification of hazardous areas, substances and activities and an assessment of the degree of risks arising from the hazards;

(b)

mitigating measures to control the risks referred to in paragraph (a);

(d)

safety procedures when an accident happens and timeliness on report submission;

Suggest a correction

(e)

emergency response procedures which shall include the following:

(i)

measures for ensuring safety and stability of mine faces, openings, waste dumps and tailings impoundments;

(ii)

for offshore dredging, precautionary measures relating to wind speed, sea current and wave height;

(iii)

the provision of appropriate safety facilities, equipment and warning system;

(v)

the manner of informing the relevant authorities in the event of any emergency; and

The Assistant Director shall within thirty days decide whether to approve or reject the safety management plan and notify in writing of his decision.

The holder of a licence may submit to the Assistant Director for approval a modification of the safety management plan approved by the Assistant Director under subregulation (4).

Where the Assistant Director rejects the safety management plan or modification of such plan, he shall notify the holder of the licence in writing of his decision.

After being notified of the decision, the holder of a licence may, within thirty days, submit an amended safety management plan for the approval of the Assistant

(8)

Any holder of a licence who is aggrieved by the decision of the Assistant

Director under this regulation may, within thirty days from the date he is notified of such rejection, appeal in writing to the Director whose decision shall be final.

The holder of a licence shall comply and carry out the safety measures as in accordance with such approved safety management plan.

(10)

Any holder of a licence who fails to submit a safety management plan or to comply with the approved safety management plan commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both.

Review of safety management plan 4.

(1)

Notwithstanding subregulation 3(5), the holder of a licence may review the safety management plan when necessary or upon request by the Assistant Director.

The holder of a licence may submit the reviewed safety management plan to the Assistant Director for an approval.

DUTIES OF A HOLDER OF A LICENCE ON SAFETY IN A WORK PLACE

General duties on safety in a work place 5.

(1)

A holder of a licence shall take all necessary measures to eliminate or minimise the risks to safety in a work place and in particular―

(a)

shall ensure that the work place is equipped, operated and maintained in such a way that the employees may perform their work without endangering their safety;

shall monitor, assess and make regular inspection of the working environment to identify various hazards and potential dangers to which the employees may be exposed and to assess their level of exposure;

(c)

shall take appropriate precautions relating to the nature of operations in the work place to detect, prevent and combat the start and spread of fire and explosion or other dangers;

(d)

shall ensure that when there is a serious danger to the safety of the employees, all workings are to cease operations and the employees are evacuated to a safe location;

(e)

shall provide adequate supervision and control on each working shift to secure safety at the work place;

(f)

shall provide sufficient safety equipment including first-aid and emergency treatment facilities; and

Suggest a correction

(g)

shall post notices in conspicuous places containing actions to be taken in the event of an emergency and a plan showing locations of telephones or other communication, equipment, first-aid stations, fire extinguishers and other rescue devices.

(2)

Where employees are exposed to physical, chemical or biological hazards, the holder of a licence―

(a)

shall inform the employees in a comprehensible manner of the hazard associated with their work, the health risks involved and the relevant preventive and protective measures to be taken;

(b)

shall take appropriate measures to eliminate or minimize any risks resulting from such hazards; and

Suggest a correction

(c)

where adequate protection against risk of accident or injury to health including exposure to adverse conditions is unable to be ensured, shall provide and maintain at no cost to the employees, personal protective equipment, emergency breathing and resuscitating equipment, clothing and other facilities.

(3)

If a risk to the safety of any person arises because of such non-compliance with the safety management plan by the contractor or his employees, the contractor or his employees shall be directed by the holder of a licence to stop work immediately and shall not resume work until any requirement is complied with by the contractor or his employees.

(4)

Notwithstanding subregulation (3), if in the opinion of the holder of a licence that an immediate cessation of work is likely to increase the risk to safety, he shall direct the contractor to stop work as soon as it is safe to do so.

(5)

A holder of a licence shall take all necessary actions to ensure that the employee—

(a)

complies with any safety measures to be observed at the work place;

before commencing work and at frequent intervals during his shift, examine the safety of the work place and any equipment or facility intended to be used by him are safe to be used;

(c)

takes reasonable care of his own safety and health and that of other persons who may be affected by his acts or omissions at work, including the proper care and use of protective clothing, facilities and equipments;

(d)

reports immediately to the holder of a licence of any situation which he believes may present a risk to safety or health of other persons;

and

Suggest a correction

(e)

cooperates with the holder of a licence in respect of the employees’

duties and responsibilities at the work place.

Safety training programme 6.

(1)

A holder of a licence shall ensure that no employee is to carry out any task at the surface mine unless he has completed the basic training.

A holder of a licence shall ensure that the employees are given refresher training at least twenty-four hours a year.

(3)

A holder of a licence shall provide a safety training programme for his employees as follows:

(a)

a basic training and refresher training on safety matters which shall include the followings:

(i)

an introduction to safety management plan and emergency response procedures;

(ii)

specific skills on mining methods and equipment used; and

(iii)

an introduction to the rights and responsibilities provided for under the Act;

(b)

a specific training for the mine rescue team which shall include the followings:

(i)

an appropriate first-aid training emphasizing on the safety of the person giving the first-aid and the safety of the person receiving the first-aid;

(ii)

an introduction to the use, care and maintenance of rescue equipment; and

(c)

any additional training needs as may be required by the Assistant

Director.

(4)

A holder of a licence shall―

(a)

appoint any person who, in his opinion, is competent to conduct the safety training programme; and

keep and maintain records of training and any assessment given or undertaken.

Duties on safety during pre-exploration works 7.

(1)

A holder of a licence shall, before the commencement of any opening, pitting or trenching works, submit a plan to the Assistant Director showing the location of the proposed works.

A holder of a licence shall ensure that before the commencement of any work under subregulation (1)―

(b)

a slope or a wall is made stable.

Duties on safety upon completion of exploration works 8.

Upon completion of any exploration work, a holder of a licence―

shall fill or cause to be filled in all openings, pits and trenches;

shall demolish or cause to be demolished all camp site buildings and structures;

shall bury or cause to be buried any refuse.

Duties on safety in dealing with unconsolidated material 9.

(1)

A holder of a licence shall ensure that stockpiles of unconsolidated material―

(a)

are inspected regularly by a competent person to detect any hazardous condition;

are made safe before an employee is allowed to work close to or on top of the stockpile; and

(c)

are piled or stacked in a manner to prevent accidental movement or collapse.

(2)

A holder of a licence shall ensure that before an employee enters a structure, all supply of materials thereto or removal of materials therefrom shall be stopped.

A holder of a licence shall ensure that when working on top of an unconsolidated material in a structure―

(a)

an employee shall use a fall arrest system; and

at least one other employee, equipped with a suitable alarm, be in constant attendance outside the structure.

(4)

In this regulation, “structure” means silo, bin, hopper or other container used as a container of unconsolidated material.

Duties on safety in dealing with molten material 10.

(1)

A holder of a licence shall not cause―

(a)

any contact between molten material and damp, rusty or cold surface, water or other substances where such contact may cause an explosion; and

(b)

any spillage of molten material from a ladle, slag pot or similar vessel that may endanger any person.

(2)

If a ladle, slag pot or similar vessel which is used for handling molten material is found to be defective or contaminated by a substance that may cause an explosion, the ladle, slag pot or similar vessel shall not be used.

Duties on safety in dredging area 11.

A holder of a licence shall ensure that—

(a)

every dredge is equipped with the following appliances:

adequate number of lifebuoys and boat hooks, which shall be located at appropriate places;

(ii)

lifelines be fitted around the dredge at a convenient height;

adequate number of passenger boats to carry all persons on board the dredge, in the case of evacuation;

(iv)

life-jacket for each person on the dredge; and

(v)

notices indicating the location of all life-jackets, first-aid and life-saving appliances;

(b)

warning notices are posted in conspicuous places to warn person of danger from head and side lines particularly where head or side lines cross a path or thoroughfare;

only a person authorised by the person in charge of a dredge shall be allowed to work in the vicinity or within the danger zones of the head and side lines whilst the dredge is in operation;

(i)

work in outboard of a dredge unless he uses a safety harness or life-jacket;

(ii)

step or ride on any bucket, chain or revolving screen whilst it is in motion; or

(iii)

cross the well of the dredge while the buckets are in motion except by means of the gangway provided for that purpose;

(e)

the person in charge of a dredge shall inspect the followings during every shift—

(f)

if the person in charge discovers any defect to any of the safety devices or any danger condition, he shall immediately rectify the defect or take appropriate remedial measures, and all inspection, rectification or remedial measures taken, if any, shall be recorded and maintained.

General penalty 12.

A holder of a licence who contravenes Part III commits an offence and shall, on conviction, be liable to a fine not exceeding one hundred thousand ringgit or imprisonment for a term not exceeding five years or to both.
