PADA menjalankan kuasa yang diberikan oleh seksyen 4 Akta Kawalan Harga dan Antipencatutan 2011 [Akta 723], Pengawal, dengan kelulusan Menteri, membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Perintah ini bolehlah dinamakan Perintah Kawalan Harga dan

Antipencatutan (Penentuan Harga Maksimum) 2022.

(2)

Perintah ini mula berkuat kuasa pada 15 Januari 2022.

Tafsiran

Seksyen 2

Dalam Perintah ini, “Vaksin COVID-19” ertinya suatu vaksin yang—

(a)

disuntik ke dalam badan manusia yang digunakan untuk merangsang sistem imun badan manusia supaya bertindak balas melindungi badan manusia daripada jangkitan

Penyakit

Koronavirus 2019

(COVID-19); dan

(b)

didaftarkan dengan Pihak Berkuasa Kawalan Dadah menggunakan nombor pendaftaran yang ditetapkan oleh pihak berkuasa itu.

Harga borong maksimum

Seksyen 3

Harga borong maksimum bagi Vaksin COVID-19 yang dinyatakan dalam ruang (1) Jadual ditentukan sebagaimana yang dinyatakan dalam ruang (2).

Seksyen 4

Harga runcit maksimum

Harga runcit maksimum bagi Vaksin COVID-19 yang dinyatakan dalam ruang (1) Jadual ditentukan sebagaimana yang dinyatakan dalam ruang (3) dan

harga runcit maksimum itu tidak termasuk apa-apa caj perkhidmatan atau caj barangan pakai buang yang digunakan bagi maksud suntikan Vaksin COVID-19 itu.

Senarai harga jualan Vaksin COVID-19

Preamble

Menurut seksyen 9 Akta, mana-mana pemegang lesen bagi kemudahan jagaan kesihatan swasta atau pemilik farmasi yang kemudahan jagaan kesihatan swasta atau farmasinya menjual atau menawarkan untuk menjual Vaksin COVID-19 hendaklah mempamerkan senarai harga jualan Vaksin COVID-19 itu—

(a)

dalam bentuk fizikal atau media elektronik di kemudahan jagaan kesihatan swasta atau farmasi, masing-masing; dan

(b)

dalam kedudukan yang mudah dilihat yang senang dibaca oleh mana-mana orang yang ingin membeli vaksin itu.

(2)

Bagi maksud perenggan ini, “kemudahan jagaan kesihatan swasta”

mempunyai erti yang diberikan kepadanya di bawah seksyen 2 Akta Kemudahan dan

Perkhidmatan Jagaan Kesihatan Swasta 1998 [Akta 586].

PRICE CONTROL AND ANTI-PROFITEERING

(DETERMINATION OF MAXIMUM PRICE) ORDER 2022

Opening note

Preamble

IN exercise of the powers conferred by section 4 of the Price Control and Anti-Profiteering Act 2011 [Act 723], the Controller, with the approval of the Minister, makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Price Control and Anti-Profiteering

(Determination of Maximum Price) Order 2022.

(2)

This Order comes into operation on 15 January 2022.

Interpretation 2.

In this Order, “COVID-19 Vaccine” means a vaccine which—

(a)

is injected into a human body used to stimulate the immune system of the human body to respond protecting the human body from the infection of

Coronavirus Disease 2019 (COVID-19); and

(b)

is registered with the Drug Authority Control using the designated registration number specified by the authority.

Maximum wholesale price 3.

The maximum wholesale price for the COVID-19 Vaccine specified in column (1)

of the Schedule is determine as specified in column (2).

Maximum retail price 4.

The maximum retail price for the COVID-19 Vaccine specified in column (1) of the

Schedule is determine as specified in column (3) and the maximum retail price does not include any charges for services or consumable items that are used for the purpose of injection of the COVID-19 vaccine.

List of selling prices of COVID-19 Vaccine 5.

Preamble

Pursuant to section 9 of the Act, any licence holder of a private healthcare facility or owner of a pharmacy who its private healthcare facility or pharmacy sells or offers to sell the COVID-19 Vaccine shall display the list of the selling prices of the COVID-19 Vaccine—

(a)

whether in physical form or in electronic media at the private healthcare facility or pharmacy, respectively; and

(b)

in a conspicuous position easily read by any person intending to purchase the vaccine.

(2)

For the purpose of this paragraph, “private healthcare facility” has the meaning assigned to it under section 2 of the Private Healthcare Facilities and

Services Act 1998 [Act 586].
