Mana-mana pengamal berdaftar yang telah diberikan oleh Majlis suatu perakuan pengamalan pengamal berdaftar atau perakuan pengamalan sementara boleh membuat permohonan kepada Majlis secara bertulis dalam bentuk sebagaimana yang ditentukan oleh Majlis untuk suatu perakuan kelakuan baik.

Diploma atau setaraf merujuk kepada diploma sebagaimana yang diluluskan atau diiktiraf oleh Majlis Perubatan Tradisional dan Komplementari dan sebagaimana yang dinyatakan dalam garis panduan pendaftaran untuk bidang amalan diiktiraf yang berkaitan.

Ijazah sarjana muda atau setaraf merujuk kepada ijazah sarjana muda sebagaimana yang diluluskan atau diiktiraf oleh Majlis Perubatan Tradisional dan

Komplementari dan sebagaimana yang dinyatakan dalam garis panduan pendaftaran untuk bidang amalan diiktiraf yang berkaitan.”.

TRADITIONAL AND COMPLEMENTARY MEDICINE ACT 2016

TRADITIONAL AND COMPLEMENTARY MEDICINE (AMENDMENT) REGULATIONS 2025

IN exercise of the powers conferred by paragraphs 60(2)(b), (c), (d), (e), (k)

and (m) of the Traditional and Complementary Medicine Act 2016 [Act 775], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Traditional and Complementary

Medicine (Amendment) Regulations 2025.

(2)

These Regulations come into operation on 1 September 2025.

Amendment of regulation 2 2.

The

Traditional and

Complementary

Medicine

Regulations 2021

[P.U. (A) 69/2021], which are referred to as the “principal Regulations” in these

Regulations, are amended in subregulation (2)—

(a)

in paragraph (b), by substituting for the words “; or” at the end of the paragraph a full stop; and

(b)

by deleting paragraph (c).

Amendment of regulation 4 3.

Regulation 4 of the principal Regulations is amended—

(a)

by substituting for subregulation (2) the following subregulation:

“(2)

An applicant referred to in subregulation (1) shall be eligible to be registered with the Council if the applicant obtains the recognized qualification as specified in the Third Schedule.”; and

(b)

in subregulation (4), by substituting for paragraph (c) the following paragraph:

“(c)

a certified true copy of a degree, diploma or certificate, or if such degree, diploma or certificate is yet to be issued, a certified true copy of a transcript of such degree, diploma or certificate.”.

New regulation 5A

The principal Regulations are amended by inserting after regulation 5

the following regulation:

“Application for amendment of details in temporary practising certificate 5A.

(1)

Any holder of a temporary practising certificate may make an application in writing to the Council in the form as determined by the Council to amend any details in the temporary practising certificate and such application shall be accompanied by the payment of fee as specified in the Second Schedule.

(2)

The

Council shall, after the application made under subregulation (1) is approved, issue a new temporary practising certificate in

Form H of the First Schedule and cancel the temporary practising certificate issued previously under subregulation 5(3).”.

New regulation 6A

5.

The principal Regulations are amended by inserting after regulation 6

the following regulation:

“Application for amendment of details in registered practitioner’s practising certificate 6A.

(1)

Any registered practitioner may make an application in writing to the Council in the form as determined by the Council to amend any details in the registered practitioner’s practising certificate and such application shall be accompanied by the payment of fee as specified in the Second Schedule.

(2)

The

Council shall, after the application made under subregulation (1) is approved, issue a new registered practitioner’s practising certificate in Form K of the First Schedule and cancel the registered practitioner’s practising certificate issued previously under subregulation 6(4).”.

New regulation 10A

The principal Regulations are amended by inserting after regulation 10

the following regulation:

“Application for certificate of good standing 10A. (1)

Any registered practitioner who has been granted by the Council a registered practitioner’s practising certificate or a temporary practising certificate may make an application to the Council in writing in the form as determined by the Council for a certificate of good standing.

(2)

The application made under subregulation (1) shall be accompanied by the payment of fee as specified in the Second Schedule and subject to any condition as determined by the Council.”.

Substitution of Second Schedule 7.

The principal Regulations are amended by substituting for the Second Schedule the following schedule:

Traditional and Complementary Medicine Council and as specified in the registration guidelines for the respective recognized practice area.

4.

A bachelor degree or equivalent refers to a bachelor degree as approved or recognized by the Traditional and Complementary Medicine Council and as specified in the registration guidelines for the respective recognized practice area.”.

Deletion of Fourth Schedule 9.

The principal Regulations are amended by deleting the Fourth Schedule.
